  1. Hi fellow friends,

     

    HELP! My husband and I were in the final stages of finalizing our CR1 visa (embassy interview) and then decided to split up and no longer move forward with the visa processing for my Australian husband to move to the US.

     

    Location Details:

    Place of marriage/residence at the time: The Netherlands

    Place of my residence (since marriage): USA

    Place of husband's residence (since marriage): Australia 

     

    I literally have no idea if I need to get a divorce in the US and I'm not quite sure if the US has technically registered as a "married couple", as he has never physically lived/worked here and we have been separated this entire time since marriage. The Netherlands has no jurisdiction to issue a divorce since we no longer live there.

     

    Any advice/guidance/references would be greatly appreciated during this trying times of change.

There are only a few consulates that use email processing and I haven't seen anyone who has had to physically mail anything to NVC, everything is pretty much all online now

    I didn't receive the NVC email with the specifications since my Consulate location changed after I was assigned a case number. It got lost in the mix somewhere. I heard mail is still very common, but you say that isn't true. I assume it would communicate directly on the CEAC website that these forms need to be submitted via mail (which it doesn't) -- so I should be okay??? Thoughts...

  3. I have sent my I130 Petition to USCIS Chicago Lockbox on Dec. 31st and it has still not been received. I sent it from The Netherlands and it's only supposed to take 10 days to arrive in Chicago. When I track it it says its been "received to the country of destination" on Jan. 6 but not delivered.

     

    Is anyone else experiencing slow delivery to USCIS because of government shutdown?

    I'm referencing: Page 8  Part 60.a-c on the I-130

    Question: Does anyone have any advise or horror stories on having a different US Embassy outside the Beneficiary's last physical address?

     

    Situation:

    My spouse and I are almost about to submit the I-130, but also in the process of moving countries and traveling for 5 months. We are debating on waiting to submit until we start traveling (1 month from now) to avoid the difference in country's since our end country will be Australia where he is from and will want to have his interview. If we wait, the problem is if we state his physical address is Australia (it's currently not true) since he will be "addressless" while traveling.

     

    I see 2 Options:

    1. Apply now with current address and explain the situation

    2. Wait to apply until we leave this country and put his physical address as Australia even though he won't be residing there because he will be traveling the world with no address for 5 months and will go there after the travels.

  6. Hi VisaJourney Friends,

     

    In the next week we will submit the I-130 with a copy of each page of my husband's (the beneficiary) passport. But the passport will expire soon (Jan. 31 2019) and we won't receive the new one for a month or so.

    Has anyone been in this situation before and has the USISC requested a copy of the new passport? I want to avoid some much back and forth, therefore: 

    I see we have 3 options:

    - Submit I-130 now with copy of almost expired passport and hope they don't ask for the new one (that will cause delay).

    - Submit I-130 now with copy of almost expired passport and send them via email the new passport when it arrives (is this possible?)

    - Wait a month to submit the application until we have the new passport to avoid them asking for it.

    I'm a first timer posting questions here, as my husband (Australian) and I (US Citizen) are in the final stages of finalizing our  I-130 application to mail to the Chicago Lockbox. 
     
    1. BIOMETRICS: How often do they ask Australian's to complete biometrics for I-130 petition? As will be traveling (around the world) while our I-130 petition is pending. Note: My husband (beneficiary) has regularly traveled in and out of the US where fingerprint information has been given.
    2. EXPIRED I-130 PDF: On the latest downloadable version of the I-130 the date on the upper right says expires "07/31/2018". We are planning to submit this form soon, but strange it says an expired date. Anyone have /had the same concern?
    3. CHANGING ADDRESS: Any tips (or horror stories) about changing the address while having a pending application? My husband will be moving from The Netherlands to Australia, so we want to ensure this message gets across but have heard over communication is key.
    4.  HIRING AN APPLICATION REVIEWER: We are about to submit our I-130 on our own (without an official lawyer), but would like a legal professional to review it to give any final recommendations. Has anyone done this, had a good experience/has a referral?
