Haha was this Dr. Brauer then?  My fiance has talked to the office before but he's not had the pleasure of meeting him yet.  Sounds like a solid bloke ❤️

Hiii! It was him! I was laughing like wait.. this visit isn't for me but at least I am glad he agreed to see me because I was sick! Definitely solid!

[You might not have a principal residence or be domiciled in the United States. Please submit proof of domicile. For more information on domicile requirements, visit https://nvc.state.gov/fin.]

I received the above message after I submitted my documents to nvc. I am living out of USA since 2012 up to now. But I have a house mortgaged in USA and currently one of my friend is living there and he is co-sponsoring my wife.  I am planning to go with my family and start living there. So how should I reply to above message ?

Do you have anything else tying you to the USA like a bank account, business, remote job from a USA based company, tax returns, USA based cell phone or anything else? How often are you in the states?

~~Moved to the Regional forum, from IR1/CR1 P&P - as the topic is more about the medical experience then a question.~~

HI! Can you please move it to the Africa:Sub Saharan section since it's South Africa? Thank you!

  4. Last week my husband had his medical exam in Cape Town, South Africa. I went with him to the office. I waited in the reception area while he was getting checked in. I hadn't been feeling the greatest that morning and all of a sudden, I got choked up and ran out of the doctor's office...ended up throwing up all over the floor just a few meters away from the door. My husband came out running to check on me. I told him I wasn't in any condition to come back in so just call me when it's done.  He stopped at a nearby pharmacy to get me some medicine and I just waited downstairs.  He went back into the office and started his exam. The receptionist told the doctor how sick I was.......they told my husband to call me and the doctor demanded that I see him..... lol ended up with some prescriptions and now I am feeling much better!

This is probably crazy since the medical exam was for my husband but I turned out to be the sick one and needed the exam! LOL..

    Anyone else have this issue?

My I-130/CR-1 visa story has ended, as of today I’m officially a lawful resident of the USA, I hope everyone that filed in March has had their approval by now, and if not - I really hope you’ll get it soon! The wait is tedious and long, but it’s so worth it once you see that stamp in your passport.

Congrats to you!!!! My husband's interview is next week and we're excited about everything. It has been a long process but definitely worth it!

  6. I know you didn't ask for mental health advice but I feel like you are trying to marry this person to fill a void in your life. If you're going to do this, you're going to need to be able to follow all of the protocol as listed by the USCIS. You're going to need a sponsor and the value of the house doesn't factor into play here. Either you figure out how to earn more income or just hold off for a while. This isn't idea and if you barely have funds now, it's going to be even hard as you'll now need to support yourself and him (depending on how long it takes to find employment).

Anything is possible but this requires some divine intervention. Best wishes.

As part of CR1 visa, my spouse got IL from NVC and interview is scheduled for May 2033 end.

I have already uploaded year 2022 Income tax return transcript and is verified by NVC as per DQed process.

Now as my spouse does not have SSN/TIN, I have filed Income Tax return for year 2023 physically by sending the required documents by post to IRS.

I don't think it will get processed by IRS by May 2023 end. In this case do I need to upload Year 2023 tax documents like form 1080, which I have sent to IRS on CEAC site or is it fine if my spouse just takes copies of the year 2023 Income tax documents i.e. form 1080, W2 and latest pay stubs during CR1 visa interview without uploading them on CEAC site?

I think you just need to bring it. My husband and I are waiting for his interview and the email we received said that at the time of the interview, assets, income or proof of current employment might be required. So for me, this means just bring it.

    Hi,

I have a New Zealand husband and I (US citizen) submitted our i-130 last year 01/09/2023. Still waiting for a response. It just shows our case is taking longer than expected. I see on the website the processing time is now 14 months. Did anyone have any luck with theirs getting approved?

We have his work rights approved, waiting on his travel rights: the advanced parole (that says 3 weeks, hopefully, took them about 6 months to process that).

I'm a February 2023 filer and we were approved for the I-130 in January 2024 so it was 11 months for us. I don't think you can contact them until you get to the priority date or whatever it is called.

If you have started the K1 Process, why not stick to it.It is faster than CR1 and you dont have to waste time and money starting another petition

As long as you do not get married during the K1 process. You should be fine. You can move to South Africa and live as Fiancée

Thanks newbutold but this doesn't exactly work for my situation. K1 is faster but is it really faster if my future husband has to sit here in the states, wait on employment authorization and AP. If I move to South Africa now, I would be moving as someone who is getting married not living as a fiancee. I understand your post but it isn't ideal for my case. I was already planning an international move this year but happened to meet him so plans just had to be rearranged.

6 months from time of medical he must enter. But he can turn around and go right back to Nigeria and time he wants. Shouldn't stay longer then 6 months at a time though.

Thank you! He's a South Africa resident so he'd be going there. I gotta think this through. Thank you!

His CR-1, when he receives it, will usually be valid for 6 months from the date of his medical exam, he will have to enter the US within this time frame. The expiry date will be printed on his visa when he gets it. The whole process will take around 12-14 months, give or take.

Thank you! I told him it's a long process and we can make a decision whenever it processes.

One other thing that is different is you will file the I-864 with will need to show that you are at 125% of the poverty level.  If you have moved to his country and you don;t still have income from the US you will need to qualify based on the asset section of the form.  Otherwise you will need a joint sponsor.

No issues here. I own a business so I am pulling more than the minimum amount required.

The petitioner can re-establish domicile anytime before the beneficiary enters the US or they can go together.  I maintained my residence in the US while we lived in Mexico.   I included copies of the HOA, utility and insurance bills.  No issues there.

Ok thank you! I have all of this so no worries. I am keeping my house so I have HOA and more.

Similar to K1 for US entry deadline: 6 months from the medical or by CR1 visa expiry date(6 months from issue date) whichever is earlier.

Is the CR-1 entry date generally 6 months? I think that's where I was confused.

  13. Good day everyone. I currently have a pending K-1 but I am thinking of withdrawing it,  just getting married, moving overseas in the interim and filing CR-1. I know I have to establish the US as my domicile which is no problem as I still have property/assets/business/etc. here. If I go this route, what I haven't been able to find out is after approval of CR-1 when would my by that time husband have to be in the states? I am familiar with K-1 as I know with that process after visa approval, you have 6 months to enter the states and marry within 90 days.  CR-1 I am not sure when you have to leave... does anyone know? I tried to search the threads and I apologize in advance as I did see some threads but it didn't address this question. Thank you in advance!
