The one thing I did not see, that due to you not filing in your timeline, what country is your "run away wife" from?
I am married to a wonderful Filipino woman, but I have been reading some bad stories on this site, about women from the Philippines. To me, they make the best wives in the world, but my friend, just had his Filipino wife leave on a one way ticket back to the Phils. and was going to Austria with another guy.,.,.,.,.
So, in short, anything can happen, do EVERYTHING listed above to protect yourself.
Please note, THIS is nothing at all about any negativity about Filipino women, my wife is from Cebu-Mindano, our marriage is wonderful!

Hi everyone! On June 9th, it will be 5 months since my NOA1. I was told to call USCIS after the 5 month period and put in a service request. Additionally, I was told that the 5 month span was an "estimate" between the NOA1 and NOA2 for Texas. My question is.....how long do you get the NOA2 after the service request? Why do some cases take shorter than the 5 months? Does this mean they lost my case? What is the next step after the service request....
Sorry about all the questions....just find it mindboggling that it has taken so long and hasn't been touched since January.....
You should be getting the NOA 2 from USCIS soon. The NOA 2 does not come from NVC. Once they assign NOA 2 to your case the case will forward to NVC.
At the 5 month point you can request a service request. The time required isn't known but you can expect at least 30 days.
Some cases take less time but the reasons for this are difficult to define.
Your case isn't lost. The last step at USCIS is to assign a bar code to the case. This code is then scanned into the NVC system when the accept the case. This procedure takes longer than we think so during that time the case may appear to be lost because neither USCIS nor NVC can " find " the case. USCIS will tell you they don't have it and NVC will say the same because it wont show up in the computer at either agency. These facts were related to my husband by USCIS officers in two locations.
You can ask a U S politician to help you by finding yours on the web. They all have staff trained to placate the public so just send in the form they require and wait for them to contact you. They will contact USCIS and get back to you telling you what you already know. This will also take about 30 days.
Unboggle your mind and try to accept that they are always way behind with respect to these touches for example. My case never showed a single one during the 408 days. I have seen may cases here on V J where the same thing happened.
My own case took 408 days. These things I have told you come from that experience.

Thanks everyone. Fortunately she does not have access to my bank account. She has a duplicate of the house keys though. Regarding Vawa, we only had verbal fights and i always just give her a silent treatment and ignore her. do i still need to contact the uscis even though we didn't file for aos?

Hi everyone! I'm here to ask for any advicE especially a legal advice. To make my story short, I arrived in US thru a k1 visa and got married way back Dec2011 but marriage did not work out so I decided to go home in the Philippines last Jan2012. I did not able to file any adjustments of my status. So I went back home with nothing and I was devastated back then. I know that our marriage will be no longer work cos I did everything for him, he abused me mentally, and he always kicked me out just because of misunderstandings, a lot of reasons that I don't even wanna mention anymore. He is just not good. He was married to a filipina woman before and it only last couple months just like what happened to us. But, things happen I moved on and happy now. I finally meet someone who truly love me for better and worst. And we wanted to start a happy family together in future. Now my questions are;
1. Is it possible for me to file a divorce even I'm outside in the country by just having a lawyer who will represent me? (MarriedinVirginia,USA)
2. I only I stayed there for 5 months I think. Would it be still possible?
3. How much it will normally cost if we file the divorce uncontested?
4. It is also possible for me to file a tourist visa? if its possible for me to file the divorce.
5. Please if you know anyone who can help me with my case, please feel free to message or comment.
6. Legal advice much appreciated or any help would be great.

Its possible to divorce from outside the USA. Plan on spending thousands. Why not let the USC file the divorce? You wont get anything anyway so why fight it? Uncontested cost would be a few thousand depending on where its done. My husbands cost about 5 K in Calif many years back.
Tourist visa? You have already demonstrated your intention to live in the USA and that you aren't tied to the P I so you will have a difficult time getting approval. However you can apply as many times as you want.
I am hope your new relationship works but you didn't say if that was with another USC. If so plan on some problems with USCIS. The fact that you went back on your own will help you next time. Be very careful with next time !

hi, my wife came here on a k1 visa and we got married a month after she got here. she's been here for 5 months now but we did not adjust for status yet. Our marriage has been rocky from the beginning and we have a conflict most of the time. Just recently she ran away while i was at work and won't tell me where she is. She had all her belongings except the ones i gave her. She also took our marriage certificate. My question is what should i do to protect myself? can i file a divorce right away? can she adjust her status without my consent? thank you.
Stop any ability she may have to access your money by ATM ect. She must have had this planned so she is with a " friend ". Beware of anyone calling you at work that you don't know.

I thought the same thing. She has good street smarts, but something is clearly clouding her judgement here. I'm sure it has something to do with face. Going back empty handed would make her look bad.
I hope you see that she leaves with what she brought and not much more. She already looks bad in her village and to her family because she told everyone that the plane was taking her and some of them to easy street. They all think life is what they see in the movies where everyone is rich ect. Its the Willy Wonka golden ticket they seek rather than a life here where we have to work for what we have.
She has lost face and will go back to tell a series of lies to try to overcome that problem. In time this will soften the blow to her ego and allow the family to recover some but they will live with this for a long time because the village wont let them forget. This is the price paid for what she has done.

Exactly. They are gathered on the grass ( plastic ) mats under a tree right now discussing this tragic story while trying to do damage control knowing its too late.

That scenario has human trafficking written all over it. Once in LA they'll probably take her passport and she'll be laying on her back working to pay back the money they fronted her to get to L.A. There's no way in hell she can get a visa without going back to Thailand and applying for another one (unless she goes the VAWA route.) Her being from Isaan, I'm surprised she would fall for something like that. I'm sure she knew many people growing up there who were promised good paying jobs in Bangkok only to end up dancing on Cowboy or Nana with number 58 strapped tho their bikini top and getting short timed 3 times a night. But hey, she's got it all figured out. I'd tell her Chok Dee and send her on her way. You pulled the I-864 so your obligations are over as far as immigration is concerned.
She really needs to go back to Thailand, but I doubt she will.
Karee is not only right but he must have seen a girl from my home town because she uses # 58. " Short timed 3 times a night " is a classic. I love the sense of humor.
My husbands dad used to say " give them a kiss on both cheeks; paint a red X on their a$$ and ship them ". Some reference to selling cattle I think.

Ok, a bit of clarity today. She has been talking with a Thai woman in LA who just "happens" to be from her home town. This lady is offering her a flight to LA, and good paying job and a 6 month visa. All pre-paid. She can pay them back when she has the money.
Obviously, I don't want anything bad to come to her. I have contacted all her family. (who don;t think I'm a scumbag) and told them they need to talk her out of this if they ever want to see her again.
She has been getting terrible advice all along. Almost as if they wanted to put her in a vulnerable and desperate position. Clearly she was stalked on Facebook and targeted.
I feel bad for her, but all I can do is tell her it is a scam. To which she responded. Oh, she would never lie to me she is from my home town.
I hope she starts making better choices.
Let me guess that this home town hero " lawyer " lives in or near Thai Town in the L A area. What she will encounter if she believes this latest liar is basic slavery and extortion by the homie. Please don't help her in anyway to do this. She will disappear into the wilds of the L A scene while becoming another illegal working for nothing. Maybe she can see that the offer of a 6 month visa is a lie simply because she doesn't need a visa because she is already in the USA therefore the whole thing is an attempt to get her to L A. Her destination must be Thailand if she is to remain free and safe.
Slowlyman be careful what you do with her family now. They will do whatever they can to put her in the best position to gather as much money ect as they can because she is family and to save face which is foreign to Americans. The people in her village probably already know much of whats taken place and have begun to talk. Its a blood sport in Thailand where they love to see these things happen to others. Here its called petty jealousy.

I also had a thought that probably she just made up about visa thing or lawyer. But, after went through all the visa process, she should known better that she can't lie to her soon-to-be ex husband about obtain any kind of US visas. Or I am just too naive thinking that way about her.
She was lying to him throughout this ordeal in my opinion so she thinks he will believe her I suppose. She is just trying to get anything she can but karma will follow her.

Ning We have the police certificate. I am asking about filing a report to the police for the lost old passports? I am wondering if that is required or not.
I don't know but I wouldn't think so. I don't think the embassy will care about the old passports anyway because they are useless if found. I would suggest she just goes thru with the interview and hopefully no one will bring up the lost passports. Just have her present what she has.

OK So We have made it this far and was wondering if anyone especially those who had there interview in Thailand can lend me some advise. Her interview is the 27th and I feel pretty comfortable about it we have been together since 2009. Lived together for half that in bahrain, We have a daughter together. The problem is thailand Packet 4 says to bring all old passports that was used for overseas travel. She has her current and the one from before we got married but the one before that is old and cannot find. She went to file a police report and they said she cannot unless she has the Passport Number. Would this be reason for a denial? Or major delay in her getting her visa? Has anyone else experience anything like that. I am open to hear from all and thank you in advance.
She can only show them what she has and that will be enough. They just want to see her travel outside Thailand which helps indicate what she was doing in other countries ect.
File a police report? You must mean requesting a police report. Why doesn't she just use her current passport if they are asking for one? To get the police report she will need a copy of NOA 2 or something that indicates why she is asking. This will take 2 weeks to a month in normal circumstances. Of course we all see what is going on there now so plan on much longer and hope for the best. It was a mistake to wait so long to seek the police report because the report is good for 6 months anyway.
The embassy will not issue the visa without the police report. She can interview by indicating she will hand carry the report asap. The delay will be as long as it takes to obtain that report.

Apply a tourist visa It means she has to do that in her home country. There is no shortcut for get a tourist visa in the US. There is no the US embassies/consulates in the country. In order to get a tourist visa, she needs to attend the interview at the US embassy/consulate. I have no idea where she gets the attorney who gives her such a bad advise. And no any attorneys can use their power to influence the embassy to issued a visa.
The " lawyer " has to be totally ignorant of immigration law and circumstance. My guess is this " lawyer " is driving a tuk tuk or a bar stool in Thailand. She is probably calling Thailand trying to save face because Slowlyman is divorcing her therefore she will be forced to go back.
She will never leave Thailand for the USA again due to what she has done to her husband I hope.

So, my soon to be ex wife is telling me she has found an attorney who can get her a 6 month tourist visa.
She entered on a K-1, we married and filed the AOS
Her AOS has since been scuttled
The marriage will be scuttled soon
Does this make any sense to you guys? Can this be true?
The lawyer either doesn't exist or doesn't know anything about immigration matters. I wonder if she has been talking to some Thai people about what to do rather than a lawyer. This type of thinking is common on the streets of Thailand.
This is just an attempt to either make you mad or extort money because there is no way she could get a tourist visa now or at any time in the future. Her track record will now follow her even back to Thailand where any future attempts to get any visa will be very difficult because of what she has done. She will never be granted a tourist visa.
If she stayed those 6 months what would she do? She cant work; may not have money including legal fees. Where would she live?
Slowlyman you found your way thru the maze to help her arrive. Just use that same thinking to ease her out and you will finally exit the maze a little wounded but whole again. I am sorry this happened to you and hope for the best now.

In my opinion,As I noticed my case online and people who got under 221g in Thailand( we have THAI USvisa group ),Yes,I will say in Thailand only before we will got visa approved,At first,Status will show "Administrative Processing " ,after the Consular person bring your case to consider again and you get approved, it will show you "Ready",after that ,I mean next day,it will show you "Administrative Processing again",then finally,it will show you "Issued"

I remember your previous posts about the case. In the beginning you thought the problem was due to your transgender status or that you are in a same sex relationship. I think its important to make sure other people understand that the problem with this case seemingly wasn't about either circumstance.
The sole problem was due to the embassy wanting some documents about your breast surgery if I now understand what you have said. Maybe this will serve as notice to others to make sure they have a doctor submit these docs.

As you full well know Ning I entered this discussion under the belief that this was legal as did the OP, so get off our backs, there will be times in this process where you think something is acceptable and it is not, get over it.
So here you are attempting to chastise me and you think that makes the horrible advise you gave the O P ok? No.
You entered the discussion advising the O P to do something similar to what you got away with. You and your employer knew what you were doing was wrong which is evidenced by you referring to the valuable opinion of that same companies lawyer. Why would you or they even need to ask the lawyer or the insurance company ? You just did what you wanted thinking as you do now that you got away with something; evidenced by your statement about relevance. You did get away with breaking the law. At least so far. So just accept that as fact and get over it.
I made a mistake about the non profit situation. However unlike you I have never broken the law to gain anything.

The USC in this case should make an Info Pass appointment to go sit down with a USCIS officer in person. See USCIS web site to set this appointment.

How do we answer Question #13.d. "Have you obtained a Certificate of Naturalization or a Certificate of Citizenship in your name?" Yes or No?

The answer is no because he is a natural born U S citizen. His birth certificate is proof of that.
The question is designed to be answered by those of us that gained citizenship by other methods.

There we go Ning we were both misinformed and now we both know the rules, so you can stop chastising the OP for considering a volunteer job providing it is for a non profit company and won't lead to a job, because that we know is perfectly legal
I will accept what T has indicated as to volunteering at non profit places. However the O P never said she attempted to do that. It was your idea to have her attempt what you got away with. Much later you suggested the non profit angle.
It was and is the O P that made the honest statement where she said " When they know I do not have work permit they do not even want to continue talking". That had zero to do with a non profit and you know that is true.

Regardless of my situation turning out to not be allowed Im a paid employee now so it is irrelevant and the OP now knows they should avoid it even if a lawyer oks it so add something productive to the original question or leave. You are in violation of the TOS of this web site by advising people about how you broke the laws. You continue to give that advise now. You admit finally that you broke the law in taking a job. Its irrelevant now? Maybe because you didn't get caught. It was you that was advising people that a lawyer approved your job. Of course that same lawyer was paid by the company that wanted to use you as free labor. You went along with the idea because you wanted to cheat the system.
The only reason you now admit it is because of what you read that I posted here so others including the OPs husband could accept the laws and follow them. That is productive to me and I could care less what you think I should do.
Any effort at working as a volunteer at any organization is a violation of the law. Profit is irrelevant. Working is not allowed until the immigrant has the legal documents to do so.

Is there anything wrong with this kind of volunteer? And about the education that you are saying, I do not have anything to say to that because it is irrelevant, it is my right to do or not doing anything ( I hope a US citizen like you probably understand the concept of right) and it is a waste of time to respond that to a person like you.

I did not get any possible compensation. And it is barely an interviewing for job, it is more like a talk. Is it illegal to go talk to someone asking them if I can do volunteer work for them?

You do not have a " right " to do anything you want. I certainly understand my rights under the U S Constitution and the laws of our country.
Do I know what you tried to do? All I know is what you said you did in your sentence. " When they know I do not have work permit they do not even want to continue talking". You tried to apply for jobs but were turned away when they realized you weren't able to supply the LEGAL documents required. You were trying to interview for a job.
I understand you didn't work. They didn't want you or you would have done it. You still don't see what you attempted to do was wrong and illegal.
You still ask if its illegal to ask companies if you can do volunteer " work " for them. Yes it is illegal. Read the info from Duke again.
The basic concept here on V J is to gather info for many people to review that may help them in their case. This is why these posts are important. Your situation can serve to keep others from making these same mistakes as you have made.

There is one this I do want to say however: Are you a lawyer? I suspect you are not, and if not you really have absolutely no reason or credibility to be questioning the legal opinion of a lawyer. It also seems like you do not have a good understanding of the US legal system. The opinion of lawyers is essential for shaping our law. Law are created, then adapted, shaped, and clarified through litigation. The understanding of laws is advanced by lawyers who have studied the law and present their understanding of it. This is part of the long tradition of Common Law that we inherited from the United Kingdom.

Here is some legal info from Duke University site. Find volunteer activities. Begin with # 5 . Then come back and explain about what the lawyer did in one case that you want to site. Remember these lawyers are following that long tradition.
" From the DHS perspective, if the alien is providing a service normally provided by a paid employee, then the activity is work and the alien is receiving the " compensation " of valuable training or experience and / or the "compensation" of possible future paid employment. It does not matter that no money changed hands at the time the work was being done. Being paid or compensated in the future, does not change the fact that one is performing real work in the present. For example, you can not serve as a lab technician while waiting for work permission that will permit you to do the same or similar work for pay ( Cam 54 ) . In that case DHS sees the current " volunteer " activity as work that is " holding " a position for the future and is therefore compensating or " paying " you with the reward of a future job".
Your wife can not volunteer to escape the laws you speak of just because Cam 54 did so with the permission of an poorly informed but paid lawyer.

My understanding of the legal system here is good enough for me to have become a U S citizen. It was also clear enough to allow me to understand I couldn't go to work until I had a legal method to do so. Your wife has already tried to circumvent the laws as she has said here on V J. She then wants to believe the member that took a job illegally because one of these lawyers you think are the experts said they could get away with it. Why hasn't she contacted USCIS or better yet why haven't you?
I also understand that these lawyers you think shaped the laws fight in court for their clients. We see great lawyers work on the mafia type cases ect. They kept Gotti out of prison for years for example; during which he continued to kill ect. Don't try to sell the virtues of lawyers to me. You didn't use one did you? Why not? What about that long tradition?
Since you and your wife are interested in the foundation of our laws why not simply learn the law and follow it? This would have to include a clear understanding of the fact that under those laws immigrants can not work illegally. A job as a volunteer is still a job in the opinion of the lawyers at USCIS. Call them yourself. Talk to a lawyer that isn't being paid to tell you what you want to hear.
Here for example is a direct quote from the person you say isn't trying to operate in the shadows. She has been applying for jobs without the legal ability to do so.

The co sponsor can be anyone that is considered a close friend or family that lives in the USA. His income will not be enough as you know. His assets would have to be liquid to be considered. Equity means nothing unless those items are sold. The cars are worthless when it comes to this situation for example. You need to find another co sponsor.
You also submit the 864. Indicate your V A income. If you dont submit tax transcripts you will probably get an RFE. Send tax info for the last 3 years along with a statement about the missing years.
Unemployment income would be ok so file for it asap.
You can always attempt the expedite but it will be denied. In my opinion there isn't going to be a " war " as you describe. Keep in mind the common people have no weapons ect and are not organized in the way they would have to be to fight as you think. Sadly what we see in my country is not uncommon but hasn't resulted in a civil war. The King or Prince will have a huge influence on the people.
