    Qt 36: Has anyone ever filed an immigrant visa petition on your behalf?

    The sample form on this website says we should check NO, is that because the K1 visa is considered non-immigrant? Just thought I would check. Becasue for 26 and 27 we do show our intent to live permanently and get married as reasons to move to the US.

  2. I have a few questions as my fiancee and I get ready to send in Packet 3 to Mumbai embassy.

    1. Can we drop off packet 3 at Mumbai Embassy or the VFS office or does it have to be mailed? If we can drop it off, does my fiancee have to drop it off in person or can a member of the family do it on her behalf?

    2. Form 156 - Question 31 - Have You Ever Been Refused a U.S. Visa?

    My fiancee was once turned down a student visa at the Mumbai Embasy. Not sure if it was a reject or request for more information. However, she was issued the student visa on her second interview soon after. Should we answer yes or no for this question?

    3. Form 156 - Question 28 - Who Will Pay For Your Trip?

    Does it matter if you answer fiancee or self here?

    So they are not asking for DS-156? I also found a DS-156K form on the dept of state website. So confusing. What statement are they talking about? Is that the one where you check off that you have all the supporting documents? Also, when they say in person, does the beneficiary have to go or can a family member submit on her behalf?

  5. ...okay so my fiancee goes to the Mumbai passport office to make a new pasport and after standing in a line in the sun for about 3 hours and then inside in another line for another hour or so, she reaches the officer who tells her that basically she cannot apply for a new passport under tatkal because her passport is damaged. And then she says she cannot accept her application because it is missing an affidavit signed by the court certifying why her passport is damaged. Really, why does the court need to testify that the passport was damaged because of a water spill? And if they are so picky about water damage, why can they just not laminate the whole passport?

    Anyways, I'm going to cut the drama and stick to the story. So now she has an affidavit and has to go and stand in the line again and then she will be issued a passport who knows how many months later (2-3 she was told).

    This is so frustrating, we waited for a long time and finally got the NAO2 and now this 2-3 month delay is going to push our plans back by months. And who knows what will happen if our petition expires before then. Not to mention the discrepancy in the passport numbers. I feel so terrible my fiancee has to go through all this by herself, but she is being so strong about it...I know ultimately we will all come out stronger and we will be fine, it just seems very frustrating right now.

  6. My K1 application was received by USCIS (California Service Center) on Mar 1 and I received my NAO2 a couple of weeks back, so yours should be on its way. Keep your fingers crossed. Good luck.

  7. This is a difficult one. Most people from India seem to get rejected for a visitor visa when an immigrant visa is pending. The basis is that you are unable to prove strong ties and reason to come back to India. However, if you are able to prove that, there is no harm trying at all. It should not affect your immigrant visa petition regardless of the decision made by the consular officer.

  8. It is my understanding that the consular officer at the embassy is authorized to extend the validity of the approved petition. They do understand that the timeline and process sometimes extends beyond the validity of the approved petition. I think you should be okay since you do have an email from the embassy, just make sure you carry it.

    Also some of our more experienced advisors on this forum will also give you some good input. Good luck with the interview. Let us know how it goes.

  9. Thank you all. We will try the tatkal process but before that we will try one more time and see if we can get the police clearance at the passport office with this passport itself. Maybe the officer was just trying to be difficult in order to get some money, who knows - I would hate to slander him without knowing the truth. I mean, a little smudging because of a water spill or something cannot be that bad can it?

    But if we were to apply for a new passport, do you think we can send in packet 3 for now with the old passport details (assuming the new one has not been applied for yet?) That way we will get in line to be scheduled for an interview....how long does it take for them to schedule an interview at Mumbai once you send in packet 3?
