  2. Hi, I got my receipt 9/16 and it’s an SRC (so Texas?) receipt no.  and radio silence since then .Just  did an erequest. Will see what they say and update. I know this is the Aug thread but I thought it was close enough ….. came to see if others were in same boat and yes they are! Can file citizenship this year so that may yield results before getting a non conditional green card 

  3. Sorry I can’t find threads on this though I’m sure there are many. 
     

    I’m adjusting through marriage from E2. EAD in hand and just did my 2nd biometrics for AP today. Today was also our AOS interview. All went well, I handed over my i693 medical which was not in my original packet.

     

    At the end of interview, we were given a notice saying our case will now be reviewed, if nothing else is needed from us we’ll get a decision in the Mail. 

     

    Most anecdotal evidence I’ve read suggests most get approved on the spot. What have others experiences been with this? I assume as my medical was only submitted today the officer needs time to review it which could be the reason? 
     

    Any thoughts on how normal it is to get this letter or if I should be worried?

    The other users are talking about K1 medical done outside the US, which is valid "forever" as long as you file for AOS within 1 year of the date of the medical.

     

    Remember that this topic is under the K1 section of the forum. And 99% of K1 don't do the medical in the US.

    Wow I had no idea this was a K1 forum specifically, thought it was all AOS! I’ll bow out and find the right thread LOL.

    Pretty sure it’s only valid for 60 days before you file, then it’s good for 2 years while application is in progress

    help if outside of processing time. Even if yours is not the friendliest toward immigrants,  check his/her website as I’m pretty sure they all have to assist with federal agencies which USCIS is, even if they dislike immigration....

    What we do have is shared lease, shared health insurance, shared car insurance, shared phone contact (only have bills to show both of our names) and we do have a shared bank account, which for now is also in my maiden name due to having no ID. 

     

    For some places it can take a while before the interview is actually scheduled, mine was scheduled within a day and was scheduled for 1 month after the notice arrived. What you could do is call your bank to see if you can be added to the account, we did this and went through their drive thru to sign the paperwork, they suggested this and we later asked for statements in both of our names. Car insurance, I could add online without having to call or go somewhere.

     

    I expect officers to be a little understanding that we cannot provide more than what we got since, we don't have much more and COVID kinda made things harder. If I were you I would try and get you added to the bank account, I read somewhere that they see that as a real positive thing. Just try calling them and see if you can do it at the drive thru. 

     

    What I have now for my interview next week is;

    - Copy of AOS package

    - Copy of every single paper filed in the past before getting married

    - Pictures together of wedding, events after and pictures with family

    - Copy of health insurance policy, car insurance declaration page and cards, bank statement and letter from bank, shared lease and a few phone bills in both names

    - Marriage certificate and copies
    - Marriage cards we got at our wedding
    - All letters we received from USCIS in the past

     

    Its a pretty thick file and people on this website can definitely give you more advice! I give what we have right now, we are just 24/25 so we don't have much more as of right now. 

    I’m also on Ready to be Scheduled for an interview but read it can take up to 2 years to get it, maybe that’s wrong. Also I’m confused by people on here putting together binders of stuff to take - when the AOS was submitted, each of us has provided evidence of a bona fide marriage so I’m not clear what the point of additional stuff is? I plan to take my packet and the originals of the copies sent in that packet, and my I-693, which i didn’t file at the time. Can anyone help me understand why you are obliged to take additional documentation to the interview?

It seems there is an option to do the AP for a year and then come back for the interview, get the GC and then apply for a re-entry permit.     To be clear, we do not "want" to live abroad. It's not that we aren't excited about the move and going to the U.K. But, it's a postdoc appointment for 2 years, with the option to extend for one more. After that time, we will return to the U.S. 

     

    Last thing, what exactly is converting to consular processing? I looked into it but couldn't find how it applies to an AOS (K-1 to GC). Could you elaborate? Thanks again for all of the help! This certainly is a difficult situation. 

    I think then you just wait for the AP and if it’s not here by Dec 30th, she waits here til it comes then joins you (easier said than done I know). If she has multi entry AP you’ll be able to travel back and to (I believed AP is only for urgent reasons or business but I’ve been corrected on that on here!) My only concern would be if you need to disclose to the USCIS that you’ll be outside of the country mostly for 2 years, as you don’t want to be seen to be hiding anything that could be material to your case.  I think still you need a lawyer. 
    Re the fingerprints not being applied to AP, there is lots of anecdotal evidence on here that that happens and people still receive the combo card with both EAD and AP. As AP processing time is still approx 6 months you could file a Case Inquiry as it’s outside of processing time (it’s a shot in the dark) and see if that gets you anywhere? Or congressman will sometimes help. Good luck!

    Pretty sure you can leave on AP for as long as the AP is valid. I don’t know how long that is but I think it’s one year. So you could use that and just hope that GC comes through in the next 12 months (you’d have to both come back to do the interview obviously). If that didn’t happen in time I guess beneficiary would have to return before AP expired and apply for a new one? I don’t know if any of this is allowed though! I would say you need to speak to a lawyer....if beneficiary doesn’t have AP by the time you leave for U.K. you’d have to leave them behind til it came through if you didn’t want to immediately abandon the case.

    I’m adjusting from e2 visa and while I had a biometric appt on Aug 27 and  update to Case ready to be scheduled for interview on Aug 28, it’s been radio silence since then (appreciate its only been 11 days but feels like forever....)

    Also be aware that only citizens are guaranteed entry, even if you have a green card, you don't have guaranteed entry. 

     

    Secondary screening is also rare for AP.

    It literally states the reasons in the instructions for the i131. Telling people AP is for any reason is dangerous!

    Really AP is only for humanitarian reasons etc. Not sure if birth of baby counts, it depends who you get processing you on way back. You are not guaranteed re-entry (but then if you’ve been an immigrant on a visa for a while that’s nothing new) but the risk is low. Secondary processing is a guarantee, she will

    be taken from the normal CBP area to another area where she may be interviewed or have documents checked. 
    it’s really a risk/reward call. I intend to travel if/when i get my AP.

    So weird, I was using my.uscis.gov. This is egov.uscis.gov and I had to sign up seperartely for the latter just now. This one is up to date whereas my.uscis.gov is not. Thanks for the tip. 

  15. Where is everyone looking for updates? I was using myuscis but got a notification from Lawfully, an app I’d forgetten I’d signed up for,  this morning telling me of changes to 2 of my pending applications. I checked myuscis and those same updates were not showing there. But if I put my receipt number into USCIS case tracker it does show the same updated status as Lawfully has and which Case Tracker app has( fingerprints applied). Nuts!
