Hi,
I have a Venezuelan friend whom I worked with some time in the past while they had a humanitarian stay in Costa Rica. That stay has expired and they are back in Venezuela. Can I sponsor them to come to the US?
I make more than enough money. I was reading through some posts and had some questions.
Does a family member have to start an initial petition for them? I am not family and as far as I know, no qualifying family lives in the US.
If I can just file the I-134A only and that works.. can she also bring her granddaughter of whom she has full custody for a couple years now?
Anything else I'm not thinking of?
I'm just trying to help her move to somewhere safe, or at least work here for a couple years and save money for when things improve.

Point is the visa is to use to enter the US, not to be used for the entire of living in the US . So enter before it expires and you are good. The green card comes after.
I assume that's why you are asking.

I actually had put (245) (c) (9). But saw an example with just (c)(9).
That's what I saw on some posts but I wasn't sure as most of the examples are for K1 visas.

Hi, Thanks in advance for your help.
I had previously filed an I-130 for my parent and already have the NOA1 but after they came for a visit (and I became a citizen) I am adjusting them from a B1 Visa. I notice the NOA1 has the Section listed as '201(b) INA' , is that what I put on form I-765. under eligibility category?

In my case i did the roc biometrics less than a year ago. So the biometrics was current and done locally.
The only thing of note is that the roc case hasn't been updated to 'biometrics taken' almost one year later. So maybe the automated system didn't recognize that.
I'll just go and do the other biometrics.
-
I got a letter for new biometrics a couple weeks later. Seems reuse isn't mandatory.
-
Update:
I got a letter to do new biometrics though I did the ones for ROc less than a year ago.
So I guess it does happen

Tier 1 officers know less than you.
Every case where you pay a biometrics fees requires an USCIS case worker to look at previous nineties and make a session whether to schedule a collection or waive it. The decision to collect your N-400 biometrics hasn’t been made.
Thanks. Just wondering why other people to submitted N-400 online got an instant waiver for Biometrics plus their location assigned.

Why do you think you will have a biometrics appointment?
it’s possible but I think improbable
The agent I spoke to told me that.
More concerned that their own system didn't pick up I had one on file and if I'd need to do it again.
-
I filed for removal of conditions a year ago and did the Biometrics in December 2021. My case still says 'Case received' which isn't a big deal except I noticed that people who applied for N-400 after me has had their biometrics waived and already were assigned to a location. Many times automatically from the online portal.
I called USCIS to ask and they say they can see the Biometrics on their side but there is nothing I can do to have them update it on the portal. The agent I spoke to also said she sees I am in the queue to be scheduled for another Biometrics. I suspect there is a disjoint between systems and because my status isn't updated for the I-175 it is affecting my N-400 which is giving an approximate completion time of 16 months and is assigned to NBC, not a local location.
Anyone else knows how to trigger the update on USCIS side or have been in similar position? Did you do two Biometrics?

Curious as to why the Visa fee was paid before even the interview. The fee for the greencard was to be paid after the interview and the visa approved. This means potentially having the visa in hand.
I think I needed a number from the actual visa to pay, but I may be mistaken.
Paying too early may have been a reason, or using the incorrect number/code when paying.
-
I recently arrived on cr1 and went to the ssn office to apply for the number but was told i couldn’t apply as it automatically will be processed and sent to me in three weeks.
For people who checked the box on the ds200 how long did it take for the physical number to arrive?

in the overwhelming majority of cases, the only thing they can ask is if you have legal work authorization.
In a few cases, most notably on certain government or military facilities, you are required to be a citizen. So if their client fell into that category (certainly plausible), then yes it is legal.
For example, my husband can not work out in the shipyards in norfolk (at least most of them), because he is not a citizen.
That is usually covered by asking working permit status, which is asked in most online forms along with whether you will need sponsorship in the future
. The how part though was weird.

Thanks everyone for the responses. I spoke to many other recruiters who did not ask that either. I feel more confident to tell any other recruiters that ask that it’s not their business.
-
Been approved and have CR1 visa in passport so now seeking job. In a recent chat with a recruiter I was asked how i got my green card? I asked why they needed that info and they claimed its because of the client. I have applied for the client directly before and all that is asked on their website is whether I have work authorisation. He then asked if its though diversity lottery.. I said no. Then he asked if I have ever been to the USA.. I said yes, may times.
Does it really matter? Is this something I should be answering?
*note, explaining how would reveal my family situation which is not the recruiters concern imo, but maybe I am overreacting.

So I'm looking at the vaccines required and my wife is suggesting that I get them done before the medical. Think that makes sense?
Depends on where you are it could be way cheaper . I wish I had

Check the rules on immigrant intent. I think they should consult with an experienced immigration lawyer first before making a mistake based on opinions of people. The only entry in which people come to the country with the intent to get married is the K1 visa. The legitimate legal way to do it.
You can get married anywhere as you meet the requirements. Whether you leave or stay and adjust is up to you.
Thousands have just married in the USA and left to do documentation in their home countries.

I think the op is not being rude just pointing to the very specific question asked which is ONLY about offering extra information.
I don't have an answer beyond don't offer what isn't asked. I know many people who with the most details and ties still got denied. Be positive. Have her speak the truth about what's asked and let it be. For example if asked why she is going to see daughter at this time then she could offer details about pregnancy and critical time.
Good luck!

Finally submitted my documents just now! Took me a while tbh to get everything sorted, especially because I get a little finicky. But done submitting *phew*
One question: do we need to submit marriage certificate with I-864 as well?
You should for the petitioner documents

hi guys, so we heard back couple days ago, divorce certificates accepted, now they want proof of employment and also a joint sponsor. I suppose everything should have been submitted right away at the first submission and our wonderful attorney went by the logic of if they're not specifically asked for it we're not giving it to them. So now we're playing catch up. We added our joint sponsor but for some reason the website is saying proof of us domicile is a required document, our joint sponsor lives in the US, he doesn't even have a passport and has never left the country. Now I am not sure what to use as proof? Can I upload his state tax return for last year as proof? He doesn't have a voters registration, which is what NVC suggested when I called them. Or would a drivers license be enough? I am so completely lost.
Also another question I have, uploading his federal tax return, do I only upload form 1040 or do I also scan the forms 8880, 8867 and 8879, which were all in the same packet he gave me from his accountant? The forms say they are to be filled with 1040 and are named, efile authorization form, credit for qualified retirement savings contribution and paid preparers due dilligance checklist. Do I scan all of this in with the 1040 or do I omit this? We have been screwing up since may, this is our 5th resubmisson and I am at my wits end at this point
Also, for my proof of employment, letter from employer would be enough? I am a bartender and don't really get regular paychecks
Thank you in advance
Drivers license can be used for proof of domicile. I think our also need proof of citizenship/ residence status. I know I uploaded a passport as well. Maybe birth certificate too.

I lived in a third country for some years (Costa Rica by the way, pura vida!) and I apostilled everything I got back from there. I haven't had the interview, but they did ask for CR police records. Apostille is proof that the document is legitimate outside the country of issuance, since my interview is outside of CR I got it apostilled to be safe.
I have not apostilled mine from a third country, did you use a lawyer for this?
-
For those who finished the interview and did it in a third country, did you need apostilled versions of your civil documents?
Thanks on advance.

Those with spouse + children’s visas, how did you get cc’d, on the same date? And IL’d, on the same date? If not, what did you do to “align” the two petitions?
My husband’s CR-1 was cc’d on 10/1, while my stepson’s CR-2 was not even looked at. Status still “submitted”.
Even though I submitted for my stepson’s two days earlier than for my husband’s.
Now I see two cases for same Embassy (Paris) with later cc date got their IL, while for us still no good news.
Does it make sense to do an expedite with NVC? What should I do?
They were all cc'd at different times. Then child was given interview first. I waited a couple days to see if they would align then I Had to send an email to NVC expedite to request interview for same date.
They responded a couple hours later. Same date and time.
I would wait for at least the interview for one to be set then request alignment.

Thanks for answering.
So do I start from the I-134 for both?
