    When I inquired with USCIS, this is a reply that I got:

    Since the I-129F petition has been returned to the USCIS, all action on this petition is concluded and the petition will not be revalidated. 

    For I-129F Consular return cases where the K-1 visa was not issued, the USCIS may not be issuing any further notification about the case to the petitioner. In this instance, the petitioner may choose to file a new Form I-129F, Petition for an Alien Fiancé(e), with fee.
    We hope this information is helpful to you. 

    Recent update on my case is My Fiance called NVC and inquired about the status.. NVC told him that your case isn’t back yet to NVC and is under processing in Islamabad. My interview was on 3rd April.. almost 5 weeks now and case isn’t back to NVC means they might be reviewing it on embassy level? 

    How much time does it take for embassy to transfer the case from embassy to NVC? Any idea??

    My fiancé visa also got refused last month.. we met 9 times in a year after we got engaged.. I was in Dubai he came all the way from NY.. anyway now we planning to get married and apply CR1.. did you guys get an approval yet?

    My approval expires on 5th may 2019.. I didn’t receive any letter after my interview that why my case is being sent back to NVC they left us guessing and in extreme misery.. anyway we are planning to get married now and applying CR1 soon we shall withdraw the petition..

    That’s great.. almost a month has passed since my interview and I’ve heard nothing from the embassy.. the wait is so exhausting.. we are planning to withdraw k1 and get married next month to file CR1..

    Hi. For reasons of time we could not make the wedding. And as in the embassy we received the suggestion to re-enter a new application k1 but this time fulfilling the requirement of two immediate years of sight in person and we did so. No luck what we find. This has been extremely draining and sometimes discouraging. IN Ecuador

    Did you get refused again? Or still waiting for an answer?

    K1 Visa has validity. It expires. If there were something missing he would have asked you. But there was nothing.  So returning the petition and passport means its refused. 

    I've been through same process. They gave me 221g and kept my passport. But after 3.5 months they sent back my case. 

    Check your online status at ceac.gov. if there is no refused. Then you might hear back something good. 

    And if you love to saying it again n again that consular haven't said its refused or haven't gave you anything in paper then it wont change the facts. 

    The fact is when K1 petition is returned and handed back passport means its refused doesn't matter what so ever he said you.

    Unfortunately the CO of your country sends the case to NVC and lets him expire his case is valid since his approval in immigration. The same thing happened to me. In November I had the interview and my case was returned to immigration and this April I get this letter I share so you have an idea of how it works. It took 5 months to receive an answer from immigration.

    Yes we are thinking to do the same. I am just scared that what if they reject my spouse visa application aswell? We have waited for years already! 🥺

    I recall a recent case where the Pakistan CO determined that the couple was too married for a K-1 because they had booked a hotel room together once.

     

    To be clear, I have no idea precisely why the CO made their decision in this case. Nobody does. It's speculation. Only the OP and their fiance know the full details of the relationship.

    Our relationship is genuine the amount of pictures we have together clearly show the time that we have spent together. And we are liberal muslims and Pakistan is nothing like the world think it is. People have courtships and long relationships outside of marriage here! And we on the other side are engaged and already planning our wedding in the US.. I am thinking to file an apeal once I get a response from USCIS.. hoping for the best.

    But we waited for almost 2 years!! Of course we wanna be together asap!! 

    We cant stay apart this is effecting our relationship we have every right to speed up the process and choose the fastest possible way to be together

    If it’s against cultural norms they shouldn’t have an option to file a k1 visa for Pakistani citizens.

    I just called the US embassy they said they do not handle anything on phone calls. 

    What should I do now?

    how to get in touch with them can someone advise please!!

    NVC will not send you anything.  What they mean is they are returning your case so all future communication should go through NVC.     NVC will have it for a short time before returning to USCIS.  In a marriage visa USCIS will request evidence but with a K-1 it will sit until the application has expired.

     

    Having 9 visits unmarried is an issue for Pakistan.  This coupled with the divorce caused some scrutiny on your case.   You'll need to be sure you have the proper divorce documents (original divorce agreement, notices sent and final union council certificate).  Best bet would be to get married and apply for CR1 continue with consistent visits.

    Yes I now found the original document now. But the question is will they get in touch with me to submit the document now or not? If 9 visits are a problem they shouldn’t have a k1 visa option for Pakistanis then. 

    We filed k1 visa because it is the fastest!! And we wanted to be together asap

    It's not common, but I've heard it reported here that the person never received a slip.

    Even with the slip, it's not going to go into great detail over exact reason why the visa was denied.  Usually just a box checked off, and that's it.

     

    A way to figure out why it was denied is to go over the interview in your head with a fine-tooth comb...and also what sort of evidence was sent with the petition...Pretty sure there was more than just the 1 question asked about "where did you get engaged?"  Think back to what the CO seemed to focus on (if anything).

     

    You said you were divorced before, curious if this new relationship/upcoming marriage was arranged in any way?  There may have been some questions regarding that (ie. who arranged it,  how do you know the person who arranged it) to ensure it wasn't arranged moreso for immigration benefits.

     

    VO asked me who did we met through. I said  family friends in 2013. After that he also got married and I also got married; but we both got divorced and reunited and filled a k1 visa. He asked why not a spouse visa? I said because k1 is efficient and takes lesser time. 

    He kept asking for my divorce certificate and I didn’t have it.

    As mentioned in this thread, the visa was denied.  You are free to apply again if you wish, or apply for the CR-1 spouse visa after you get married (in your home country).

     

    What you need to do is figure out the reason the visa was denied, since you say you do not know...and if that denial reason will affect a future CR-1 spouse visa.  Sometimes they do, sometimes they don't.  

     

    The only part that confuses me is that VO said we need more evidence on the case and NVC will het in touch with you! If the visa was rejected he would have handed over a slip to me stating the reason isn’t it so?

    USCIS policy is to no longer review returned I-129Fs. They let them sit to expire.

     

    The line you got from the CO is in accordance with the DOS policy to return the petition, but no longer reflects what actually happens (USCIS has their own policies).

    Means Do I still have a chance to get a visa? He said NVC will get in touch with you for RFE. He kept asking for my original divorce certificate that happened in 2016. But I took stamp paper with me but he wanted original certificate.

    he just asked where did you met first time. Engagement happend in dubai, but My original divorce certificate was missing he kept asking for that I didn’t know which doc he requires after coming home I saw that I didn’t take divorce certificate with me i just took stamp paper with me

    Denied K-1s have their underlying I-129Fs returned to USCIS by the DoS and are left to expire by USCIS. A long time ago they were sometimes reviewed for possible re-validation, but now they aren't. 

     

    Your choices are to file another I-129F and hope it goes better, or to marry and then file an I-130 in pursuit of a CR-1.

    But VO said NVC will get in touch with me for RFE. He didn’t say that visa is rejected and didn’t hand me over any slip stating a reason.
