    NOTE: A survivor’s period of residence in the U.S. after the NH dies may be counted toward the 5 year period of residence.

     

    So the important thing is being able to come back to the US as an LPR (even as a widow?).

     

    I emphatize that this is a sensitive topic esp when discussing with strangers.

     

    3) Your mom still has at least 5 months until November. imo Don't wait until the last minute. They should try to go back to the US before then. They might not get on flight on June 1 but they can try to book on the next available flight.

    I am not sure if this the right forum to post this question, please feel free to move it to a different forum topic if required. 

     

    I have a couple questions, but first a little bit of background:

     

    My mom, who is currently a permanent resident came to the US from El Salvador as a spouse of a US Citizen back in 2017, unfortunately just a month before she arrived my step-dad(US Citizen) had a stroke, after a few months of my mom being in the US my step dad decided he wanted to spend some time in El Salvador to rest and get treatment over there, weather in the US was making pain worse for him and he needed expensive full care support during that time, so they both went back. Just to be safe I helped my mom to file for a re entry permit since they were planning on staying more than a year. My stepdad had a very successful surgery in El Salvador and is progressing in recovery, although still has mobility issues.

     

    Questions are: 

    My mom's re entry permit is soon to expire in November, El Salvador has a travel ban and has closed borders due to COVID19, although the US is helping US citizens who are stuck in El Salvador to get back to the US in a schedule fashion.

     

    • I have been reading and see that you cannot extend a re entry permit but instead have to submit a new application while in the US, so for the moment, this is not possible. My mom is worried that she will not be able to travel before the re entry permit expires, if this is the case, will her residency considered to be abandoned? Are there any emergency immigration relief laws or exceptions that we can cling to in order to avoid this from happening? 

     

    • My step dad has another concern, that in a worst case scenario, he passes away, my mom not being a permanent resident anymore(if she is not able to maintain permanent residency status because of the mentioned above) his social security retirement benefits would be lost and my mom would not be able to collect any of his benefits. She is currently not receiving any spouse social security benefits because she is 58. I have not been able to find clear information on whether in the case my mom is not able to travel and her LPR is marked as abandoned she wouldn't be able to receive my step dads benefits in case of death. 

     

    My step dad and my mom do not want to abandon status, but life being unpredictable forced them to leave the country. They are now at a point where they can start thinking on returning to the US not what my step dad is feeling a little better and my mom's re entry permit coming to an end.

     

    This is a sensitive topic for the family and I understand might be polemical at some degree if not expressed correctly, so I have try to communicate my mom's and step dad's concerns as best as I can. I want to be able to help them and give them some guidance like I have been able to do before during immigration process but I am hitting a wall on this one, I know there are a lot of knowledgeable people in the forum and thats why I am seeking help. 

     

    Also I think is worth mention that I am a US Citizen as well.

  3. In preparation to my wife's interview Oct 17th I submitted a request to my employer on how I could add my wife to my employer insurance plan. They did not say I can add her now byt they did send me a letter to present at the interview that reads like this:

    To Whom it may concern:

     

    <employee name> is currently employed by <company name> and is enrolled in our group medical plan with employee only coverage. If his spouse relocates to the United States, this would be considered a qualifying event for <employee name> to add his spouse to his medical plan. Her coverage would be effective the date she arrives in the US. He would need to provide proof of her relocation as well.

    Now, I am wondering if you would be considered enough or if I should try to get a short term or individual market insurance for her....I know the proclamation doesnt take effect until November but I have seen enough not to assume things...

    He doesnt need to schedule an appointment since he already has an interview schedule. He will only need to fill out the document delivery information section.

     

    If you dont mind me asking, what type of visa is he applying for? And how long did it take from being documentary qualified(NVC email stating documents were accepted) to when he got his interview letter? 

     

    My wife and I are going through the process of IR1\CR1 in El Salvador and we received our documentary qualified email a little over a month ago and we have not gotten our interview letter yet.

    You would only need your spouse to have a SSN or ITIN if you are filing married jointly. 

     

    I filed my 2018 Taxes as married filing separate, printed out and wrote "NRA" in the 1040 spouse social/ITIN textbox as I read on several forum posts. Taxes went through with no issues.

    Just to triple check, it shouldn't be a problem that the marriage certificate only shows her maiden name, and, that I for I-130 and I-130a purposes, use her future married name that she intents to use before she actually gets her updated passport and IDs? Is it likely that USCIS will RFE because the marriage certificate does not match her name in the application? (I also plan on writing her name on the other names section).

    Yes she actually does need to register the marriage in El Salvador in order to get her named changed over there 😕 the apostille was needed for the US marriage certificate and make it valid in El Salvador but that has been taken care of.

     

    But my hope was that if I could file the application with her new name before she actually updates all her paperwork over there, that would allow me to file several weeks ahead of time. And by the time we need the updated paperwork we would have everything set. But we don’t want to cause any issues on our application if that is not permitted.

    I see, so should I use her maiden name to send the application and then update the name during NVC part? Or should I submit the application with her new married name?

  11. If you are filling for your spouse, your spouse is the beneficiary. Note that the form asks you information about your current marital status and spouse under Part 2 as part of the "Information about you" section. Then it asks for full beneficiary information in Part 4, this will be information about your spouse too (and some might be similar to information you already filled in Part 2). 

     

    Please provide part and item numbers so that we can better assist.

  12. Hello VJ Community!

     

    I have a question for all,

     

    I am a US citizen(naturalized) and I married my wife in the US last December in VA while she was on a tourist visa, we both had family in VA and some delicate family health issues made us celebrate our civil wedding over there. She has now gone back to El Salvador and she is in the process of registering the marriage in the appropriate consulate and local authorities (thats a whole another story! Apostille and everything). 

     

    When we requested the marriage license in VA they told us we could only use maiden names, and that if she wanted to use my last name, she would have to do the name change in El Salvador, not here. So our marriage certificate only shows her maiden name. 

    Anyhow, my question is that,  we want to file I-130 but I am not sure if I need to wait until she changes her surname in El Salvador and gets a new passport, IDs and everything changed to her new name before I can file the application. I don't want to delay the process anymore since we want to be together and we know it will take some time to go through the whole process. 

     

    Should I wait until all name change process goes through and she gets all documents revised with her new name?(Which could take some time). Or is there anything else I can do in order to submit our application before that and that will not cause us any troubles in the process? What name should I use when filling the application?
