  1. Were you working for the US government in Dubai or another entity with significant ties to the U.S.? I would definitely consult with a lawyer. You might be able to fight their definition of residency in the US… Does you son not have any other citizenship can he not obtain an emergency passport allowing him to return to school so he can write his exams?
  2. Ah… i missed that… if he is Indian she needs to make sure not to marry on the first visit especially if she is not of the same nationality/ religion/ background and there is an age gap. It is even more important to make sure there are many in person meetings. Third country national in Canada marrying an American, they’re also more likely to encounter the DS5535 when they apply for the immigrant visa (especially if they’re studying something in science or biology). Immigration and long distance relationships are really expensive. It takes a lot of sacrifice but if you have found your person the wait ends up worth it. @OswRae what is your partner studying and how long does he plan to be in Canada?
  3. @OswRae you’re worry about Step 7 (3 years down the road) when you should be thinking about Steps 1 and 2. The affidavit of support is only needed at NVC stage after you meet, get married and file the petition. And affidavit of support means nothing if the consulate doesn’t believe the relationship is real. So, first steps: meet this person 1-3 times. If you live close to them you should be meeting them as often as you can before marriage and after marriage. Canada and US are right next to each other and it’s very easy for Canadians and US citizens to travel to the other country. If you don’t establish a good base of in person meetings I worry about the visa being approved. While you are building your relationship, look for online work. Look for part time work. i864 suggests assets can be used but it’s not a guarantee, so, if you can’t line up a joint sponsor you need to earn more money. You have 2-3 years to either find a joint sponsor or make more money. Don’t get married on the first or second visit. Don’t get married via Utah. Being in a U.S./Canadian relationship has real privileges to it..: If your partner is Canadian have them see if they qualify for a TN Visa. They can move to the US and maybe you can build your relationship like that… or maybe because where they live is so expensive have them move to a border city so it’s easier for the two of you to meet. Even though Canada is not a high fraud country marrying on the first/ second visit without a lot of IN PERSON time is a red flag. If you know this person is your forever person make sure you build a strong case FOR THE CONSULATE and so he is able to move to the US sooner rather than never. Good luck!

  5. You want the petition to be pending for as long as possible. Your stepson’s age will “freeze” once you submit the I130 once the period is approved (NOA2) he will start aging again. You are referring to what happens with IR2 petitions IIRC. If you wife was a USC and she filed for her Under 21 child he would not age out.

  7. K1 visa applicants can adjust status even if they divorce. Issue is… divorce was finalized in 2021 and you received the GC in 2022 and didn’t inform USCIS. I would consult with a lawyer. I would also look at your tax documentation- were you and your husband filing MFJ even when divorced or??? You might be able to figure things out but it sounds like filing for ROC is something you need to do alone because your ex husband sounds like he is playing with your status.

  10. Next question. The man who was shot and killed (the robber) he did this several times… how does this impact the other U visa applicants? Were they actually cooperating with police to get the assailant arrested or was it just for the EAD? How long was this scheme sustainable? Surely the police/ USCIS would have realized it was the same gas station/ the same perpetrator and all the victims happened to be undocumented… I need to find some more scams and schemes and how people get sussed out.

But I’m asking if THIS couple now qualifies to apply for the U visa because even though they were involved in the robbery scheme they NOW have witnessed a man get shot… I’m just wondering what the parameters of a U visa are… if you were involved in CRIME A but then you witness a crime B while perpetrating the Crime A… can you apply for U visa?

  13. He might not know the divorce was fake. If you listen to a certain YouTube show with a certain lawyer. You’ll find out people get divorced in Nigeria when they are overseas and the lawyer handling their case will take the money and run. And then send them fake paperwork. The advice to many Nigerians is to get divorced IN AMERICA then remarry their USC spouse so USCIS doesn’t question the validity of the divorce document. OP might not know the full story… her husband might have obtained a divorce in Turkey but used Nigerian divorce paperwork for first immigration benefit. I know a few people get confused and get divorced twice (once in country they live in and again in their home country)… But also, OP might have been lied to by the lawyer in Nigeria- he could have said the divorce was fake when it was actually real…

  16. He will have to remarry the first wife if he wants to petition her. Otherwise he is admitting to polygamy. If USCIS/ the consulate in Turkey didn’t catch the first divorce was fake they’ll probably catch it the second time around. Especially, if they interview in Nigeria. I personally don’t think hubby is bringing first wife to the US. The fact of divorce first wife, marry USC, divorce USC, remarry first wife is a known scam… @Bengoj should submit her evidence to the places @TBoneTX suggested and then move on with her life. The fraud finding/ stripping of US citizenship isn’t going to happen over night… so thinking about this for the next 5+ years won’t be too productive. And bothering USCIS over and over will most likely make it look like she is a bitter spouse not someone interested in justice.
  17. Simple answer: The spouse of a USC can naturalize in 3 years so you need THREE years of savings to support them until they become a citizen. All other family members can only naturalize after 5 years so you need FIVE years of savings to support them until they become a citizen. So, you'll need 3X savings for you wife to be and 5X savings for her child.

I said it might suffice not that it will… You might have to move to the US before your wife interviews… I believe common advice on this thread is to have 3 months worth of paystubs at NVC and/or interview stage. Job offer serves two purposes: 1) it shows you have made moves to return to the US 2.) it shows you are able to make enough to support your spouse. If you do not want to be separated from your spouse during this process AND you don’t have sufficient savings I recommend you get a joint sponsor.
  20. Qualified joint sponsor. I haven’t seen any successful cases of assets being used for AOS case. As you know we used assets for consular processing… but even that is hit or miss as some consulates don’t accept assets either and request JS.

  22. What do you want to happen and why? You are no longer on the I864 hook because he naturalized. You can divorce and move on with your life safe in the knowledge he is in Nigeria and you won’t have to run into him.
  23. Correct. At this stage you need to file I130 and I130a with supporting marital evidence. That’s all you need at this stage. You will then wait about a year before you get to the next stage at NVC. Financial evidence is for the I864 and that is at NVC.
  24. Please keep updated on the process. Have you had the medical yet or do you still have to go? There was one other person who had to complete a waiver for his tourist visa (not a medical) so this information would be helpful to others in a similar situation.
