    Dec 3, 2020 - RFE for i-693 medical, which I didn't get in the mail but by email from USCIS for me to submit it before March 2 2021 after I reached out to every congressman/senator in NY for assistance which they replied. 

    Dec 9, 2020 - i-693 medical submitted.

    Dec 30, 2020 - Update on my online status i-485 card went into production. First update on case since submitted!

    Dec 31, 2020 - I-485 approved

    Jan 5, 2021 - Card mailed

    Jan 7, 2021 - Card in Hand

  4. Dear Vj Family &  Sandra/ stillwinning 

        I am grateful for all of you to help us in this hard immigration processing. I can not made it so far without your help. 

    as you know since I received RFE about a criminal charge as Domestic battery after my I485 interview. I was posted my questions here and got some good  advices that I need find a good criminal attorney to dismiss this case. REF dead line is 1/31/21. 

       I did found two criminal attorney and all paid them off. 

       first attorney filed my case to court asked to recall the warrant of arrest but was denied, and pre trail date and hearing date set up at 1/13 and 2/16 in 2021. he said it looks hard to dismiss my case also  I could not expedite the hearing date.  

        then I hired other  Criminal Attorney, he said could dismiss my case and get every thing done before deadline and would not let it hurts my immigration case. unfortunately since he got my paid off to him, he does not answers my email and does not answers my phone call about two weeks . I check the contact paper again and it  said this legal fees can not be refund. I feel bad this attorney does not response to me. that is really wast my time. also I don't know if I can report him to the bar of Indiana state and ask my money back because he really did nothing in the ? 

        first attorney is very nice and he contacted me and tole me how his thoughts about my case. he recommends me to  plead a guilty to get an agreement(my understanding.)  he wants to know what kind charge would not hurt my greencard case. or go to Jury trail.

     

     I really need your guys advices about my case. I do remember that Sandra said I must find a good criminal attorney to dismiss this charge. I would love to do so, too. but unfortunately that is not much time to let me find better criminal attorney and to dismiss case before 1/31/21. 

        Does USCIS allows me to extinction the RFE deadline? 

      What is best i can do? I am willing to go to Jury Trail if Judge lets me to. just worry it takes long time and could not get any results back to USCIS before 1/31/21.

    I've been thinking about your case and I must advise you that there is a small possibility that you will be incarcerated when you appear for your hearing in January.  (see the attached document, there is still a warrant for your arrest). You should bring the bond amount to the hearing so that after you are processed you can be released quickly.
     
    Also, I do advise that you get an immigration attorney to assess whether a plea agreement to an A misdemeanor will hurt your immigration case.  I understand that you maintain your innocence, and that you wish to contest the case.  However this will involve significant expenses in the future, and knowing the judge in this case, he was a former prosecutor for many years and only if you get a jury trial could a jury review your case.  In short, you may have an uphill battle in trying to be found innocent, especially if you don't get a jury, and in particular if both the police officer and your ex boyfriend are available and show up to testify.  A plea agreement might be a better option for you, so I would want to know whether an A misdemeanor would impact your immigration case.  If it doesn't, then I wouldn't worry about.  Sometimes they just need documentation, that is what your letter said.  If the an A misdemeanor negatively impacts your immigration case, then we can proceed to try to win, it just might be expensive.  You should check with your immigration attorney about what should be done.
     
    To win your criminal case, the first step would be to establish that the state has no witnesses.  I'm guessing that they will be able to produce the police officer because my brother in law who is a local police officer found that the officer was making digital police entries last year, so he's still probably available to testify.
     
    Remember too, even though you would like to be shown innocent, this has never affected your life prior to the immigration case, and all they are asking is for proof of the outstanding warrant so that they can assess whether they will grant you the immigration status you are seeking.  If you provide the proof, then it may not really affect your case further, but you should check with your immigration lawyer.

    Looking at the USCIS policy manual, it looks like the best outcome for her short of an outright dismissal would be a plea to a petty misdemeanor, if that is a possibility. If not, making clear that whatever happened involved no more than simple assault/battery rather than any type of aggravated offense would be next best. 
     
    At worst, it appears that this would be likely to be a time limited bar to her ability to adjust status. But I assume that the clock would tick from the date of her sentencing rather than the date of the incident. 
     
    All of this is within the discretion of USCIS, where they are able to weigh any mitigating factors, such as her children, her seven years of being law-abiding, her ties to the community, etc.

    You must have your case dismissed in order to have your green card approved. Your case MUST BE dismissed ON THE MERITS,otherwise your green card won’t be approved.

     

    Make sure that your criminal attorney knows that  you NEED  the  dismissal ON THE MERITS.I am not going to explain here about criminal law because this thread is for Vawa cases.

    I thought read somewhere and it says only needs police report from where you lived over 3 years. I got the wrong information about this then made things very difficult now.

    You are right. I thought we only need to summit criminal records from the state where you live over 3 years. IN is the first state that I lived and it was less than 3 years, so I thought I don't need to get no criminal records from there, also my immigration attorney did not recommended to me do so too. 

    It was big mistake that I did not checked it before USCIS requested evidences from me. I don't know how it goes since it has been so many years ago and it already court ordered.

But you can also go to court in your current state, it will be easier for you.

    wow! that would be very great if court can do so. I still feel like that I need an attorney,because there is a activity warrant of arrest order on me. I worry the police officer would arrest me at the place.  Thank you very much for your advice! it makes me see the hopes.

     Don't worry about expunging the case for now, worry about dismissing.

     

    I think someone here said even if you expunge, USCIS will have access, we can't hide this cases from them. 

     

     

    Thank you! I would find an attorney to take care of this case earlier if I knew it before. I did not know about it and now don't know how to find a trustful attorney. I talked with few attorney and don't know which one I should to hire or need to looking for other attorney. 

    it is hard time to me. 

    I will keep positive and hopefully every thing would be turns out great.

    Thank you for your cheering ! it really means lot to me. I will try to talk with Sandra, but kind of like she is not at here today. hopefully I can get her helps with this big issue soon.

        Good evening. I am facing a seriously big problem of the RFE from USCIS after AOS interview. I really need advice if any one of you have experience of it. 

     

    I went to AOS interview on 10/15, it was went well. IO asked me if I went to the court/or any arrested. I answered that I did went to court so many times for divorce, child support /child custody cases but never got  arrested.  He gave me a paper that marked as "your application/petition has been recommended to approval. "since then I haven't heard anything from USCIS and my immigration attorney says my case more likely getting approval . 

         

    on 11/13, I received a letter from USCIS and requesting more evidences of  a domestic battery charge/ and warrant of arrest. dead line is 1/31/21. 

         

    I was very shocked and surprised because I never do anything harms anyone else. then I started to used information that USCIS gave to me on letter and researched on mycase.gov and find out there is a active case pending. it is a criminal misdemeanor charge. one order of protection, warrant of arrest and domestic battery charge on me back on 2013 in one state that I have been lived less than 3 years.  I never knew about this case and promise that I never hurt anyone else. I never received any notices from court about this case, too. I also got one time pulled over by the police for the speeding ticket, but police did not put me in jail by this arrest warrant so I really did not know about this case. 

       

      I quickly looking for the criminal lawyers in that state, and they found out that was the case by one guy who I dated for a short time  and broken up with him , he claimed this case.  there was no any court hearings about this case. 

       

    few attorneys called the different prices for this case. mostly called $1500 or $2500 ,but they said can not guarantee the court dismiss this case and clear my criminal records for it has been so many years and already is  court ordered.  only one attorney called $7500 and said he able to get this case dismissed and expunged so it will not show up on my record. 

     

         My questions are as below. 

     

    1. I  answered that I never got arrested to IO on AOS interview.  is this will cause a problem ? I am a good and honest person, I did not know about this case until received RFE letter from USCIS.  I got no criminal records from my home country, the states where I lived more than 3years, only this state where I lived was less than 3 years and I thought it will not need no criminal record from it. if I know about this case earlier I would find an attorney to take care of this case before interview for sure. 

     

    2. how many chance that I can dismiss this case and clear my record once court ordered domestic battery charge on me back in 2013, and there is a active warrant of arrest, a order of protection on me too. 

     

    3. which attorney should i hire to help with my case?  Or any one of you know a responsible and trustful criminal attorney in IN recommend to me please. 

     

    4. does my GC application will get denied if this case could not get dismissed? 

     

     

    Any advices are welcome and please to help me with this big issue, please. Thank you all. 

  14. Good afternoon, Dear VJ family

        I had my AOS interview and it was went to so smooth. IO asked about who is my child's father, and I told him his father was my ex boyfriend. He did not ask more questions about this and gave me a paper when finished interview. 

       it marked as" Your application/petition has been recommended for approval", my lawyer was with me and she was happy and clapped her hands at IO's office. she said "The person who interviewed you cannot make the final decision. But it's a good sign that he recommended both of you. It means that you will both likely be approved."

        I have not hear any new update about my case since interview, it is almost two weeks now. I am worrying about if there is any chance that IO will not approve my case? or anyone here received same paper who able to tell me how long to get final decision when we received this paper after interview?

    Thank you for you kind words. I have no idea with this lawyer, she was talked okay with youngest one and I did paid how much she asked as$1,500 for interview only. I hired her on 13th and she said do prepare for interview on 14th, but nothing good talk just make me worried more. I lost my words for my wrong decision on choose this lawyer. 

       I hope other friends from here to get earlier for interview after VAWA got approved.

    1. VAWA derivatives are able to adjust on the same terms as the principal, meaning that things like an EWI, overstay, illegal employment, possibly being a public charge, etc are not a factor. Unless your kids are criminals there's no apparent reason for why they'd be denied.

    2. I-192 is outright the wrong form for three (!) reasons:

    a. The form is used for non-immigrant visa waivers, I-601 is generally used for immigrant visa waivers

    b. Overstay/EWI is not a factor in VAWA cases

    c. The 10 year bar associated with overstaying only triggers if you depart the US and you're not an LPR. Even if you did depart, VAWA comes with a special provision that if you can connect the overstay to the abuse you can get it waived without needing anything aside a statement attached to the I-485.

    3. USCIS agents are not supposed to ask about the details of the abuse. They may ask regarding the bona fides (i.e. whether the marriage was legit or not) if something's fishy but abuse part is solely the job of VSC. Yeah the lawyer can't stop but they can still interject, argue, and demand a manager or a different agent if the interview goes off the rails. As is you're basically paying just for the lawyer to sit there pretty.

     

    Regarding the kid, if you cheated then this might cause some serious question into the bona fides of the marriage. If the kid was conceived after you two split up then you should be fine. The statute only really prohibits remarriage until the I-360 is approved, but nothing legally prevents you from sleeping with someone else in the meantime.

    I received notice of interview on  9th, OCT and needed to find a doctor to do Medical exams for me children, it took me almost a day on last Friday. also made phone call to find few lawyer and meet/phone call consultation past 3days. there was not much time for me to looking for a better lawyer to regarding my case especially baby problem. so I needed decided one than none but she told me things like yesterday. 

     I hopefully be lucky today. I have no words more thank put every thing in God's hands.  I hope friends of here get lawyer earlier than I do. I thought my case would be take longer even asked congressman's help but just one week part between notice made to interview.

        I have interview tomorrow morning. but I feel so nervous about it. for my completed situation, I hired one attorney to come with me to the interview. I thought every thing would be okay, but she said my children's AOS interviews should be denied because they are not eligible to apply green card. I was shocked for this answer because I applied to my children by my own during my VAWA was pending, my VAWA case was approved. Do they not eligible to apply to green card before my I-485 approved? Also she said I need to answer simply and truthful every question that IO asks on interview. Even they ask about abuse that she does not has power to stops IO to asks me and I need to answer about it. 

       I feel like very scared of interview because she said my baby would causes a issue that make IO questions about my marriage and think if it was real marriage. 

    as I posted here before,my youngest baby is not ex abusive husband's child. I did write a letter to tell the truth to UICIS and willing to give it to IO tomorrow. 

        Also she questioned if I have form I-192 for overstay issue but I never filed it. 

       

    I list my timeline as below if anyone wants to know. 

      

       7/10/2018 , Applied I-360, I-485, I-765, I-864w, I-912. received by VSC with help of lawyer

       September 2018 received a prima facie.

       11/26/2018, applied I-485, I-765 for my children and received EAD cards and made SSNs to them on June 2019.

       renewed once my EAD card and my Children's EAD cards

       3/16/2020,  VAWA was approved .  C31 card was in hand in JAN 2020.

       asked congressman for injury in 09/30/2020. 

      10/15/2020 interview  

      

     

      I am very thankful for stillwinning, Sandra, etc kindly help to each one of us in this forum. I hope all applications in here get approved.

         I need some advices from you all. 

         I posted my story here  when I filed my VAWA case , it was approved on March 20. I am waiting for my case transfer to local office and interview. (there is no any update about my I485 yet).

     

       I am very worrying about my AOS interview now. 

     

        I  did not sent my divorce decrees to VSC , my divorce was finalized two months after I sent  VAWA packages . It was on document that my new born baby was not my ex husband's baby.  We did DNA tests that showed he was not the father. 

        My visa was expired so many years ago, my ex was filed my I130 and I485 after we married a month. He withdrawal these cases when we doing divorce. I got denied notices from USCIS but I don't know  if I was put into the remove list.  My VAWA package was sent to VSC a month after my I130 and I485 was denied.  

        My marriage with my ex was real, our divorce based on his abusive but it was not words his abusive on finalized divorce decrees. We did DNA tests that showed my baby was not his baby so he was very angry. 

       My ex did Sterilization before we married. I had one time sex with my ex boyfriend during the marriage time , it should not happened but I was abused by the hands of my ex and was very sad and needed comforter so talked with ex boyfriend and it happened . 

        I am worrying about this marriage baby was not my ex's could be  big problem when I go to AOS interview , What I need to prepared for this? 

        I am not mean to lie on AOS interview, just need advices how to cover this big mistake.

        I never sent I693 to VSC with I485 application, also I think that I need to give my finalized decrees to USCIS officer during the interview or when they ask me about  medical records I send it together. 

        Do you think I will fail of AOS interview? what I can do for it? Do you think it would be help if  find a good lawyer go with my AOS interview ? I would love to have a good lawyer for my interview but really on  hard financial situation. 

         I have been receive  help from this great forum, I grateful for all your help and appreciate all advices. I am keeping prayer for all applications would get approved .

    The Lord in His infinite wisdom helped me to find what would be best for me. 

     

    2 years and 7 months ago I applied for VAWA by myself, I since I could not find someone willing to help. I provided all supporting documents for my case. I did the best I could. In 01/13/2020 I received a RFE requesting a background check from Spain. I provided such document and in 04/03/2020 my case was approved. 

     

    I encourage all of you who are hopeless, and have been on a situation like mine, do not despair, for the Lord hear your prayers and he will guide you through dark times. 

     

    If anyone need help with anything, hit me up and I'll try my best to help.
