My EAD was approved for 62 days. I didn't apply for AP.

I believe that if a child is under 18 years old, has a green card, and has at least one U.S. citizen parent, she can qualify for derivative U.S. citizenship. (This does not apply to stepchildren - only biological or adopted children.)
Look at the instructions for form N-600, the application for a Certificate of Citizenship, which is the form you would file to officially establish her citizenship, and see if it applies to you. Here is the link to the form: http://www.uscis.gov/n-600

Nutty, everything is o.k., don't apology. I thought that this can be a mistake from USCIS local office. So if the law requires it everything is in order.

Nutty, I don't freak but some things are unexplainable for me. First, my case is under further review because they doubt if my husband divorce in the past is valid here in the USA. They will ask Attorney General about this. If this divorce is not valid he has to divorce again and to marry me again. In the same time they grant a green card to our child on the basis of this "doubtful" marriage. By now I have thought that the documents of my daughter don't depend on our marriage or me.

Thanks for the reply. I've corrected my timeline. Our marriage was in June 2006. I know that my green card will be conditional. What about this of our child. She will be a child of my husband forever. This fact doesn't depend on our marriage. What is the condition in this case? I understand the logic about the conditions for the marriages, but about the children? After two years they can say - you don't have sufficient evidences that your marriage is real, but how they can say - you don't have evidences that you are the father of this child. Or just the law say so.

Fwaguy, when our daughter was born, her father was a permanent resident. Two months later he became an US citizen and filed I 130 petition for her and I 130 and I 129 for me. So we arrived with K3 and K4 visas.

We received a green card for our child. This card is 2-year and conditional. Is this right?
She is not a stepchild. Why they give a conditional residency to her? Does anybody know?

We have our AOS interview on 12th March. Last week we received a letter from USCIS that our daughter's green card is approved. We received also another letter with a new appointment with the USCIS office for my husband in relation to my case. He went today and the lady asked him to verify some information. Three years before our marriage, my husband had a divorce with his first wife. At that time he and his first wife were permanent residents of the USA. They are both Bulgarian citizens. Their marriage was in our home country Bulgaria and they had their divorce in Bulgaria. So the lady from USCIS said that she is wondering why they filed for a divorce in Bulgaria, but not here in the USA, and she thought that this divorce is not valid in the USA. So now she will file an inquiry to the Attorney General about this and after his response they will sent us further information. According to me this is very strange. How they can accept marriages from the other countries but not accept the divorces. How they approved our I 130 and I 129 and I had my K3 visa approved if our marriage is not valid. Any opinions?

Hello friends. Me and my daughter had our AOS interview today. Everything seemed to be in order. The immigration officer called us. We get into her room, swore and the interview began. She ask me to verify my address, names, dates and place of birth. After that she assured that we have submitted all documents with our AOS package and that the fees are paid. She said that everything is in order with papers and fees. She asked how we met and made copies of marriage and other photos which I had brought. It was everything. Finally we were told that everything is o.k., she approved us and will recommend us for approval to her boss. The lady explained to me that I will receive in a mail a green card within 2 or 4 weeks, and she also gave me an info about conditional green card. She gave us two sheets with interview results and we get out.
When I get into the car and looked at the papers which she gave to us I was so surprised. According to them our I 485 forms are currently under further review and we will be notified by mail when the decision is made.
She didn't take our I - 94 or my EAD card as they usually do when give approvals.
What should I think? Are we approved or this lady was dishonest. Why she congratulate us and said we are approved? Could anybody give me opinion? Thanks in advance!

Well, since he just started this new job, his health insurance will start after his 2nd month.
I'll tell him to check in the HR if it's possible to cover pre-existing conditions, including pregnancy... I hope so!
Meanwhile, can anybody tell me if a Green-Card Holder (5 months) can qualify for Medicaid ??

I think that it depends on the state where you live. You have to check with the Health Department of your county. They will give you information. In some states there are programs which cover prenatal visits for women without insurance.
Check with them and go to visit a doctor as soon as possible. When I was pregnant I was eager to go to prenatal visits to see that everything is normal.

Update me. Today we passed biometrics. We have our appointment at 9.00 but were went there 15 minutes later because a traffic. Everything was o.k.

I have my interview for K3/K4 visa at the embassy in October. I know my husband for 3 years and we have 1 year old baby. When I went to the interview I brought with me many photos where we have been together and from the wedding. The CO refused to take them. He said he didn't need them because it is pretty clear that our marriage is real because we have a child. They didn't ask me questions to verify our relationship. We received our visas. It is my personal experience. They even didn't take my evidences. We never made DNA test.
When we sent our I 130 one of the requirements was to enclose documents proving family relationship. One of this documents is "Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together". We enclosed only Birth certificate and everything was o.k.
Frankly speaking I don't believe that somebody will have a child only for immigration purposes. For me it is not serious to think that having a child is a proof that you have only sexual relationship with this woman/man. Hope that most families have children after serious relationship.

Yes, the waiting time is very difficult. When I was waiting for my approvals some people couldn't believe me that it is possible to be married and to wait so long to be with your husband/wife.

I waited 8 months to come to USA and to be with my husband. /K 3 visa/.
In the summer Vermont was quicker than California. It is possible your case to be approved withing 3 or 4 months. Some people have their approvals fast. Wish you to be from them :thumbs:

We received a letter from USCIS. Biometrics scheduled 12/17/2007.
Can somebody tell me where my cases will be transfered after NBC. To my local office or to California Service Center where my I 130 and I 129 where approved.
