@Ointeina I agree with @Fe.Ta when you go to the USCIS website, in the 'Foreign Lenguage Documents' section, it only says that the documents only required to be translated. No need to apostilled, notarized or legal actions required.

I even personally asked in a general AOS forum and people with green card assured me they were approved without apostilled any document, only translation.

Is you still want to apostille the Acta, search about doing it in the US. Apostilla de la Haya is an international document. I'm pretty sure you can do it here, as well as sworn translation if you want and notarazation.

Alright so just to be clear, it is absolutely not required to apostille the acta?

I know the translation is 100% required, but I just need that question cleared up, thanks! :)

Ah, I know it still has to be translated, thank you!

But I was asking about where @andreaam mentioned that these documents don't need to be apostilled!

I apostilled my acta just in case before coming to the US. But when we were getting AOS ready, we read on the USCIS website that all foreign documents don’t need to be apostilled or had a sworn translation.

The only thing you need is a certified translation l. This can be made by anyone that is bilingual. After you translate it, you have to sign a certified letter saying that your translation is correct.

Oh my God, thank you so much for this good news!!

Can you please send me the link on the USCIS website where it says that all foreign documents don't need to be apostilled or have a sworn translation?

  4. Hello all! I have a bit of a dilemma.

My fiance got his visa approved and he is now in the US with me, he arrived here two days ago.

The problem is, his acta de nacimiento was not apostilled and translated while he was in Argentina because we both didn't know that was required and the real kicker is that he has no family in Buenos Aires to say, send it to and have them do it for him.

So what has to be done for his acta?

I hope someone can help me because we're both freaking out about this and our wedding is in less than two weeks.

    Hey there!

I gave my original Acta de Nacimiento at the interview and they gave it back to me when they approved me that same day. They didn’t keep it.

It will be nice if you can share your experience in the other thread so you can help future readers :)

Ah thank you very much for your answer!

I'm asking because at my fiancé's interview, they approved him but said that they needed a fix on his acta which we would have to deliver to the embassy before they issued the visa.

A few days after that, his visa got issued and is now ready for pickup but I am still under the impression that he has to get  the fixed acta as the error that was fixed is something that could cause problems in future filing.

So now my question is, when he delivers the fixed acta to the embassy, will and if so how will they get the fixed acta back to him?

    Hey @Fernanda R Sanz!

When you gave your acta de nacimiento and then your visa was issued, did they return your original acta de nacimiento when you picked up your passport with the visa at the ASC?

Or do they never give you back your original acta de nacimiento once it's given to the embassy?

    @andreaam Hey there!
Would you be able to answer this question by chance?

     Embassy Interview approved!! :) :)

I arrived at the embassy at 10:15am. I had it scheduled for 10:30. I went to a window and sayed I was there for a K1. They gave me a green folder where I put all the originals.

Once inside I went to the window 4 and they took my fingertips and then I just went inside the embassy and waited on the left. You don’t have to do the line with all the tourist visa.

10 minutes later, a lady called me through window 17 and asked me for the green folder. She told that was not the interview. I had everything she asked for. She asked me for another pair of the passport photos because she didn’t like the quality of the ones I sent. Luckily I had more with me so i was fine.

I went again to the waiting area on the left and after 15 minutes a consul called me through window 5. He made me swear that everything I was saying and the documents I presented were true.

The questions were: - how we met? - when and where we met? - what I was doing in US when we met? - when I came back from US the last time? - what he does for living? - what would I do for living? - where I will live? - how and when we got engaged? - when we will get marry

For the last two questions I didn’t have a formal answer since no one proposed in my case, we just discussed the fact that we both wanted to get marry. And then we don’t have a wedding date because we wanted to be done with this process first. I answered with the truth and made sure to the consul we are getting just is not going to be the traditional way.

The consul was serious the whole time. Not funny, empathetic or social at all. But he wasn’t mean or anything. The interview was in english. It was maybe 10 minutes long and then told me the visa was approved and that I should be receiving through dhl the closed envelope and passport.

At 11:30 I was walking out. Really happy we were done.

I FaceTimed my fiancé when I arrived and we both can’t believe it.

Thank you for helping through the process. I’ll keep posting and answering in anything I can help.

    Best wishes to everyone!

Hey there, congrats on yet another approval!

My fiancé and I have our interview on Monday and I'm a bit nervous as you can imagine haha.

I wanted to ask, what is that they ask of you in that green folder?

Could you perhaps offer us some insight on the list they put in there?

    Thanks!

    Hi! Thanks so much 😊

I'll be traveling to the US this sunday and will be able on monday to tell you what the stamp say.

The visa stamped in my passport is valid for 6months while Im in Argentina and durates 90 days once you are in the States.

You need to marry as soon as possible in order for the beneficiary to start the greencard process before the 90days visa expire.

With this process you fill out the forms for work permit, advance parole (in order to be able to travel ONLY under 2 emergency situations: beneficiary's family death or illnes, or the beneficiary needs medical treatment and is able to travel to his/her home country to get medical assistance that the US will not provide) and greencard. So while the greencard is being evaluated (this could take 6 to year and a half to have it), you will get the Work permit and Advance parole in 3 to 9 months.

The your fiance and you will need to go to the USCIS for a last interview together and separated, if they approve the greencard it'll be for 2 years, after this period of time the beneficiary will need to remuve conditions and if approved the USCIS will grant the 10 year greencard. After this process the beneficiary can stay as a permanent recident or do the naturalization, doing the history/geografy and language exam, suare to the US Flag and become an Argentinian-American Citizen.

The CR1 Visa is the one that grants a 10 year greencard after the interview in the US Embassy. You need to marry in argentina, wait to get 2 years of marriage.to apply and the process takes year and a half to 3 years. Maybe you got confused with this visa

Oh no no, I'm not confused at all.

The website for the US Embassy in Argentina states that the K1 visa is treated as an immigrant visa and usually, you are given the temporary green card/1551 stamp when entering the US at a POE on the admission on an immigrant visa.

That's why I'm asking that you get back to us to see if it is indeed the way I speculate it being since it is treated as immigrant instead of non-immigrant in Argentina.

I believe we all post in english because people from other countries, as well as the American petitioners needs to understand the information we share from our experiences through this process. I agree if someone needs or wants to say something in Spanish, add the english version just below.

As you all know I'm already approved and  Im helping you, because I would like you to be approved as well, we are not lawers or professionals, we just share our knowledge and experience,we may have done something right through all this to be approved.

Hope somebody here can help me in the near future with the Adjustment of Status process.

You'll do good, believe in yourself and practice for the interview 😊

    Hello Fernanda!

    Congrats on getting approved!

I had a question in regards to the whole process.

I know Argentina treats the K1 visa as an immigrant visa even if it's normally a non-immigrant visa and usually with immigrant visas as I've read on the uscis and travel.state.gov websites, when you go the US at the point of entry, they stamp your passport with a temporary green card and tell you that you'll be getting your physical permanent green card from the DHS in a couple of months from then.

Now, I was wanting to know if this is indeed true once you go to the US with your fiancé since you're doing the K1 visa, that if they give you the temporary green card stamp once you arrive at the point of entry, eventually sending you the green card itself in a few months.

This way, it'll set aside any confusion about having to do the adjustment of status after the wedding if the Argentinean K1 visa really is treated as an immigrant visa in its procedure.

    Thanks!

My appointment date is March 21st, next Thursday :D
My fiance and I feel so great to be able to complete this packet 3 and send it finally!, I´m nervous for the interview because I don´t know what to expect.

I will need to send it the day after tomorrow because I need a biger folder and find a good envelope to use. Sorry, I´m not sure If I understood your question, You want me to ask them how long it takes to receive the packet 3?

    Congrats!

I'll keep that in mind about getting a sufficiently large envelope!

And yeah, I don't know how to describe it but I mean you go drop it off at the embassy and I'm wanting to know how long it takes them to progress the P3 to make sure it's been properly reviewed and ready in time for the interview.

  12. 12 minutes ago, Fernanda R Sanz said:

I will send my Packet 3 tomorrow in person because I want to make sure they get it no problem, but you can use any currier as well.

As far as I know, they attach your packet 3 with the rest of the documents after the interview and they mail it to the beneficiary.

    Oh I see!

    When is your appointment date?

Also once you drop it off in person, can you please let us know how long it takes them to have actually received it in reference to your visa?

  13. 1 hour ago, Javier Mera said:

It shouldn't be a problem really. I've read people's experiences and they've mentioned that other couples were interviewing while they were waiting.

Ah okay, sorry for the worry!

Now I have another question for those that have already gotten approved or turned in their P3, did you drop off the P3 at the embassy?

And if so, how long did it take for the embassy to attach the P3 to your case? Like as in they officially received and reviewed the P3?

  14. 2 minutes ago, Javier Mera said:

It will go nice and quick probably! Nothing to worry about :D

The only "problems" we had were with the options really when creating an account to pay and book the appointment. She wasn't sure of some options but it ended up working out.

Hey there I saw you booked your interview for the 29th of April at 10:30am.

Thing is, I also booked it for that day.

Can multiple different interviews be booked for the same time and day?

If not, then this is very confusing.

Congrats on getting NOA2! I just got NVC number case so our timelines ar pretty similiar. Maybe we wil have the same interview date.

We have the same doubts regarding Police Certificate so hopefully someone will answer.

Regarding Acta de Nacimiento, is the one a Registro Civil gave to your parents when you were born and they requested DNI

Partida de Nacimiento is something different and is not what you need for this process. This paper is usually issued by the hospital you were born with information such as weight, lenght, etc, etc.

I hope this is helpful. I've been asking all day about this in the municipality office in Cordoba

    Hey there!

What book if any, is the acta de nacimiento in?

  19. 5 minutes ago, M and Ed said:

He needs the ACTA. His parents should have the original. If they don't, I'm sure he can get a certified (legalized) copy where he was born. Then he will need to make it internationally valid (not sure the procedure here).

He's made an appointment for this Wednesday to go talk about doing the acta, since they directed him online to do a "partida".

But thank you so much for your answers!

There is no specific way to assemble the packet. Wanted to clarify this, because I can not edit the misstake in the post.

    Hello Fernanda!

I wanted to ask, since you seem to be as far away from Buenos Aires as my fiancé seeing as that you're from Cordoba, how did you obtain your police certificate with the annotation of the art. 51?

Also how did you obtain your acta de nacimiento?

  21. 34 minutes ago, M and Ed said:

I don't know about Tucumán. I'm sure you guys an find info online. Argentina is super easy and relaxed when it comes to burocracy, so don't worry.

They ask for the acta, not the partida. And ot has to be the original one

My fiancé doesn't have his acta only his certificate of birth. When he tried to obtain the acta online they called it a partida?

So now I'm very confused about this whole issue.

  22. 11 hours ago, M and Ed said:

When I went to the Registro de Reincidencias un Tribunales to get my police check, I asked them to specify the art.51 clause. The officer asked me if it was for a US visa, so clearly they're familiar with the process. It was really easy to get.

I used the original acta de nacimiento my mom has. I first submitted a copy with my P3 and then took the original to the interview. They asked for it, saw it and gave it back to me on the spot. Same with old passports.

The appointment date is for the actual interview. No biometrics appointment needed.

Let me know if you have any other questions.

Okay so even if my fiancé lives a good distance from Buenos Aires, it's best if he goes to the Registro de Reincidencias in Tucuman to get the police certificate?

Also is the partida de nacimiento the same thing as the acta de nacimiento?

Thank God it's the actual appointment date, I was beginning to worry haha

But thank you for your response and I hope these other questions are easier to answer!

  23. 5 hours ago, Fernanda R Sanz said:

Better If you ask in the group so we can all learn from your doubts and answers. I´ve tried to get information from the ones that has already been approved, but they are not posting anymore, so we can try to help eachother or you can also ask your concern in the international group called DECEMBER 2018 K-1 NOA2 --- NVC

Well I'm having a problem with two of the documents and one doubt.

How did you get your police certificate with the added annotation of the art. 51? My beneficiary just got his and it doesn't seem to include it even though he asked for it when he appeared physically at the police branch in his city.

How did you get the acta de nacimiento (the instructions specify that it is NOT the birth certificate) and how long did it take?

The appointment we make on the https://ais.usvisa-info.com/en-ar/iv website, is that the actual visa interview we're making the appointment for or is it just for the biometrics/fingerprints and then they'll give us the actual appointment date after that is completed?
