  1. I received my SSN 2 weeks after I entered the U.S. I wouldn’t worry about missing the deadline of 10 days because you can’t get the DL with SSN. A good reason. I’m confused about your dates though… you applied for the SSN 20 days before you arrived on CR1? Did you apply for the number while on ESTA?
  2. My husband’s employment ended a week after my visa interview. You should be fine. But, you should identify the consulate you are interviewing at because different consulates ask different questions. And what is true for one consulate is not always true for others.
  3. It really depends on the country you're interviewing in. You will probably be fine. But, as you are the USC living overseas what plans have you made to go back to the US? As being on unemployment in the country means you should be looking for a job which contradicts your intention of moving to the US.... Your spouse on unemployment doesn't matter. It is about you and your ability to support them.
  4. Have your brother complete the I864 by himself. You currently do not live with him. This is also easier and simpler. Your household size should be you, the wife and any children you have for your I864. And yes, his wife should complete the I-864A if they file MFJ. And your brother needs to upload any W2s and 1099s with his packet (to show his income separate from his wife's).
  5. They will probably ask you basic questions about her life. And ask you basic questions about your life. Then they will ask her the same questions and see how they match. They will probably also ask you questions that related to the bonafide evidence you provided in your I130 application.
  6. The divorce proceedings have nothing to do with her ability to remain in the US. They are two separate issues. "The evidence of record shows that, when you filed your application, you were lawfully present in the United States as a nonimmigrant. Your period of authorized stay as a nonimmigrant has not yet expired. You are authorized to remain in the United States until that date (or any further extension)." Her K1 visa was valid for 90 days. Did the denial letter indicate when she was supposed to leave the country? Or did it just refer the fact she is authorized to remain in the country until her non-immigrant visa expires?
  7. I would make one file with several photos. Don’t show too many photos 1-3 photos showing you together and then with family and/or friends. max 5 photos.
  8. Most people are questioned about domicile at the interview. If CO doesn’t believe the USC is actually going to return they need to send in evidence after the interview of their plan to leave Korea. I’ve seen several cases of AP on the Naver group. My suggestion is to keep your proof and answers succinct. I told my husband to focus on 1.) the fact he left his job- he left it mid contract and his final date of work was actually AFTER the interview 2.) his application for pension. We had additional proof like housing arrangements but the CO apparently liked the way my husband answered the question so he was satisfied. I think quitting a job mid contract was what pushed it over the edge for us. I know some people have shown an old contract that ended but they had actually signed another contract with their job or with another job so… the CO didn’t like/ believe the evidence.
  9. Question is: are podcasters seen as foreign media or entertainers? If foreign media... you are only allowed to enter the US on ESTA or B1/B2 if you are conducting research or going to conferences... If entertainers... you should apply for the entertainer visa even if you are not paid for your work. So, ads or no ads if you're an entertainer you cannot travel to the US to work. It doesn't matter if you are not being paid. Have you successfully re-newed your ESTA without issue? I believe you had some concerns about working for a US company in the past without the correct paperwork. Was that resolved?
  10. We uploaded many photos at USCIS stage. Are you sure the size of the files aren't too big? Are you submitted one document/pdf or many separate photos?
  11. Ah! You still won't have an issue. When some people are petitioned for I-129F they don't have passports yet. The only time the passport is needed is when applying for the visa (DS160). Look at the DS160 form. At no time does it request "please input information of PRIOR passports".
  12. No issue with renewing your passport. You input the new passport information when you complete DS160. Take your old passport to the interview in case they want to see it. Unless they request old passport details on DS160 you don't have to provide it.

  14. Follow the UK forum for UK specific timelines about NOA2- medical- interview- receiving passport back. Then fill out your timeline and tell us the country you're moving to. This will help us give your more accurate answers.
  15. Read the thread @Mike E posted above: This is what miiiiight happen if you do not have proof of status after 90 day mark. If your marriage does not work out - and you never receive the GC then ESTA is gone forever. You won't be able to visit the US on a whim. Instead you will have to apply for a tourist visa.

What counts as fraud in divorce court (where only one party is guilty) might count as immigration fraud (by both parties)… Have you spoken to an immigration lawyer FROM THE US or a divorce lawyer FROM THE US/ Sweden…? you cannot be sure of how USCIS will read the texts and they might believe you are 1.) complicit and 2.) altered the texts in some way to hide your role in the immigration fraud plan. You have been supporting him and they might believe you agreed to give him money in exchange for a green card. make sure to consult with an immigration attorney based out of US for the best plan forward if you want to report him to USCIS. But be aware… he could easily start another relationship with someone else. nothing is stopping him from carrying out a similar plan of scamming someone for money with the promise of marriage and living together in the US… you reporting your experience to USCIS in most cases will shine a light on you and possibly prevent you from obtaining an immigration benefit in the future. e.g. if you fall in love with another American they might believe the new relationship is also not real.
  17. yes… so you have nothing to worry about. I had a friend who was denied 3 times for the tourist visa and he was able to move to the US on the spousal visa many years later…
  18. Be honest. Don’t lie. Tell them the real timeline. Consulates are very familiar with the “I’m just visiting my friend” song and dance… they don’t believe it and then you marry and move to the US on the correct visa. It’s a very common story. Don’t worry at all about the denied petition…. Just make sure to tell the truth at interview.
  19. Was the friend mentioned in the denied tourist visa application the same person the beneficiary married?
