  1. Hey there-

     

    CR1 visa couple here and we had never interviewed in the USA- just in my husbands home country.  We have our interview here in our home city in a few weeks and I’m unsure if I’m supposed to bring my evidence back from the initial CR1 I130 interview (like travel proof, old photos from before marriage etc) or if I need to just bring our new stuff - house deed / bank statements  / shared children’s birth certs etc.

    Yea I agree- I think that’s why! It’s odd to me in general because I feel like I had to submit a crazy amount w my original I-130 and the CR/IR process is actually more tedious than K!  I guess I’ll bring all my old I-130 docs with me too just in case.  Are you waiting on interview as well?

    Same situation here- just got changed to ready for interview.  I am wondering how to long to expect to receive a date because I am expecting our first baby in February.  Also I see almost all K1 filers are being waived for the interviews, but us CR1 are not. 

  4. Has anyone from MSC (CR1 ROC filers specifically) gotten any update on biometrics?? It seems the only ones who have been waived have been k1.

     

    my packet was actually initially received 3/26, however weirdly they changed received to 4/17. That’s the only update I have and it’s nothing. I thought biometrics was 4-8 weeks after filing. Is that super delayed too?

    I called USCIS and they told me that they won’t grant us an InfoPass apt for a 551 stamp if our letter is still valid.  They said the stamp is only for expired extension letters

  6. Hello-

     

    I know this has been asked a million times, but due to COVID, I am being extra careful.

     

    We have a trip back home (international) planned for August.  We just received the NOA1 for the I751.  I called USCIS to see if I needed a stamp, but she was adamant that a stamp is only for expiring extension letters and that my info pass request will likely be denied because I don’t need a stamp.  I initially worried that biometrics won’t be completed, but she reassured me that biometrics doesn’t actually matter in regard to travel with the extension.

     

    Has anyone traveled internationally since COVID started with their expired GC and extension letter?  Any issues?

    how long did it take to get fingerprints after NOA1? I’m hoping to travel internationally and want biometrics first.  

  8. Hi! It’s been two weeks since I got notice that UPS delivered our I751 package.

     

    A few questions... 

     

    1. How long is the current receipt wait time? I just hope it’s not too long because I will worry that they didn’t receive my package or something and time is ticking...

     

    2. I’ve seen that biometrics apt doesn’t come now for months after receipt.  I read somewhere that with your I751 extension letter, you can go to the local USCIS office for an extra stamp to travel.  Does anyone know about this? My husband really has to see family this year.

    The first year offers lots of options.

     

    If he has cash income they can list that as foreign income if you are filing MFJ.  If filing MFS the income doesn't really matter.   If he doesn't have any US income then in a MFS situation he doesn't have to file.

     

    It is fine to just have one tax return at ROC.

     

    He lives here with me now. Before he entered the USA he earned cash in his country, but we have no documented proof of earnings. Wasn’t sure if I needed a W2 or 1099 to claim that income or if I can just write in an estimated amount because there is no official documentation of his foreign earnings before he entered the USA.

    You are incorrect......if filing a joint return, world-wide income for the entire year must be reported.  That is the law.... There are multiple tax strategies for a person entering the US the first year.  It is possible to file separately.  He could then be classified as a dual status alien.......then report only income from US sources.  A competent tax pro will calculate both ways to determine best strategy.

    Then what do we do if the income is not documented? We have no forms or any proof from the foreign country as their pay system is nothing like the USA, nor can we obtain anything from them stating he was paid.  

  11. Hello!

     

    Just had a bad experience at HR Block trying to file taxes.  My husband has a GC valid as of 6/15/19.  He did make some (small) income in his country of residence prior, but they don’t really do taxes there and there is no documentation of anything related to income.

     

    HR Block told us we had to claim money he earned before we attended our visa interview, but that seems inaccurate to me because why would we pay US taxes on money earned abroad before he was even a visa holder and permitted to enter the USA?  I don’t see why we’d have to  claim anything that he made unless it was after the date of US entry.

What documents does she need for a smooth entry back into the USA next week? I also understand that she and I can go through the same line? (I'm a US citizen). Thanks for any tips and advice. We are also celebrating our 2 year wedding anniversary in few days. :)

    Have you guys gone yet? We are supposed to travel in a few weeks to my husband's home country and we are nervous because we haven't traveled yet and don't want to do anything to risk our newly obtained GC.  

  13. Hi!

     

    My husband received his CR1 Visa in May of this year from Costa Rica.  We have a trip planned in a few weeks together to visit his mom, but I am nervous to travel.  I know that our documents are all valid, unexpired, and legitimate, but I fear that we would have some horrible border control person and they'd give us a hard time re-entering.  After all the years apart, it is difficult for me to risk this.  Can anyone who has a similar visa/ situation give their experience or reassure us that traveling will probably be ok?

    Since it’s past the tax date, they will want 2018 or a letter of extension/ exemption as to why you didn’t file.  If you have that documentation, bring that along with 2017.

    My husband doesn’t speak English yet either! It’s a learning process and we communicate in his language just fine happily here in the USA!! The USA is a mix of people and English certainly isn’t a requirement. I find it funny that the person who didn’t want to offend you, doesn’t even know how to properly spell “offense” ! Good luck in your process!

    Did you guys check that box on the application?

    I checked it too! All the office told me was to wait 3 weeks and if they didn’t send us it, they could issue us one.  It never came so they issued us one.  If the border officer doesn’t do something correctly when you enter, you’ll never receive a SSN even if box was checked off. (That’s what our SSN office said has been happening lately)
