    This service center seems to be approving I-130's as early as January-2019. I understand other centers take longer to process the I-130's

    Potomac is flying! We had NOA1 4th December and NOA2 12th March. Very grateful for the luck of the draw in getting that service centre.

    The question is not can you file as HOH when you are single or married.

    Yes. Apologies, I forgot about HOH, mainly as it involves a fairly specific set of circumstances. The issue is if you are married you should not file as single.

    Ignorance of the law is no excuse. Those saying filing single is accepted even if you are married, show me any IRS law or provision that says so. Even if USCIS/NVC accepts it doesn't make it correct. Doing things the right way from the onset relieves you of any future headaches.

    Could not agree more... not to mention, there is no down side, just another small piece of evidence of commingled 'finances', everybody wins!  

  5. It is illegal to file as single if you are married. This has nothing to do with the NVC or USCIS. While it may very well not impact your NVC case at all it is, nevertheless, still illegal. As many people have already stated your options are 'married filing separately' or 'married filing jointly'. It has nothing to do with whether you live together or not, geography is not the issue. If you do not want the hassle of amending I suggest making sure that in the next years tax return you make sure you file as married.

    It really is! Obviously very pleased to be one of the lucky ones, but the difference is so big, so unfair and seemingly so random. My heart goes out to everyone that has been waiting for so much longer than us, in fact to everyone in this incredibly stressful process x

  7. I am hoping someone can help me. We are readying our CR1 petitions and I realise that we need to complete 3 i130's... one for me, one for each of the kids. My question is, do those three documents go in the same packet with one copy of all our documents or do we need to prepare 3 individual packets with three separate cheques and three separate sets of evidence? Thank you in advance for the help.
