    My fiance' is a US citizen after birth. He was born outside the United States and he is a U.S. citizen through his parents, but he lost his certificate of citizenship years ago. HE can't file the I-129F because according to USCIS he should wait for his New Naturalization Certificate (which he requested 7mos ago!)

    Question is... is his passport not valid as proof of his citizenship? can he already file the I-129F even without the certificate, just a passport? Our I-129F is on hold because of this. We are still waiting for his certificate replacement. USCIS site states that N-400 takes 6-9mos of processing. but thats for those who are applying for naturalization. my fiance is just asking for a COPY bec he lost the original. does anyone know why the copy is taking this long?

    Well, good luck my friend. Best wishes to you and your SO! The time is finally near. I agree with Mister Fancypants; just help her feel confident, relaxed, and be herself. Sure, being nervous and anxious is expected. The pressure is really how much you put upon yourself. But, I think you've prepared each other well for the interview. All the paperwork is there. All the necessary tools are there. Best wishes to you and your SO again!

  3. Hey guys just looked over my 129f and noticed theresome errors. I know I should have looked over everything more carefully, but is there anything I can do? its already been approved and being sent to the embassy in Cambodia. I had some type it up for me, I thought I looked over all the paperwork carefully enough. I'm freaking out now because I now my fiance might not get to come because of my mistake. help!!!!

  4. we got same notice too that uscis will forward our papers directly to the listed consulate without mentioning that it will go thru nvc first but actually it did go to nvc because they are the ones who assign case number, just keep calling nvc and check if your papers are already there. hope you get positive response soon. goodluck

    just send a regular email to them..indicate in your email, your Receipt Number, petitioner's name, beneficiary's name & NOA2 date of notice.

    Wait for at least 3 weeks from the date the NVC sent your petition to USEM then call the Department of State to ask if you already have your interview date and medical. . goodluck

  8. that's the stub that has the beneficiary's name that you need to show at the window 34 to pick up the visa, and also the guard won't let you in without it..

    So if I go with my honey to the interview I can ask for the visa and get it instantly? The pink slip means I can walk to another window and walk back to the hotel with her visa the same day?

    no. not the same day. after a few working days.

  9. Hi Guys!!!

    Am feeling down here bcoz of my NVC status. I dont even know where is my NOA2 hanging now. I was approved by california sevice center since June 19 of this year, but until now the NVC dont recieved our papers. Its more than one month now. I did phoned and email the NVC, same answer they dont received our case from uscis. So i did phoned USCIS to locate where our papers now but they cant give me a answer. NVC said they havent got our case yet. Then USCIS said our papers will not go through anymore in NVC, they will send our case directly to my consulate or embassy. Am soooooooooooooooooo confused. I dont know now what is the best action i should do now. Any people who experience this kind of case. and what is the best action should i do now. aside from calling.. emailing them.. or should i just wait again and do nothing..

    we got our NOA2 email notice last June 20, 2007. Until now, we havent received any hardcopy of NOA2 though my fiance already called USCIS to inform them that we didnt receive y copy of NOA2 & that we are requesting for a new one.

    Then, we follow-up NVC for our manila case number (update of WAC number). We made follow-up thru email. As in we're sending an email to them everyday from July 9.

    Then, finally, we received response to them last thursday - July 19 indicating our new manila case number.

    If you want, try to send follow-up emails to NVC.

  10. If your buying it in the PI, they are all unlocked. I brought a few back with me from the Philippines and didn't have any issues. Nokia N73, SE 850i and some other Nokia........

  11. Nope, that is the last you will hear from USCIS, once they hand it off to NVC it is out of DHS's domain and into DOS's domain.

    give it a few weeks then call NVC for case number and status, NVC's automated system wont have K-Visa cases, you need to talk to someone, or email them.

    guys, me and my fiancee, we're thinking of going straight to guam after i get my K1 visa. is that possible? but for now she's still in kansas working. is there going to have a problem coz when we filed our K1 she's in kansas working. can i go straight to guam or i should go to kansas first then go back to guam? can guam be my POE? thanks in advance...

    Guam is a US Territory and you can go there straight and Guam will be your POE.

    thankyou! does may fiancee need to file for change of address or something?

  13. I'm not entirely sure how this works for US territories, but I don't think it should be any different. After you activate your K-1 visa, you will have to be careful about taking any flights that may transit through another country. Well at least until you receive your green card or AP. I think you should be fine going to Guam directly if thats where you plan to live.

    thank you for the advice and yes we're planning to live in guam just not sure if it is possible for me to go straight to guam since she lives in kansas when we filed our K1. and she's still in kansas right now. i dont know if i have to go kansas first before going to guam since guam is also a US territory.

  16. i will only been working for 8 months when i file my tax returns this coming January.because i have been in the Philippines for the past 4yrs. but i currently gross 2000 dollars a month.

    can i use my mom as a co-sponsor?but i am confuse with the poverty line.something about household size.since im living with her, am i considered as part of her house hold.there are 3 of us in the house and we all work.does this mean we are 3 in the house hold?and counting my fiance would that be 4?so my mom as a sponsor would have to be making 25,000 dollars since we will be a house hold of 4.am i right?im very confuse?but she doesn't make that much a year.but if i annualized my income i will be making 24,000 a year.how will this effect my petition? please explain?just wanna be prepared for everything...

    My understanding is:

    1. YOUR ONE YEAR income for the year you filed your PETITION must be at or above the 125% income guideline. So if you only worked 8 months, you had to have met the guideline levels.

    What are you reading in the memo that leads you to believe one cannot annualize the income from a job they just started?

    Okay, maybe Im wrong but here is the quote:

    "(e) Sufficiency of Form I-864.

    (1) In general. When determining the sufficiency of a Form I-864, USCIS shall first consider the sponsor’s anticipated income for the year the sponsor signed Form I-864. Thus, during the initial evidence review, USCIS shall as a general rule determine the sufficiency of a Form I-864 based on the sponsor’s reasonably anticipated household income for the year in which the sponsor signed the Form I-864."

    The way I read it...is the anticipated income for the year. In otherwords they will anticipate (meaning from that day forward to end of year) the income that sponsor will generate. So if you start working in JUNE and they are looking at it in September, they will anticipate the income you will earn for the remainder of that year. Key word is "anticipated"

    ANTICIPATED:

    verb: -pat·ed, -pat·ing, -pates.

    transitive verb

    1. To feel or realize beforehand; foresee: hadn't anticipated the crowds at the zoo.

    2. To look forward to, especially with pleasure; expect: anticipated a pleasant hike in the country.

    3. To deal with beforehand; act so as to mitigate, nullify, or prevent: anticipated the storm by boarding up the windows. See synonyms at expect

    4. To cause to happen in advance; accelerate.

    5. To use in advance, as income not yet available.

    6. To pay (a debt) before it is due.

    So with THAT information...this is how sponsor income is calculated. Any other ideas???

    K1 visa doesnt use I-864! K1 uses I-134 form!! :whistle:

  17. hi fellow vj'ers!

    i had my early medical at SLEC last july 16-17, supposedly i am scheduled on july 30 but i prefer taking it earlier so that my anxiety will be lesser and all i would think about would be my upcoming interview..

    i woke up early last monday but the taxi driver don't know where SLEC is located, so i arrived around 8AM..it wasn't easy and not a walk in the park at all! but the step by step procedure the guard gave me when i came in was very helpful plus the guide i got from visajourney..i finished around 5:45 in the afternoon and they asked me to return the next day at 1:30..

    so the next day, i arrived at SLEC at exactly 1pm and go directly to the 2nd floor for the vaccination..i was only called for the shots at exactly 2:30! :o well im afraid of needles but it wasn't as painless as i thought it would be..then they asked me to go at the ground floor and wait for my name to be called..at exactly 3:30 i was called by counter A and they asked for my passport and 2 copies of 2x2 photos and sign some forms..then again..i was asked to wait again..then i was called by quarter to 5 at counter D..the lady asked me some questions about the information i have provided in the forms i filled up on the first day..i think they are confirming that everything written there are correct and accurate...finally she gave my my vaccination record and my x-ray film! yehey!! according to the visajourney, this is a sign that i have passed the medical!! i'm so happy! :jest: when i got home i immediately told my fiance about it and he was also happy!! :jest:

    the waiting is really killing me for those 2 days of medical but nevertheless i gained a lot of friends aside from bien(my vj twin) and jenneth are also there.. it was all worth it because it lessens my anxiety..and most of all to finally be with my one and only love :luv:

    all i have to prepare and wait now is my interview...

    hi rea, as you have said if they give you the vaccination record and x-ray is a sign of passed. then what is the sign of not passing? if you dont mind me asking. just curious lol!! thanks in advance
