Hello VJ team, really need your advice here (I also posted this on the general forum).
My fiancee's K1 petition was just approved at CSC and sent to NVC for onward processing to Mumbai Embassy, India. In order to have our paperwork ready and in anticipation for Packet 3, my fiancee went to the passport office to get her police clearance. The officer there said her passport was damaged and she would have to apply for a new one before they could do anything. The only damage is a slight smudging on the passport issuing authoritys stamp and sign. Are they just creating a fuss over nothing and need something to get the work done?
What happens now? If she gets a new passport, her K1 petition has another passport number. It will take as many as 3 months to get a new passport, in the meanwhile she cannot even complete Packet 3. And the petition expires in 4 months. And when she does fill in forms DS156 and DS230, the passport numbers will differ.
Should we just go ahead and use the old passport numbers and send in Packet 3 so the process is not held up? Or should we wait until we get the new passport and then continue the process? We would just be holding up the already long timeline that this takes....

Hi Mala,
You need the ploice clearance from both passport office and your district police station. In Mumbai, the passport police clearance only takes a couple of days, the police clearance from the station takes a month.

Hi all,
Is the police clearance from district police different from police clearance at passport office (Mumbai Embassy)? Are both required or can one be substituted for the other? As my fiancee and I get ready for this step, would appreciate anyone from Mumbai or India who went through this recently.
Does it take a while to get both clearances? Will it be okay to send in packet 3 if we are just beginning to apply for these clearances or should we wait until we have the clearance in hand? Please advise.

Thanks for your post. We just filed our I129F at California Service Center. Its such a long wait, very hard to stay apart. Good to know your K1 is on its way to Mumbai. We wish you speedy approval. Do you already have your police clearance ready? Do you know how long it takes to get that done in Mumbai?

Hello fellow March filers,
I thought I would be a Feb filer, but just received my NOA1 in the mail today and my notice date is March 1. When I look on the USCIS website, it says Feb 28, but I guess this makes me a March filer. Good luck to us all and hope we are re-united with our better half soon enough.

Hi fellow February filers,
I made it to the February list!! I sent in my packet on Feb 26, and was able to see my case was entered in the system and NOA1 sent on Feb 28, 2007. Probably among the last few February filers.
Now its just sit back and wait...lets hope we all get lucky really quick.

My fiancee too had a SSN# for the same reasons. We used that number on the I-129F and G-325A.

I too was in a similar situation and had posted on VJ. The general consenus was its better to send a complete application rather than have something returned. At best you may delay by about a week.
You could also call USCIS and see if that directive still holds true today. I just played safe and asked my fiancee to send me signed forms however, it would be interesting to see if anyone has got RFE's for not submitting signed G-325A forms.

Hello,
My fiancee's passport and birth certificate has the middle name spelt differently (same name, a few letters are different...two "o"s replaced with a "u") - will that be a problem? Can we use either spelling that is the birth certificate or passport for the G-325a and I-129F?

I found this internal document on the USCIS website and it says that a G-325A without the beneficiary's signature is acceptable and can be signed at the time of interview. I am in the same situation and posted this question to the VJ community and the general consensus was its better to have the form with signature. However, in theory, they do have a process where they should not RFE a G325A without a signature. Here's the link to the document on the USCIS website.

Thank you all. Yes, I should submit the G325A. I was looking at the USCIS website and found the attached document which basically says if the G325A is not signed or photographs not submitted, an RFE should not be issued, rather can be collected/signed at the time of visa issuance. Based on this guideline, would it be prudent if I was to fill in the form on my fiancees behalf and then submit it without the signatures which can be done later? What do you advise? I guess I am trying to get my packet as fast as possible to USCIS but do not want to encounter any problems or delays.

I was all ready to submit my I-129F package and just relaized that I am using form G-325 and not G-325a. the G#25 is a 2 page form as compared to the 4 page version of G-325a. The information is the same. Is it okay to use the G-325 or should I ask my fiancee to sign and forward the G-325a? I am just afraid that I keep pushing the waiting time as I will have to wait a bit to get the forms back from her? What does the VJ community advise?
