  1. Just wanted to update here. Yesterday my AOS is approved. status updated to Case Approved. just waiting on the card arrival now.
    Thank you everyone. Timeline is below. didn't include I-130 because we have our I-130 approval back in 2019. when my wife was PR.S
    She became a citizen on 03/15/2022 and we filed 485.

     

    AOS (485-765-131) Filed: 04/04/2022

    765 and 131 approved: 01/13/2023

    combo card arrived 01/21/2023

    I-485 interview scheduled: 03/30/2023

    interview date: 04/27/2023

    Actively Reviewed: 08/12/2023

    Approval: 11/19/2023

     

  2. So yesterday we completed our interview.. was very smooth and easy.. took finger prints and photo.. asked my passport, medical and couple of questions about security.. 10min max.. 

    he said he will go thru the file in the next 2 weeks and make decision.. 

    I heard from 2 different lawyer that if the officer takes your finger print on spot meaning you are approved.. is that right?

    This is a complicated case.  Your current AOS gives you authorized stay.  Your I-131 was approved and therefore you should be able to travel and return.  My concern is what the system at CBP states about your status.  If you are flagged for X days of overstay, they may give you a hard time.  Or they may see the pending AOS and let you in.

     

    The above is moot if you don't plan to travel until your current AOS is processed.  

    I was planning to travel but prior situations I had stopped me to avoid re-entry ban.. juat scared id say

    Begs the question how you know there are not any proceedings against you.

    I mean they usually send you a letter if you have any proceedings against you or inform you somehow. + I paid $20 to check my background on instantcheckmate.com nothing shows..

    it's complicated here but any suggestion appreciated..

    I came to States under J1 (2 years rule waived) 09/15/2012 - Changed the status to F1.. while on F1, my wife's employer sponsored us for Green Card. She was on E1. 
    Her status approved to PR but I got denied because didn't maintaine the F1 status for a week or so.. because I forgot to pay school fees and the school removed me from Sevis.

    after couple of motion applications and re-applications I kept denied. so we decided to apply for 601A along with the I130. I130 approved no interview but 601A got denied.

    Now my wife became a US citizen and I applied for AOS again on 04/04/2022 with my consular approved I130. 
    On 01/13/23 I have my AP approved. didn't used it for travel still waiting.. no rfe or interview request since then.. 
    what are my chance to be approved for AOS. no criminal record or anything.. no deportation letter.. it's been a year since I applied again, people keep getting rfe's for medical but I didn't receive anything yet.

    When we were initially applying, we had no intent of traveling so we didn’t apply for an advanced parole. But in case they don’t get the green card by June 2022, we would potentially like to travel abroad and see some friends/family. Our field office is running 12-16 months for an interview, hence the optimism. 
     

    My question is: could we apply for an advanced parole document for the beneficiary? If so, would they have any issues reentering the US since they overstayed a B-2 visa? Or would the AOS not make this a concern? 

    Did you get the green card? please update thank you 🙏🏽

    Hey Carlos, congratulations. Did you send a fax for your expedite request? Cos I also requested expedite for my advance parole on Dec 6th and received an email saying that I need to send proofs on Dec 27th. After I faxed the documents on same day no news since then..and is it 2 years AP or 1?

    26th October I requested ( via Emma live chat ) an expedite and was given a ref number. Been checking MyUscis daily but nothing on there to indicate Expedite request.

     

    Those of you who asked for expedite - how fast was the request noted on your MyUscis ?

     

    Re the expedite - I asked for it for my EAD but I was wondering - when an applicant asks for an expedite, is it just the EAD they consider expediting or the AOS itself ?

    It’s just for ur ead not aos.. no update since April 4th..
