    I called and submitted inquiry at the same time. ask your spouse to take screenshot of his bank to show that the money was cleared and attach to inquiry. I demanded NVC on the phone to forward it to supervisor to review. It took 3-4 business days then my aos payment changed to paid. I think supervisor did it. I still did not receive the response from Inquiry since December 31 lol.

    We can't move on next step about AOS process...

    Tell you spouse to call NVC at 7 am EST. 

    ask them to forward the issue to supervisor and at the same time submitting inquiry on nvc website

    The authorised agent will have to see the actual passport and the person that wants the ITIN, their role is essentially to tell the IRS ‘I’ve seen the passport, it’s the real deal’. But keep in mind their services can be pricey and not worth it. 
     

    So the first step is to check your spouse’s passport and figure out who issued the passport. If it’s an agency they can easily access like a local agency (e.g.

    Then they can either send the hard copy to you and you attach it together with the W-7 to the tax refund, or if you can’t wait for whatever reason you can file a form 2848 via fax and give your spouse signing rights, then they can file the taxes from wherever they are in one go, but it shouldn’t be that much of a difference time wise and you guys are well before the deadline. 

    Her passport was issued from department of state and they dont do certification. We did at Department of Justice. I will send it and see what happens lol. That is federal tax, how do we deal with state tax when there is no W7 to send with? 

     

    Is there possible to use HR block or Turbo Tax software to fill in everything and print out to send it to prevent all calculations that I might mess up? Software might not allow me to by pass no ssn for my spouse from HR block or Turbo tax. Thanks

    Thank you. My spouse cant send the passport to me due to our interview will be soon. I have her certified passport but it might not be from issuing passport. You mentioned that authorized agent can do paperwork without certified passport or actual passport by itself? I really dont want to go married separate as I can save couple thousand dollars on joint marriage.

So the next time you'll need it (next year) you'll most definitely have it. The ITIN doesn't have much other use than that.     Do you have to include the passport of foreign’s spouse or certified passport is ok along wit W-7 and tax return?

     

    Also, can we do it by ourselves or we have to go to specific agent that got authorized to do tax by IRS?

    I did not translate any document that is in my official language. I would prefer to talk to supervisor on this. This makes nonsense if their instruction says one thing and they review them in different ways. This is BS to delay process.

  7. Why do we even need to translate if document has either English or official language of the country where spouse will interview on?

     

    Did I miss anything on this quote from travel gov website “All documents not written in English, or in the official language of the country in which you are applying for a visa, must be accompanied by certified translations“

  8. Is there a possible typo on the original post? The OP responded to other poster above stated that “The problem is we did filed I-751 in May 2017 and get denied in Jan 2019. Due to lack of evidence (bank statements, lease agreement, phone bill, pictures since he came to US until present). So my husband hired an immigration legal assistance to file another I-751 in Feb 2019 and has interview on the 7th of Jan,2020”.

     

    Based on this quote, it does sound like they got denied on first I-751 so they hired the immigration office to file second I-751 where her husband got wrong on most of the simple questions.

    The problem is I already submitted without translating or certified. It is clearly mentioned on their own website that we only translate if the document is not in our official language or english.

    This is scared me because I did not translate any documents to English by following the NVC guidelines as the quote below from travel gov website:

     

    “All documents not written in English, or in the official language of the country in which you are applying for a visa, must be accompanied by certified translations. The translation must include a statement signed by the translator stating that:

    • The translation is accurate, and
    • The translator is competent to translate”.

    I might be as well got rejected it. Dang it NVC.

    I then attached a screen shot of both fees coming out of my bank account.
     
    By January 2nd the AOS fee showed as PAID and the form was available.  Not sure if it was my email that moved things along or they rebooted their system but it worked.  Hope this helps.

    Good to know. I have other questions on this subject about total income or adjusted gross income. I am filling I-864EZ form and the instruction said if I filed form 1040/1040A then use total income and 1040EZ uses gross income. My gross income and total income are slightly mismatched. I just need to know the correct number income to fill in I-864EZ. So my question is which income I need to fill in I-864EZ and I don’t recall I ever fill 1040EZ?

    I am planning to upload three years of tax transcripts instead of only 2018.

     

     I wonder if I need to combine all three years of tax transcript into one pdf or separate pdf per each year.If separate transcript pdf per each year then I would image W2 will be the same way as transcript? 

     

    Also, do we combine transcript and W2 in one pdf or they need to be in different pdf files. I heard the combination of transcript and W2 in one pdf will lead to reject so I just want to confirm it.

    No matter what i did (online printing or requested from mail), irs tax transcript always misses few  random letters in my name. The cover letter does have all characters of my name.  I was lucky enough to find my old requested tax transcript that I requested a year ago with all characters. I have not went to IRS office yet.  I was wondered how NVC handles this recently.

    NVC wont email you for receiving petition from USCIS. You have to call them to ask whether they receive petition yet and  case number will assign about one month later after they received ( they are working on file that received 11/08/2019).

    I did request FOIA few years ago and it only showed me left and entered US only. If you use loose leaf visa, they will only stamp on the leaf visa. That is the reason I use passport visa only. They stamped on my passport and sometime stamped my exit ticket as well.
