Normally not. Normally 131 doesn't even require biometrics and if they need biometrics they use the one on file (if they haven't expired yet). But lately more and more people report the same experience you have. Perhaps it might be worth to call USCIS (and ask for a tier 2 officer) and see what's up. Now that all ASCs are closed anyways, there's no real time pressure.

Right I would think they could just use the one already on file. I'll definitely call to follow up. Thank you for your response.

  2. We just had are K1 visa interview  on 10/25 I'm the petitioner. At the interview I asked the interviewer if his visa could be expedited so he can fly back with me. I was told unfortunately no and that it will take 1 to 2 weeks to be ready. It was actually ready on 10/31 for pickup. I know others that asked and was able to pickup Visa in two business days so I'm assuming it's just luck on who does your interview.

Long story short my brother in law went in for their interview with his wife, the officer said they were approved. They get a letter saying his wife was in a common law marriage and he needs to prove saying that the marriage ended. Anyone know how to obtain a certificate of No Impediment to Marriage/Single Status from Jamaica. That's the only thing I can think of to prove she wasn't married before they got married. Does anyone know anything else they can use to proved that she wasn't married before they got married. He is A US citizen she is from Jamaica.

    Thanks

She can get a certificate of nonimpediment from the registrar general's department. I had a similar situation and was approved after I submitted that document.

Hello the wife needs to go to the registrar general's department  office in Jamaica to get a certificate of no impediment.

  5. I recently received a RFE on my K1 visa petition. I've since responded and received an approval. However on my RFE I noticed the beneficiary middle name spelled wrong. Looking back over my paperwork this was my error in the original petition. Along with my response to the RFE I pointed out that the beneficiary name was spelled wrong. I included the corrected I-129F form page as well as a birth certificate. The approval /NOA2 still came back with the wrong spelling. How do I go about resolving this?

  6. *****Update*****I just wanted to post an update in case anyone encounters a situation similar to mines. I responded to my RFE with a certificate of nonimpediment and a letter signed by a JOP( justice of the peace). The letter was generic and just stated common law marriage is not legally binding in Jamaica. After 21 days of waiting I received a response today. We were approved. I did not consult or retain an attorney.

Technically they are supposed to register, but a lot of times it is not revealed until common law spouse files for child support and part of the house and land.

Do you know if a common law relationship that was not registered and has been terminated is still considered legally binding?

You will need to consult a lawyer in JA.  To be deemed a common law marriage, they lived together for 5 years or more.  JA treats common law marriage just like regular marriage and if the relationship has been dissolved it is filed in court to be considered a legal separation.   His common law spouse can file for child support, alimony, and part of all property owned during the common law marriage.

He cannot just say that he moved out and left 2 years ago.

Thank you for this information. It's been really difficult trying to figure out what to do from here.

So how does the embassy know?

In the past when he was still with his sons mother and still living together he applied for a visitors visa. He applied twice and was denied twice.  She applied once and was denied as well. He did list her as someone he lives with at the time. I'm sure she listed him as well. That's the only thing I can think of. I don't have the physical letter from Immigration as of yet.

Thank you so much for your response. I've been checking everywhere and this is the most insight I've gotten on this topic so far.
