as per IRS understanding, it is for tax purpose.  A husband and wife if they want to claim spouse benefits according to their work status they filed jointly.

    Options on Form 1040:

     Are you filing

    1) Single

    2) Married filing jointly

    3) Married filing separately

    4) Head of Household

    5) Qualifying Widow(er)

I am the beneficiary, not residing in USA. I am not filing my tax return separately in USA, anyway.

Therefore, My petitioner is technically filing return as single.

NOTE:  THIS IS FOR TAX PURPOSE. WE ARE NOT LYING.

ACCORDING TO FORM WE FILL UP THE DETAILS.

You should file “married filing separately”, not “single” because you are not single.

I called NVC and was able to speak to someone who was more informative than most.  This is the issue at hand- everyday NVC sends  new case/ invoices to CEAC in Washington DC.  They said that between dates 2/20-2/25 for some reason, CEAC in DC did not update their system.  CEAC began updating again 2/26 forward so those people have no issue.  He said that currently dates 2/20-2/25 are in a black hole........... and that we are awaiting a CEAC update to put us into their system correctly.  Yes I asked about obtaining a new case number that would work.... their reply was that you cannot just re issue because this number is already assigned to our case and a new one would not work either...(I did not understand that reasoning too much...) He also stated that we cannot pay via mail because that is our embassy's decision not ours.  He said that in our current cases, expediting wouldn't even help because we'd still need to use CEAC........ if anyone has any ideas or thoughts please let me know.

I think we are totally screwed...especially because it affects a limited number of applicants. It definitely does not seem like it's much of a priority for CEAC to fix, given that it's been going on for nearly 2 weeks.
