As you are 1.) not currently working 2.) have homes in Korea 3.) have no solid plan to leave Korea without your wife. There is a chance they won’t give her a visa. I can’t predict the future. Buy a fully refundable one way ticket to the US if it makes you feel “safer”… but from what you’ve stated you and the wife could comfortably remain in Korea indefinitely without working. What concrete evidence are you planning to show that you will be leaving Korea even if your wife doesn’t move to the US with you?

VAWA isn't a fast or easy fix especially outside the US. It currently takes about 3 years when someone is inside the US. Most people don't apply outside the US but you would be waiting maybe 3-4 years. You won't be able to resolve your moving to the US issue in September when you are no longer able to stay in your current residence. I would add - if your spouse is being supported by you and has children (and appears to not be working). I do not think they will be able to successfully sponsor you via the I-864. You might want to reconcile with the reality that moving to the US is not on the horizon and if your spouse is currently not working and using you for money. He might not have ever had the plan to complete the process. -

If you're able to move freely to the UK/London and can afford to stay there for an extended time (for medical before the interview and in case of extended AP after interview). You can interview there. You were living there at the time the petition was submitted. If you prefer interviewing in your home country- you will have to request they move the interview there. This will add time to your process. Another member a few months ago interviewed in South Africa even though they had moved back to Zimbabwe. There were a few delays as the beneficiary was unable to obtain a document before interview. But, everything worked out and they are now in the US. -
Is it necessary to have a big religious wedding or is it possible to have a paper marriage and push back the wedding to next year/ a time you can afford the religious wedding? Hopefully you receive good news soon… but you might want to give the name of the country the beneficiary will interview in as that can help others inform you of possible scenarios and when the petition will move to the next stage.

You’ll need to tell your mom to figure out her priorities. The green card for a spouse is to reunite families IN the US. If your mom has no intention of living in the US without your dad there really is no reason for Montreal to give him a green card because they can and do live in Canada together. If your dad is a Canadian citizen he should be able to visit the US fairly easily. The issue is it sounds like your dad will be living inside the US with your mom while he waits for the visa to be processed. If it looks like he is moving to the US with your mom he could be denied entry and not allowed to go to the US until he receives the immigrant visa. Nothing is certain… Canadians can and do visit their American spouses while waiting for their immigrant visa. But, sometimes people are denied when they are suspected of moving to the US without the proper visa.

Excellent! I’m glad to hear it… I thought you mentioned child was 4 months old and didn’t know if they were born before I864 was submitted. You’ll be fine! If everything goes well then hopefully your wife will be able to join you in the US before a few days/weeks after her interview. It seems like ROC will be annoying as opposed to something you actively want to avoid so have her and your son move to the US as soon as they’re able!- 25 replies

You won’t know if mom’s intent to re establish will be accepted until your father goes to his interview. So, this is why members suggest your mother (the petitioner) moves to the US before the interview. AP in Canada can be lengthy which will delay the move for everyone. Does the entire family have to move to the US together? Have you or your older brother considered petitioning your dad and moving to the US ahead of the rest of the family?

Son is your child. You are now +1 for I864 (that is If son wasn’t on your approved i864 at NVC stage) I would update the i864 and have wife take it with her when she goes to interview. she can submit it in case they ask about the addition to your family and request a new i864.- 25 replies

Mom won’t have to move until I130 is approved (if Montreal consulate still wants USC to move before interview) and dad applies for visa by completing the DS260. This might take 12-13 months. Not sure of the family dynamic but I would file NOW and plan for mom and younger siblings to move to the US next August/September for the new school year… hopefully your dad will interview late 2024 and family will reunite 2025. None of the plans you’re figuring out now need to be submitted until NVC stage… so she can obtain DL, you can look at selling house etc over the next year… don’t delay filing because domicile has not yet been re-established. This is not a factor for the I130 stage.

Did you obtain CRBA and a U.S. passport for your child? Have you updated your I864 to include your new child as a household member? I see your spouse is from Morocco… she miiiight not receive her visa right after interview. Quite a few cases out of Morocco go through AP after interview. My advice: if after visa is obtained your wife has 10-20 days before 2 year anniversary. I would have her enter after 2 year anniversary. But, it is your choice… if your wife has no interest in obtaining US citizenship soon and/or petitioning other family members, or has a desire to travel outside the US frequently in the next 3-4 years going through the expensive ROC process will be a pain but not a major impediment to life in the US.- 25 replies

@heynow VJ has a fairly large user base of Filipina/US couples and they are a great resource. I suggest using a lawyer if you want a handhold during the process (but be aware that might not guard against an RFE) but questions regarding culture, civil documents, and nuances of medical through St Luke’s? VJ is the place to be… and it’s free!

CO will ask beneficiary if they’ve traveled to another country between submission of Ds260 and interview. CO will also ask if beneficiary has lived in a country for more than 6 months (other than the ones listed on DS260). I would not travel after medical. Generally medical takes 10 business days to reach consulate. Go to medical 3 weeks before interview and don’t travel during that time. As you are planning to travel before interview I suggest bringing up to date bank statements to the interview. This will show CO you have sufficient savings and have not depleted your resources due to travel. As you are planning to move to the US before your Korean spouse. If you are still in Korea when the interview takes place 1.) go to the interview with them 2.) buy YOUR ticket back to the US before interview and take that as evidence of intent to reestablish domicile. Good luck! Seoul is an easy consulate but I have a feeling domicile is a sticky issue for them… so make sure you have a lot of proof you (the USC) have a solid plan to return to the US with or without your spouse.

Especially when people don’t realize some consulting services are very country specific. What’s completely fine for one country is a red flag for the other.

so, you won’t be called for an interview anytime soon while your husband is an LPR. Last time I checked, Ghana had a significant backlog for spousal interviews so I think you should be okay either way… I would still have your husband file the I130 for your son asap. When he becomes a USC he can upgrade both petitions and hopefully by that time both cases have been approved at NVC. You can then write to the consulate to expedite your son’s interview if you are called to interview as spouse of a USC. -

He should file a separate I130 for him now. You will have to pause your application at NVC so your sons petition can catch up with yours. He doesn’t have to wait to become a USC to petition your child separately. -

I’m saying- it doesn’t matter if you file the I130 or not. No one can tell you if her previous visits to the US will impact her next stamp or not. Her relationship with you is the factor that might stop her getting another stamp. MIGHT- being the operative word. Don’t delay filing the petition only because you think that will help her get another stamp. In the case of my friends, they live together in either the spouse’s home country OR a third country (like you would live in Canada with your wife from China). -

$400 to review paperwork seems excessive. For I130- reviewer doesn’t know all your details (SSN, correct addresses, work history etc) so I would be worried they wouldn’t catch an error. I would have a family member double check the form. Then you could always write down the list of the documents you plan to submit on a post here on VisaJourney and we can tell you what’s necessary/ unnecessary or a red flag… free! Others have done it before. Here is an example of a post like that…

The IO at the tourist visa interview didn’t believe the “friend” was just a friend…. You didn’t have to lie on the I130 application about when you met. FYI: When the beneficiary goes to the upcoming interview more than likely potential questions asked will be: when did you meet? Where did you meet? When did you start dating? When did you get engaged? when did you get married? They might ask about the denied visa. Be honest and explain IO didn’t believe you had strong ties.
