Good news! Our I-130 was approved yesterday after only 81 days!!! This is way ahead of our foreseen schedule (good problem to have). We want to have my wife come first and get settled. Do the kids also have to come within 6 months or do we have a year from Visa approval?

Does this mean I will pay $325 x 3 for spouse and 2 children? Plus the $120 for ALL 3?
I’ve been looking for an hour and can’t find specific language about “per child” or “for each relative” etc.

The relevant search will be "treating non-resident alien spouse as resident"
As far as I understood you need to mail to IRS:
- W7
- Your passport
- Declaration that you and your spouse what to treat you as a resident alien
- 1040 with "W7 attached, applied for ITIN" in place of yours SSN
- The documents you regularly need to file with 1040 (W2s, etc)

Has anyone used a certified copy of their spouses passport from Kenya for your tax return? I feel like 16-18 weeks is an awful long time to give the IRS her passport in case our petition moves quickly.

I don't have a specific answer but my attorney said yesterday that NVC is speaking to a conference in Portland, OR. on April 17th. I am sure many lawyers will be asking this and other questions. I wish you well and will follow your progress!

Yesterday I met with my newly acquired Immigration attorney. I wanted them to go over my application and had some specific questions regarding the NVC stage and the I-864. The poverty limits are not even close so I am ok there. My questions were: does being on disability for months and having a tax return (for 1 year) that is about $50-60k less than normal going to be an issue? I was still receiving income from a private LTC policy. They assured me that shouldn't be an issue since I can provide bank statements showing that source of income. However, my next question didn't get as clean an answer. Due to the disability, I incurred huge medical bills. Unfortunately because of a very large sum of child support that is automatically pulled from each paycheck, none of my creditors nor judgments can be acted upon because I am already at the maximum allowable garnishment limit. My personal attorney suggested I could and maybe should, file for bankruptcy to get relief. However when I presented this scenario to my immigration lawyer, they said that due to the new Public Charge rule, they can't advise one way or another because, at this time, there is no precedence to allow them to offer me sound advice. They said we should watch for the next few months and see how cases are being adjudicated. Is anyone else seeing this issue or being told to hold off because this Public Charge rule is too new?

Is it possible Islamic law will allow you to marry your current wife "again" without a divorce? I apologize if that is a silly question.

I have done it both ways. I prefer the online. My first experience was years ago. Submitting that package and making copies was so time consuming not to mention sending the whole package via DHL was expensive. This way, all my docs are already in PDF form so she can print off all our documents with my login info.

This is a good question. A lot of members have been on here for years (and their expertise is invaluable) but it seems there is a disconnect sometimes with the new online filing process versus the paper-packet version. I think eventually it will sort itself out as we all figure out the nuances. The "additional Information" is very helpful! Also being aware that once you submit your online application USCIS is not required to consider any additional information you add after you submit your initial online application. So make sure you have all the relevant information uploaded first.

But, no....if the threat was more direct - to YOU - then maybe, and even that bar is high.
But an expedite for a general regional threat...I seriously doubt it. Just one person's thoughts.

I'm in the US. My wife's job is a block away from 2 of Nairobi's most popular hotels so it's pretty scary. The 1998 attack killed over 220 Kenyans. Not in our embassy, but the bank next door collapsed so there is precedence.

Does anyone know if US Embassy warnings about Terror attacks are reason enough to ask for our case to be expedited? I assume not but thought I'd ask.

I have not yet but I am going to once I learn how to download Whatsapp phone call logs. What I read is that if we submit additional information, USCIS is not required to review it in making their decision. So, we can definitely add stuff but they aren't obligated to consider it in their final decision. For future filers, I would make sure I have ALL essential proof downloaded before submission. I don't think a statement or my call logs (I already submitted my international calling plan log) will make a huge difference but if for some reason we get an RFE, we can point to that information.

So for those who are considering it, there is a section in the online application where you can put in all the evidence you like. Just document everything. There is a lovely additional information section so you can explain end dates in which are current (i.e. putting in the date of filing) since you MUST put an end date to proceed even if your are still married to the spouse you are petitioning for 🤪.
One thing I did was instead of printing the documents I selected PDFCamp Printer. This allowed me to create PDF's in 500 page increments, which was under 5mb. We have over 200k messages on whatsapp so instead of trying to save a 40,000 page document into 500 page docs. I don't like taking digital pictures and trying to add writing to the back but I guess I have no choice.

Sorry for the short explanation. I filed for three i-130's. Wife, and 2 stepchildren. I submitted all three at the same time online. I received the approval notice online for my wife only. It seems strange the kids haven't been approved yet (both are minors). We were trying to have my wife come to the states for a few months first to get settled and get things ready for the kids. They would then follow. We were hoping to have longer than 6 months to do all of that.
