  1. What exactly does this mean? Does he get another chance in 6 months? I'm so sorry. We try to do the right thing only for it to come back and bite us.

    Yes it means to come back in 6 months with proof of rehab and do another medical.

    I don't trust these psychs, they LIE. The psych rejected my fiance's proof of rehabilitation, now the consulate is sayiing my fiance did not have proof well the psych refused to look at it!! :crying: they are driving me crazy!!!

  2. The embassy is driving me insane really, I am going insane. Please read the following and you will understand why, I don't know what the hell to do??

    Dear Ms V:

    Thank you for your February 5, 2010 inquiry regarding the immigrant visa case of XXXXX (CDJ--------). On June 6, 2007, a consular officer found Mr XXXX to be ineligible for visa issuance under section 212(a)(1)(A)(iv) of the Immigration and Nationality Act. Under this section of law, any individual who is determined in accordance with regulations prescribed by the Secretary of Health and Human Services to be a drug abuser or addict is ineligible for visa issuance. There is no waiver available for this ineligibility. A panel physician/psychologist at that time determined that Mr XXXX had a Class A medical condition for drug abuse in accordance with the standards prescribed by the U.S. Public Health Service’s technical manual for the examination of aliens. The doctor who conducted the exam determined that his use of drugs was more than experimentation. The panel physician alone makes the determination of Class A ineligibility based on medical tests and the applicant’s own statements. To overcome this ineligibility, Mr XXXX had to demonstrate that he had entered remission by remaining drug-free for at least three years from his last drug use, which was determined to be December 2006.

    Mr XXXX returned on to the same panel physician on February 2, 2010. Mr XXXXX was unable to demonstrate that he has entered remission to the panel physician. Mr XX made statements to the panel physician which contradicted his exam conducted in 2007. The panel physician has therefore recommended that Mr XX

    return for a medical re-evaluation in six months. The panel physician also recommended that Mr C ld undertake a Narcotic or Alcoholics Anonymous program in order to maintain sobriety and learn relapsed prevention strategies and/or attend individual counseling oriented to adaptive behaviour.

    My reply to this correspondence was:

    X was banned for 3 years for using marijuana once in December of 2006. We served our 3 year ban and X came to the interview with proof of rehabilitation. However, the psychologist put it bluntly to him that "any proof of rehabilitation is bullshit (verbatim) and that neither HE NOR THE CONSULATE would take his proof of rehabilitation into consideration” for his visa therefore REFUSING to inspect his documentation of rehabilitation. The psychologist also added that it was ONLY HIS medical opinion that mattered to the consulate. It has been determined that X received his ban due to smoking marijuana once in Dec of 2006. He served the 3 year ban and returned to the consulate with medical proof of rehabilitation however that proof of rehabilitation was REJECTED by the psychologist. The psychologist NEVER ONCE mentioned anything about obtaining further rehabilitation as your email indicated, that is untrue. Nor did the psychologist of 2007 recommend rehabilitation, we had to find that out on our own. Since the psychologist told my fiance that the consulate does not accept rehabilitation we concluded that the embassy preferred to do their own drug testing by being given the 221g form saying to come back in 6 months for another medical. If there were ANY DOUBTS about Edgar's drug use, he should have been delayed in Juarez to conduct a hair analysis as other applicants have been allowed to do to prove his clean status, but he was not, he was SENT AWAY with barely any information and NOT asked to present his proof of rehabilitation by the consular. The psychologist had already rejected the proof of rehabilitation my fiance had with him which consist of 2.5 years worth of clean urine tests taken every 3 months throughout the ban period. You requested the 3 year ban for the incident in December of 2006 and we complied. When we returned to provide rehabilitation documentation to the psychologist we were TURNED AWAY and lied to by the psychologist.

    I would not expect an officer of the consulate such as this psychologist to use profanity while talking to my fiance by stating that his proof of rehabilitation is “bullshit“. Regardless of any discrepancy between what was said in 2007 and what is said now, the fact remains, the last time X did anything was December of 2006, the law says 3 years, not 10 years, X is 24 years old so if he experimented when he was 14 years old by succumbing to peer pressure that is beyond this matter and shouldn‘t be an issue. The mistake he made in December of 2006 was just that, a mistake. It is my request that this case be transferred to a senior consular for review immediately. X has proof of rehabilitation. We just need to know what to do next to arrange for the consulate to receive that documentation. I am hoping that the appt set for six months from now can be waived and have our visa issued to us so we can get married.

  3. Oh no! I'm so sorry! That's so irritating! I figured something was wrong when you didn't write anything yesterday.

    Don't get married. Hold on. That will completely take away any eligibility for the K-1, and many people get their visas after AR. You should just hold on and see what they do. I'm not an expert, but I haven't really noticed many cases on VJ where visas in AR were denied. Your Congressman will hopefully help out...this is actually the first case of AR in CJ I've ever heard of...Oh, I just saw the part about six months...see if you Congressman can get that reduced (or if you can find extra evidence?) 6 months of AR!!! But if you get married, you will just have to go through the same thing anyways, I would think, because they are still concerned about the drug ban, and that would only extend the time period.

    You could join us Americans down here in Mexico for a while! That might help!

    Thanks Lia, well I think I may have an answer from them in 6-8 weeks but if they deny it then I don't know what I am going to do because the more I read, there are ways you can mess us visa chances forever if you don't do certain things right, I don't know. I have to be careful how I handle the situation as not to ruin our chances for any future needs.

  4. My fiance was told by the consular at his K-1 interview yesterday that "THEY" haven't made a decision yet regarding our K-1 visa application. She then gave him a 221(g) form that says "Administrative Processing" on it but not much else.

    I have contacted my US Senator's office and they are going to inquire about the situation. I was happy his secretary was mexican. I also sent a public inquiry to the consulate asking them what's up and why weren't we given our visa?

    If anyone else has experience with Ciudad Juarez and the 221(g) I would really appreciate it.

    3 years and counting oh boy! Just for a K-1 visa! Maybe I'll just ditch this whole nonsense and go down to marry my fiance - that would really throw the monkey wrench in the works! What would happen if I got married now ?

    Me no likey immigration, they treat the people like animals and Juarez has no mercy, it's a dirty and dangerous place and the fact that they make my fiance return again and again is maddening.

    The part that puzzles me the most is that the consular only asked about what he said to the psychologist and then gave him that Admin review form. I can't wait until I hear something. Gosh I need a vacation, I think I may surprise my fiance in a few weeks with a visit, I gotta get outta here for awhile.

    I wish they would move that consulate, I can't believe when they made the new consulate that they kept it in shitty Juarez, that place is a seedy dump and its so dangerous for people to go there.

  6. He didn't get his visa but he wasn't denied. They gave him a 221(g) form that says "Admin Review" on it. The interview went like this:

    The interview was this: The consular asked "What did you say to the psychologist?", my fiancé replied, "I told him that I experimented once with cocaine and pot when I was 14 years old and that in December 2006 I smoked some marijuana". She then gave him the 221(g) form that says "Administrative Review". The consular then said "They have not made a decision yet on your case, come back in 6 months for another medical exam".

    I called the US Senator's office and sent them all of the information and luckily the Senator's secretary is Mexican! She said she was familiar with Juarez and sent me a form to fill out immediately in my email. I faxed all back to her today and she said she would get to it today and that she would get back to me with some answers so that was one good thing.

    My sweetheart flew back home again now for the second time, another $1100 down the drain.

    If anyone knows anything about Administrative Review I would love to hear anything you have to say.

    My signature is getting so long it's not fitting into the box anymore.

    Thank you, the interview is actually today as fiance was not able to get in yesterday after 10am w/his open appointment letter, he didn't get his medical results until after 10am yesterday.

  8. I'm pretty sure the medical went well - here is my information on what happened:

    Hi There, I think the medical went well. He did the standard medical part and then had to go to the psychologist which we expected because my fiance is returning after a 3 year ban for taking a few puffs off a friends mj cigarette *sigh* - Anyway, at the psych, which is like a hour walk away from the consulate, he asked him when he smoked pot last and he gave him the same answer as he did three years ago. This is extremely important to do, you must say the exact some thing you said prior to the ban.

    Next the psych kept trying to twist things around by saying "well you told us that you were a heavy smoker of weed etc" and bf just stuck to his guns and kept saying the same thing over and over. Then the psych wrote down that my fiance had smoked weed and then experimented in middle school then he asked my fiance to sign it. I knew this was coming so I warned him NOT to sign that paper. A friend from this forum was given that option too at the psychologist to sign the paper, he didn't and he got his visa.

    After that the psychologist started to chit chat about where my fiance is from, that he's been there etc and that was it.

    The psychologist did not want to see his 3 years of urine tests he brought either. He said that those mean nothing to him nor the consulate - he said that the consulate only will take his medical opinion and that's it. Interesting. Also when my friend went to the consulate for his interview after the 3 year ban, the consulate didn't say a word about his so called "drug addiction" or anything, they didn't mention anything about it at all.

    Tomorrow is the appt, I pray that he is able to get in for his interview and that it's quick and easy and APPROVED!

  10. oh, good! I hope everything will go fine and my guess is it will! :thumbs:

    I am double-checking your list now, but I don't know much about K-1 requirements...I know for Cr-1/IR-1 they are asking for his passport and the original and copy of birth certificate, but I can't find a good list of K-1 requirements. I have also heard of timelines and affidavits for the K-1, but I doubt Ciudad Juarez is that demanding.

    Thanks you are so sweet! It's been such a long road for sure! I won't sleep this week for sure until this is over but I'm happy I got the paperwork done, I have all day tomorrow to find anything wrong with what I have - so all comments welcome. I am going to fedex tomorrow night

    Laurel: I'd say if you had just admitted to one or two uses of marijuana and nothing else and no arrests due to drugs ... and its now been over three years since the last use ... it's not worth discussing. Chances are the adjudicator has done the same thing and isn't going to be concerned with that. Anything more serious than that and you may have to get into it.

  13. Moving to the front of the forum, gosh I can't believe there's nobody here anymore? My fiance is going back for his visa appt in 2 weeks so I am sick with nerves of course. We have everything we need I believe so this weekend I will go through all the forms again and then send it off to my lovey. I wish I could go down there with him but finances have been too tight after this recession - all I can do is wait for him so we can get MARRIED!!!! Yahoo! I haven't planned anything for our wedding because we just don't know what will happen this time. But if he gets it on the 3rd which is when he will have his interview, then I would like to get married on the 24th of February - Dear God, please let it work this time!!

Just a note to inform those going for the medical interview at CDJ after a 3 year drug ban that there is a psychologist there whom tried to get my friend to sign a piece of paper saying "I, ___________ have smoked marijuana _____ amount of times in my life." My friend refused to sign it, I think this was just one of their tactics to try and prevent people from receiving their visas.

    My friend asked the psychologist: "Why do you want me to sign this piece of paper?" and the psychologist replied, "To protect my job". My friend refused to sign and finished the medical, he then went to his interview the next day and was granted his visa so don't get sucked into the games that the psychologist will try to play with you.

    Always remember to prep your fiances as well before their medical appt. Remember that the answer to any drug questions is NO!! Have you ever tried? NO, Have you ever experimented? NO, Just say NO!!! My fiance got sucked into this at the medical years ago and rec'd a three year ban for taking a few puffs of a friends mJ cigarette. My fiance is not a drug addict and doesn't even drink but because the medical people coaxed him and threatened him, he caved and mentioned the puff incident - RIDICULOUS! I never screamed and cried so hard on the phone when he told me what had happened. We are getting ready to go again in a few weeks after our 3 year ban but just for all of you, you need to take this exam and appointment seriously - don't fool around, the answer to any drug questions is NO. They told my fiance, "It's ok, just tell us the truth, nothing will happen", ummm yeah.... nothing happened alright except losing thousands of dollars, time and the time that my fiance could have practically been graduating from college by NOW!!!!

    Get tough, don't let them push you around!! They are immigration agents, not the FBI or police don't be intimidated!!

  15. I'm so sorry this has happened to you. If you just make the report to USCIS that should be enough. After 90 days he is not your responsibility, not do I believe he is now - he did not come to meet you so you are not responsible for him financially or otherwise because he is not in your care. I'm surprised that DHS cannot do a search on the visa on whether or not it has been used. If he has crossed into the USA, they would know about it.

    I hope if he comes crawling back that you do not marry him - that would be a huge mistake and I'm sorry you have gotten taken advantage of, be glad you didn't marry him, I'm very sorry for all this.

    Thong4me: you should practice being alittle bit more sensitive, that wasn't nice what you said about the guy with his family and kids - I hope you are never put in a bad position as this and someone says something terrible like that to you.
