ETA: I am not sure what who married you. If it was someone from the county or an officiant who had their own rules. But, rules have changed since the online marriage became possible and they're continually improving the experience for overseas applicants.
  3. So, once you divorce you will send USCIS proof of divorce and switch to divorce waiver. You do not have to do anything until you have the divorce paperwork in hand. Hopefully they will approve your I-751 soon without interview. Are you and your wife still on friendly terms?

  7. This question has come up several times in the last month. People have a USC partner and want to return to the US on an F1 visa that is still valid. As long as you have the correct documentation to enter the US you should in theory be fine. No one can tell you what will happen, but if you decide to follow through. Please return and give us feedback as this will help others in a similar situation.

Your partner is probably about 5-6 months away from moving to the US if you continue with the K1 process OR You can get married via Utah fairly soon as you are both still in together in UK, correct? That way you don't have to wait for permission to get married in the UK. . . Some people have been extremely lucky and have the I130 approved fairly quickly after an approved I129F... so you might not have to wait an additional 12 months before you hit the NVC stage but you might still have to wait 18-24 months before your partner can move over to the US but if your concerned about finances you can think of it as more time to save money and have the best possible start to your life together in the US.
  9. If AOS is secondary, that means it is not important at all and you are intending to go back to France once your job is over and OPT expires. What is more important: Remaining in the US and not being separated from your USC partner or Having a party/wedding in France this summer?
  10. What do you mean by "shaky" are you having relationship or are you attached to @Seino and worried about the I-134? US Embassy UK is fairly easy going~ This poster apparently was planning on using bank statements and a letter of proof of employment. You might want to DM to see what the UK embassy requested~ Apologies if I am incorrect and you are not connected to the above named poster.
  11. One more thing: US Embassy UK is one of the easier consulates and they have a great website. You can probably send them a message about potentially delaying the process and they should be able to guide you~ But as I said above... you are probably about 4 months out from interview so the need to delay is probably not necessary.
  12. I would follow the UK forum to see what people applying for K1 visas are doing and tips for the medical. Then after you arrived to the US join the month you filed AOS to see how your peers are doing here. Good luck! Don't give up and congratulations on your petition approval! This is good news not bad~
  13. You won’t be able to know how long the CR1 will take because 1.) You can’t choose your service center and 2.) even if your NOA1 indicates your are at Vermont… you might be transferred to California or Nebraska while you wait… The best advice I can give is to plan on 12 months. If the petition is approved before that EXCELLENT. If it isn’t you can hope for a long time waiting so your partner arrives on IR1 as opposed to CR1 and you save a lot of money and heartache as you skip the ROC phase in the US.
  14. This is why I say "miiiiiiiiight".... But, with a valid SA passport they would still be allowed to travel on said passport. I've known others to do that and I've known others who've been able to renew their passports even though they didn't apply for retention. Just something to consider. But, applying for retention can take as little as 4 weeks if the consulate is on the ball. Or one could send in the letter to SA via a document assistant company.
  15. Is your partner formally renouncing their South African citizenship or are they just not applying for retention (they're in the process of changing the law)? If it is the latter, your partner might still be a South African after they acquire NZ citizenship...   16. How many people does your partner include when they file taxes? Or are they a dependent on someone else's taxes? Household members if they file taxes separately do not need to be counted in the affidavit of support. In other advice, I would have your partner move back to the US ASAP and get a job. If you do not have substantial savings how are you going to afford the move to the US (plane ticket, maybe a second car or paying for uber to get around (if you cant drive), living expenses and adjustment of status packet)?
  17. The very first thing you need to is figure out where/how you want to get married. If she has the vacation time she can go to the US and you can marry in the US. Or you can marry via Utah (but make sure you are together either before or after the wedding) Or you can get married in Peru (if you have the vacation time). You then file the I-130 (online is best) and wait. You can visit your partner and she can visit you during the process.
  18. No, B1/B2 is canceled and person has “authorized stay” and won’t accrue unlawful presence. She is ADJUSTING STATUS not EXTENDING STAY. She can stay in the US until the green card is approved or if she gets permission to travel(you have to file I-131). It is similar to the K1 process. So, if your mom is already in the US and if she wants to STAY in the US more than she wants to go back to India and she has no need to return to India for about a year…. You can file the I130 and I485 at the same time. With documents to allow her to leave the US and to work. But, she cannot leave the US until she receives a travel document or her green card (whichever comes first). If she leaves the US before she receives permission she will lose her B1/B2 and she will have to stay in India until she receives an immigrant visa.
  19. Hopefully, they'll take pity on you because you are traveling with a 5 year old. But, I've been in secondary before watching people get grilled. Not sure why you might want to expose your daughter to unpleasantness after a long flight to an additional couple of hours while they sort out her paperwork and your paperwork. I know you can't turn back time- so this is a message to other people who might find themselves in a similar situation- but you could have renewed her US passport 6 months before it expired... so before you left for the UK or even right after you arrived to the UK.
  20. So, she is currently working without authorization? Has she checked to see if that will compromise her ability to get VAWA if she applies for it?
  21. Not sure if it is taking longer these days. But, I’ve known USCs to get their passports from an embassy in about 7 business days… I assume getting consent from the father isn’t an issue as they are going to the US to visit him.
  22. It depends on the parents. But, I've seen something similar to Ontarkie's scenario. Child lives with the mother and father visits the mother and child (because she cannot travel as easily). When child gets older they fly unaccompanied between to two parents. Flying to father for their vacations and then flying back home for school. In another scenario, the mother received custody (she was USC) and child has not yet visited the father as parents did not have a friendly divorce. And neither parent wants to/ can afford to pay for the travel to the father's country.
