  1. Hi there,

     

    So I'm still in AOS waiting upon my rescheduled interview from January! I recently had to renew my AP but couple of things...

     

    1. Is AP safe to fly with? By which I mean ...fly back to the UK with my UK passport and re-entering the country with AP? Is there anything else I need to bring? I have no convictions in the US but I'm really worried about leaving as I'm an overstay past more than 180 days on a ESTA but married US citizen and doing AOS, I'm not sure this matters at all...

     

    2. This is probably more complicated - I thought I lost my AP (I found it eventually in one of my many folders) however in my panic as I wanted to doit as fast as possible as im trying to attend my mates wedding in England, I thought I couldn't find it so I sent off a new application for Advance Parole, will this further complicate matters? Can I still use my valid AP I have in hand?

Well the wife makes $22k a year now with her job and my joint Sponsor currently does the same but he's about to go back into the job permanently where he made $40kish a year so I guess hopefully my interview will pick up after that but even so, would wife's and joint Sponsor income be more than sufficient since that's a combined $40k a year anyway? Would just have to provide recent paystubs / cheques?

    Out of interest I'm not sure if this has happened yet with anyone but I have a joint Sponsor that used to make $40 - $50k a year pre-covid, that was submitted with my AOS paperwork but obviously since Covid happened that hasn't been the case till recently where everything is picking up again, my joint Sponsor did file his taxes but mostly with unemployment "income" which was over $25k, will they look at this and take in consideration Covid and the like? Wondering if there's any experience with this on here before I have an interview and what I should bring document wise etc :)

    We recently had an interview for my husband I-485 AOS and it went well as far as we know. There is an issue here, We been together from many years and married after dating close to 5-6 years. My dad was very happy and witnessed our wedding and signed our wedding in the court. After 3 years of happy marriage life, he started to trouble my husband and me and asked me to divorce my husband, if not he will report to the U-s-c-i-s that my husband married me for GC. During the interview, the officer questioned me about how my dad feels about the wedding and why he thinks my husband married me only for GC.(which is not true, my dad complained out of personal hate and trying to prove to u-s-c-is that it is not valid even though my husband and I are honest) 

     

    The officer asked us general questions and later said I am unable to make a decision at this point and I will mail you a final decision. I am very worried about the outcome even though my love and relationship are strong and real. 
     

    please advice and suggest what might be the case in this situation. Thank you all. 

    How did the Officer know about your Dad's complaint? Did you tell them what your Dad said I.e brought it up yourself?

    You should be able to get a Real D.L with the star on it (since DL is changing from next year). With your EAD/AP and passport you can travel domestically . TSA is only interested in matching names and details on the boarding pass. There is no need to worry.  Also have you applied for your SS card?

    So i do have my SS card but my problem as i found out today is that i only have my first and last name on the card not my middle name and according to the DMV i need my middle name so cant get REAL I.D ho hum and the SSA arnt open to correct it.

     

    So if i show TSA, my UK passport + EAD/AP Card they'll be fine? Ive heard stories of ICE / CPB questioning AOS applicants etc.

A couple of days later we got a letter from our field office (no online update) asking us to mail them evidence of bona fide marriage. They didn't say it, but we understood it as "we're gonna waive the interview if we like what we see". So we sent them our evidence and after 15 days my status changed to "new card being produced" and then "case was approved". Sooooo happy!!!! Good luck y'all!

  7. So chiming in here, my situation was this..

     

    i married my USC wife in 2019, still in the process of AOS and there is (or at least was) a massive kicker here.... so my wife hadn't filed her 2018 taxes as she had no requirement to do so but she was due a refund so with the virus we had the time to go and complete all this, i went to H&R Block who advised me to file as Married filing Jointly rather than Married filing Separately for the wife as i had no SSN (at the time) as i believed USCIS had shutdown for a long while before i would receive my EAD + SSN, so H&R block then did a ITIN application for myself which at the time i thought would be beneficial for us with the stimulus but there was an unknown thing at the time in the CARES ACT then anybody in the family files with a member that has an ITIN then the whole family is ineligible which means a potential $3,600 for a family of 4 gone....

     

    So quite literally a few days after filing our taxes, guess what? only my SSN + EAD were produced and sent out to me! i thought it was too late to add that to the 2019 tax return as we already mailed in but i was informed i can then file our 2020 tax returns with my newly established SSN and receive the stimulus money in our next tax refund, oh well.. have to wait a year or so 😕

     

    Then something weird i thought happened, the 2018 tax return that was e-filed... the tax refund cheque came back in the mail but no news at all on the 2019 Tax returns or even my ITIN application, most likely due to mailing in would result in massive delays at this time anyway and i'm sure an ITIN application would be very low priority even at the best of times, i went back to H&R Block today to see if we could e-file with my new SSN on our 2019 Tax returns and yup, we were successful and now eligible for the money and anything else that will come every Americans way in the near future (talk of a $2k for every American a month)

     

    Still a huge kicker when an Alien is trying to do the right thing.

  8. By the sounds of it, the people NOT exempted from this ban are Spouses and minor children of Permanent Residents / Green Card Holders, basically if you're not a US Citizen or married to one, you're on your own for the time being.

     

    AOS applicants INSIDE the US are completely fine if you're married to a USC.

     

    He also mentioned that he can extend it or change it, who knows. - his words.

  9. Sec2.  Scope of Suspension and Limitation on Entry.  (a)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall apply only to aliens who:

    (i)    are outside the United States on the effective date of this proclamation;

    (ii)   do not have an immigrant visa that is valid on the effective date of this proclamation; and

    (iii)  do not have an official travel document other than a visa (such as a transportation letter, an appropriate boarding foil, or an advance parole document) that is valid on the effective date of this proclamation or issued on any date thereafter that permits him or her to travel to the United States and seek entry or admission.

    (b)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall not apply to:

    (i)     any lawful permanent resident of the United States;

    (ii)    any alien seeking to enter the United States on an immigrant visa as a physician, nurse, or other healthcare professional; to perform medical research or other research intended to combat the spread of COVID-19; or to perform work essential to combating, recovering from, or otherwise alleviating the effects of the COVID-19 outbreak, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees;  and any spouse and unmarried children under 21 years old of any such alien who are accompanying or following to join the alien;

    (iii)   any alien applying for a visa to enter the United States pursuant to the EB-5 Immigrant Investor Program;

    (iv)    any alien who is the spouse of a United States citizen;

    (v)     any alien who is under 21 years old and is the child of a United States citizen, or who is a prospective adoptee seeking to enter the United States pursuant to the IR-4 or IH-4 visa classifications;

    (vi)    any alien whose entry would further important United States law enforcement objectives, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees, based on a recommendation of the Attorney General or his designee;

    (vii)   any member of the United States Armed Forces and any spouse and children of a member of the United States Armed Forces;

    (viii)  any alien seeking to enter the United States pursuant to a Special Immigrant Visa in the SI or SQ classification, subject to such conditions as the Secretary of State may impose, and any spouse and children of any such individual; or

    (ix)    any alien whose entry would be in the national interest, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees.

    Yup to clarify, i didn't need to do her 2017's because she didn't work at all for that year and thus earnt not a single dime. so filed her 2018 and 2019's returns.

     

    2018 returns were filed as single

    2019 returns were filed as Married filing jointly and also applied for an ITIN whilst doing so.

     

    H&R Block told me that 2019's were mailed and 2018's were efiled, so will that delay for the 2019's show up to the IRS that i now have a SSN and thus no longer need an ITIN and then reject the tax return + application?

  11. I'm not sure if many people have ever been in a similar position... anywho's...

     

    I'm married to my USC Wife and currently waiting for an interview for my Adjustment of Status (obviously everything has grounded to a halt) so around 3 weeks ago now i got underway to start filing taxes for me and my USC Wife since she hasn't done them since 2016 (she never legally was required to file but still was due a refund) so with the free time, i went to H&R Block to do her taxes and at the same time file a joint married 2019 tax return and i applied for an ITIN since i thought it might of been beneficial (unaware, it really wasnt short term at least) for us, so we did that... now fast forward around a week or two later, i was surprised to find that USCIS had sent out my SSN and EAD combo card, i'm now a proud recipient of a SSN and able to do things on my own like any other normal American!

     

    Long story short, our 2018 refund was processed and Tax refund check was sent out a few days ago however our 2019 tax refund hasn't been processed or least didn't come with the 2018 check, weird considering we did them together?

     

    Is there any chance that since i was issued with a SSN that my application for an ITIN would be rejected and thus the tax return not fully processed and returned? Has that happened to anybody before or are they just delaying the 2019 tax return because i havent actually heard anything back about my ITIN application either?

    so i got myself a RFE for my joint sponsor, i probably know what it was for but i need to know how to reply back to the RFE.

     

    Bit of info to help this -

     

    My USC wife did not meet the financial requirements to sponsor so i had to find myself a joint sponsor, infact my wife didnt earn more than the amount to even file her taxes (i ticked that box and sent in a letter explaining why) My Joint Sponsor made more than enough but he didn't give me his actual 2018 Tax Transcript, he gave me something else which i guess it's my fault for not double checking for 2018 as it turned out, he never did his 2018 taxes, just his 2016 & 2017, so i believe that was the RFE was for as i included the following

     

    - last 3 months Pay slips

    - 2016 & 2017 Tax Transcripts

    - something for 2018?

    - Proof of US Citizenship (Birth Certificate)

     

    So i asked my joint Sponsor about his 2018 taxes to which he said he'll doit in December but then told me he hadnt done them to which he eventually did at the end of January, my RFE is from the 26th November meaning i only have till next week (21st Feb) to get this done and the Tax guy told me it might take upto 6 weeks to get his 2018 taxes done as its backdated, meaning i have to find myself a new joint sponsor!

     

    Which thankfully my mate who is my roomie volunteered to step in and doit for me, he makes $36k a year so well above the threshold of $21k

     

    Now so i need to file this by the end of the week and need to make damn sure i do not get this wrong! 

     

    Questions i do have 

     

    1.  in 2018 his taxes reported were (that's his total income and AGI) $36,010 , 2017 - 50,781 and 2016 - 43,957, he has actually already done his 2019 taxes which is reported as $37,575, after reading forums and everything that is available from questions via google etc, am i correct in saying for Part 6, Question 7 where it says "My current individual annual income is" i would then put his "anticipated" income for 2019 which i obviously know since he's done his taxes as $37,575?

     

    2. Then following that, Part 6 Question 20, it says "My Current Annual Household Income" would that be $37,575 or what was reported on the 2018 taxes which would be $36,010?

     

    3. What are the required documents do i need to provide for my joint sponsor? is there an requirement to show pay slips as i have 9 months worth but that's from Jan 2019 - September 2019 and not his most recent pay slips, which i'm not entirely sure i'll be able to get by next week? What i do have is the mentioned 9 months payslips, his US Passport, Proof of Employment Letter stating he is there full time as a server and been employed for however long and is an employee in good standing" with company letterhead.

     

    i have uploaded the screenshots of the letter i received for my RFE so hopefully that helps as to how i can proceed further with this...Also do i need to resubmit my Wife's i-864 again or just my joint sponsors? as it doesnt make any mention of that except just for the Joint Sponsor

  13. Also filing in New Orleans, people there were lovely and professional, got there early myself and went through fine, Appointment was for 10 but as i arrived early, i was done by 10.15.

     

    My timeline so far.....

    10/04/2019 mailed out my AOS package. 

    10/06/2019 AOS package received by USCIS

    10/16/2019 received 4 Official Receipts Notice (I-797) via text.

    10/18/2019 Hard copy NOA received with a notice date of 10/16/2019

    10/22/2019 received I-797C biometric appointment. 

    11/05/2019 Biometrics completed.

    11/06/2019 Case was updated to show all Fingerprints were taken and case is in process.
