    Only thing I can think of is mine didn't have a crime listed, yours have one. Even if you are the aggrieved party I asume they want to know the details and the resolution. Seems like they want to see a copy of your antecedentes penales y policiacos.

    Check mine. My case was EB3 skilled worker as well, going through consulate processing. There is a huge time gap between starting NVC processing and getting to the interview at the consulate because of the pandemic but it should give you an idea of the steps involved.

    We waited 10 days. Our interview was on December 20 so add a couple extra days to regular processing times for Christmas holidays, but it was fairly quick.

    You are absolutely right. In my experience, being DQ'ed since August 2020 and waiting for an interview at the US consulate in Guatemala City we tried transferring our case to El Salvador around October 2021 as they had more interview slots and cases were moving faster there. Even though my wife has both Guatemalan and Salvadorean citizenship they shut us down pretty much immediately - to be fair she was not the main beneficiary so that might also be a factor. 

     

    As someone else already said in this thread, this case seems to be the exception, not the rule.

  5. Hopefully I'm not too late to chime in. We had our EB-3 (skilled worker) interview in late December last year and these were the questions we were asked:

    • Who is hiring you?
    • How did you find this job?
    • What do you do for this company? (I had to give a brief explanation of my position within the company)
    • What's your college / university background?
    • Have you ever lived in the States before?
    • Do you have family members currently living in the States?
    • Who are immigrating with you? (she didn't ask any questions to my wife though)

    I'm from Guatemala and not many employment-based green cards are approved there so I guess that's why the officer was very interested in what my company does and what my position within the company is, she also checked very closely the job offer letter I brought. Once she figured that the job is legit and everything was in order she approved us. We did not spend even 10 minutes in there.

  6. Just adding my $0.02 here.

     

    I'm doing the EB3 route as a software engineer myself and even though I do have a university degree and 15 years of experience in the field I still needed to go back and gather letters from all my previous employers. Even then I got an RFE at the USCIS stage and needed to go back and get transcripts from my university. As stated above by others, the more evidence and supporting documents you can get it will improve your chances of approval.

    Just a quick update. I was able to get the Desplegado de denuncias from Ministerio Publico back in July and our lawyer sent the documents back to NVC early in August. I was not expecting to hear anything from NVC until late October or early November but last week I got the confirmation that our case is DQ! The bad news is that since my case is employment-based means that I will not be getting any appointment dates any time soon until the bans are lifted for those categories.

     

    For those trying to get the right document, don't bother with the one above. It needs to be issued by Ministerio Publico and you can get it online in one or two days. You need to fill a form in MP's webpage and then you need to contact them using informacion@mp.gob.gt indicating that you have filled the form and give your DPI number, otherwise you will never get a response from them. Once you do that you will get your document(s) in a matter of hours.

     

    Finally, if you ever lost a document and filed a complaint (denuncia) in order to get new ones issued, be warned that those complaints will show up in your Desplegado de denuncias. I didn't know that it was normal to have a few records on this document if you ever filed a denuncia and was freaking out trying to figure out why on earth would I have something in my record but it turns out this is completely normal as long as you appear as the aggrieved party. My documents were accepted without any issue by NVC. Hopefully this information will help someone out there!

  8. I can't thank you enough for all the information in this thread!!! I'm going through the document stage of my NVC ordeal and me and my wife's antecedentes policiacos were rejected as well and wasn't sure why. I'm trying to reach Ministerio Publico as we speak to try to get the right document. It worries me that they are not open to the public yet but hopefully they will be able to send it to me electronically.

    I am being sponsored by my employer for an EB-3 work visa. Right after receiving the welcome letter from NVC with the case number my son was born and our lawyers have requested NVC to issue immigrant visa fees for him as well in order to have our consular interview as a family unit. Problem is, they requested it back in July and we are not sure what is a reasonable amount of time for adding a dependent to an existing case, we have not heard back from NVC since then. Has anyone gone through something similar? What is the expected processing times for adding a dependent right before scheduling interview with the consulate?
