As a K1 applicant, you can only adjust through your K1 sponsor. if they are no longer willing to sign an I864 for you- your only choice is to leave… If they sign the I864 but pull it before you’ve adjusted- your I485 will be denied. VAWA is an option only in cases of abuse but that is a fairly long and harrowing process.

Correct! Marriage certificate is proof of name change! And then if she changed her name after divorce… divorce paperwork would be proof of name change!

Which state/county did she get married in? When did she get married? We can double check to see if it is impossible to get the marriage certificate... She should be able to go to the county webpage and request copies of her marriage certificate.

Which country are you interviewing out of? I know the UK can be a little strict but other countries are a little more forgiving with regard mental illness issues. -
2008 Version The 2008 version of the civics test is an oral test, and the USCIS officer will ask you up to 10 questions from the list of 100 civics test questions. You must answer 6 questions correctly to pass the 2008 version of the civics test. Applicants who filed their Form N-400 before December 1, 2020, will continue to take the 2008 civics test at initial exam, re-exam, or N-336 hearing. Applicants who file their Form N-400 on or after March 1, 2021 will also take the 2008 civics test at initial exam, re-exam, or N-336 hearing. 2020 Version The 2020 version of the civics test is an oral test, and the USCIS officer will ask you 20 questions from the list of 128 civics test questions. You must answer at least 12 of the 20 questions correctly to pass the 2020 version of the civics test. Applicants who filed their naturalization applications on or after Dec. 1, 2020, and before March 1, 2021, with an initial examination (interview) before April 19, 2021, will have the option to take either the 2020 civics test, or the 2008 civics test at initial exam, re-exam, or N-336. What is your country of birth? Is your birth certificate in the format NVC requests or is it not? Because if it isn't- you do not have a birth certificate as defined by immigration requirements... https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html I would do what you suggested - no name birth certificate and secondary evidence. As an alternative- check the requirements for your specific country and see if you can procure the correct type of birth certificate. I obtained my birth certificate 3 years ago as the birth certificate I had on file was not the correct birth certificate for immigration purposes.

I believe they no longer handle deportation cases. Not profitable/ they usually don't win... long and drawn out... Hacking's show is great when he has some of his paralegals and lawyers join. As they actually handle cases and are more aware of the ins and outs of immigration right now. I also liked Daniel and his appearances as he was a great cohost although at times he seemed to look like a hostage who really didn't want to be on camera... I think Hacking mostly is the face of the firm and goes to some immigration interviews as moral support for clients... but I could be wrong? He is also a big proponent of filing the mandamus. A great little copy-paste money maker. WRT to Argentina employees I think I saw a post where they pay their paralegals $800 a month... so great savings! I sent @Rocio0010 the link a few months ago when she asked how much paralegals working for Hacking make... -

I really think you should make your own post about this. It is a totally separate topic to "respectful replies". Everyone (regardless of their political views) can go through the immigration process (if they have a basis for petition). Everyone (regardless of their political views) can apply for a student visa, j1 visa, tourist visa- they might not get it but they are allowed to apply. VisaJourney for whatever reason has kept CEHST up. If people don't report threads, how are mods supposed to know there is an issue? If people decide they don't want to engage but they'll keep to certain forums and avoid other forums and avoid certain topics and posts. That is a choice they've made. They can't then complain that certain posts are still up and "why haven't the mods done something?" If you don't complain about what you don't like- mods will never know. I feel like I have replied as much as I can in the thread given the initial complaint. Good luck to everyone in their immigration journeys and see you in some other threads! -

@Doc B are you the petitioner or the beneficiary... As @JeanneAdil stated the USC petitioner needs to reply to the letter. Have the two of you spent a lot of time together? Before/after the petition was sent back to USCIS? I would include a lot of evidence of face time if possible. -

I think moving the discussion away from @AndiB's OP is taking away from her point. What happens in CEHST and Off Topic are clearly marked as not about immigration. Former and current members of VJ go to these threads to talk about beauty, games, things you could have been doing while waiting on immigration, rants about your day and issues you're having in your life.... and yes there is a very inflammatory politics forum. You could call it a place where members "go of to blow steam when they want to take a break".... If you think certain topics should be nuked from the forum. Make it a your own separate post. If you think this should be solely about immigration. Make that a post/suggestion. VJ has existed for a long, long, time before you started your immigration journey. And it has evolved. If you read extremely old threads you'll see people were extremely offensive rude and inflammatory. Be the change you want to see. Conduct yourself as you want others to conduct themselves and if you see something harmful or offensive: report it. The moderators on here have stated OVER AND OVER again they cannot monitor every single post made. If you disagree with someone or think it is offensive REPORT IT. If you think something shouldn't be there: REPORT IT. You can also block certain posters so you no longer see what they post. I've done that with several members. -

ETA: Don't lie about the child. When you are called back for a second interview. The child will be on the new I864. You will have to explain things then. Does the letter contain reasons why they refused to issue the visa? You will have to explain why they are wrong for thinking these reasons show you are not in a real relationship. Reply to every point they made in the letter. Explain your timeline. Explain how many times you have seen each other since you first met. Explain how long you've spent together. Which country are you from? Some countries are high fraud and undergo a little more scrutiny. Your wife might consider moving to your home country for a while. You have a long road ahead of you. But, if your love is strong, sincere and true. You will be able to weather this storm. -

Did you read the sticky at the topic of CEHST? BELOW IS BOLDED FOR EMPHASIS: While moderators cannot and do not read every post in this forum, we will action reports sent to us, and we will apply the TOS to posts the same as any other forum. Also, when posting news articles please use a format similar to the following post in the Immigration News forum: http://www.visajourn...p?showtopic=466 You should never copy entire articles from other websites. Only copy the first few paragraphs (fair use) and then add a link to the original article so people can finish reading there if they are interested. 1. You're allowed to post articles in the CEHST. 2. You can disagree with @TBoneTX's political viewpoint. But, was his political viewpoint hindering his moderation ability? Were you aware of his leanings before you clicked on his profile or did you only realize this when you clicked on his post history. If you don't like what you see in the CEHST, you can report comments that go against the terms of service. Explain why they are incorrect and "because they have a right wing slant" probably isn't a great reason. Or you can post articles that contradict and disagree with the articles posted by the moderator in question and have a debate. -
But "faster" on average. K1 has more "certainty" when it comes to USCIS stage- it is the same for all petitions because they mostly all go through California (unless there are petitioner issues and it goes through Vermont). Processing times for spousal visas are all over the place. 1.) 5 service centers and you cannot choose your service center and many times you don't always know which service center you are at (sometimes you only find out after NOA2) 2.) NVC times fluctuate 32 days (early 2021) to 90 days (late 2021/early 2022) to 15 days (present day) 3.) Time from DQ to interview by country varies from 6 weeks to 2 years. If we are going to compare which is faster using averages. We really should be comparing times by country to see if switching from K1 to spousal is faster. The UK average from start to finish is: 481 days (spousal) vs 583 (K1) The Nigeria average is : 834 days (spousal) vs 635 (K1) As OP is from the Philippines: 461 days (spousal) vs 632 days (K1) *I used the last 10 NOA1 to Interview timelines for each country, K1 has the advantage of skipping the NVC stage (only the consulate reviews the paperwork) and the ability to schedule your own interview. Proponents of K1 should give suggestions about why they value K1 and the advantages over CR1. Believe it or not @Crazy Cat has amended his list in the past It really isn't just "his" list.

If you stick around long enough. You'll see mods do nuke threads where replies have been hostile. And members do get banned or put in a time out if they are overly rude and unhelpful (Generally if you see "administrative action has been applied"- someone has lost their posting privileges). Report members you think are being discourteous. Report threads where you think the OP is being bullied or there is an unfair pile on. Report threads if you think someone has taken it off topic and the OP is no longer being helped. The mods might not take immediate action but they do eventually take posts down and take the offender to task. One of the VJ rules: By way of example, and not as a limitation, you agree that when using the Service, you will not: "Restrict or inhibit any other user from using and enjoying the Forums." If you feel like someone is ruining your time on VJ report their post. Write and explanation in the report box. To add: If you see someone post lawfully report it. If you see someone post a Facebook page or whatsapp group - report it. The mods are reacting to member reposts. Sometimes they might catch a post that is off topic or rude. But mostly they are reacting to member generated complaints. -
One more thing to add about averages- they don't tell the entire story. Not everyone going the spousal route wants to get to the US ASAP. Some choose to delay the visa process for various reasons. We have a sticky in the NVC forum with a "how to" on delaying the process... Delaying the process comes up at least once a month... Here is the inability to plan travel post:

You can take that risk but if you are outside for more than a year. They will presume your wife has abandoned her US residency. Depending on when the twins are due when will she return to the US? Does she want to face scrutiny and a few hours in secondary being questioned about why she was outside the US for so long? Will she want to return to the US or will she want to stay in her home country with additional family support? -
Questions about income requirement?

Generally a great thing to write off expenses but terrible for immigration. Monthly expenses don’t really mean anything. They want to see proof of income…and it should exceed the amount I mentioned above (household of 3 unless you have children- then it is more). Joint sponsor- you will need someone to agree to complete the I864 for your future spouse and for her daughter. You still complete the affidavit of support but they complete one, too. they will have to make enough to support their household +1. Google I864p for amounts and i864 to look at the responsibilities of the sponsor.
