Do you qualify for an AKA? Reviewing the documents required for it: This is more than likely for people who have two or more citizenships and do not have the name change documentation because they have one name in the US and another name in their home country. provide government issued photo ID in both names; provide two or more public documents in the full legal and “known as” names. Acceptable documents include but are not limited to: school records, tax records, military records, medical records, driver’s license, federal/state/local government ID cards, property deeds, insurance records, employment records, utility bills etc; and bring two witnesses who can attest that they have known you by both names. The two witnesses must bring valid government issued photo id with them. You may choose to bring a third public document in lieu of a witness.

File the I130 as soon as you can. The financial support documents are not needed until the I130 is approved. This takes about 12 months currently. You will only have to submit the I864 with benefits letter and tax transcripts in about 12-13 months. And you have to complete this paperwork even if you don’t qualify. it is probably prudent to obtain a joint sponsor if someone agrees to signing their own I864. Good luck on the start of your journey. Be aware it will take about 2-3 years before you spouse can join you in the US. You can see timelines for Nigeria here.

Daniel always looked like a hostage on that show. I think he finally begged off enough times so now Julia is his sidekick. He has mentioned several times the staff don’t really want to join the show.

It depends on the time of year. You are in Taiwan or China? A day or two to about 5 business days. -
If her ultimate plan was to attend the school in the US and she had the financial backing she applied for the incorrect visa. Technically, there is nothing wrong with applying for a tourist visa first. But, it is theoretically possible to CHANGE STATUS from B1/B2 to F1. She should have applied for the F1 if everything was in place and she knew which school she was going to study at. Now, it would not be guaranteed that the F1 would be granted. But from everything you’ve told me. I now think she applied for the incorrect visa. Thank you again for sharing your story. I know you feel frustrated about the outcome but know that many people. Especially, single woman with a job and an apartment in their home country get denied. And they usually have even smaller chance of receiving the visa especially if they have a friend they are visiting.

Arguing with me over the consulate’s decision isn’t going to get your friend her visa. Your friend was denied and I’ve outlined the reasons I believe she was denied. Yes, you should be honest but you shouldn’t overshare. She complicated matters by explaining her plans too far in the future with someone she hasn’t met and to a school she didn’t know if she would or wouldn’t attend. The final thing I will say is: as unfair as it is. Young unmarried women are often denied visit visas to the US. Then the next factor leading to denial is going to meet a friend they met online- before it would be more problematic if the friend was male. Now because same sex marriage is legal in the US. Going to the US to meet a female friend has a similar outcome. The student visa/ no student visa/study in the US with what visa/ placement test issue just adds to a reason for denial as it sounds like the friend wants to go to the US and live there indefinitely but with no specific plan and no financial backing. I’ve said all I can. I’m sorry the visa was denied. It does seem unfair but with her profile I don’t see things changing anytime soon.

It depends. You generally find out how long the wait will be at the interview. CO might tell you the visa should be issued in X days. What they don't include is "If all the background checks come back with no issue.) Or they might request you submit extra documentation (they want updated tax transcripts, they need another I864, they request additional evidence about the USC) which will prolong the issuance of the visa. But, sometimes you find out after the interview you have been placed in AP for non-specific reasons and this means you are in unchartered territory and might receive the visa in 2 weeks or 1 year. -
Does mom want to live in the US or just sponsor her son for a GC? Even if mom has decided it is too difficult to sponsor her son. She should still file her taxes. There is a special program that allows US citizens to back file taxes. Google "streamline filing". This means she only has to file the last 6 years and not all the years she was supposed to file taxes. Additionally, mom will have to report any bank accounts she has if the TOTAL is over $10,000. This means if she has 3 bank accounts. 1 with $3000; 1 with $4000 and 1 with $5000. She has over $10 000 in foreign bank accounts and has to inform the US. Mom's obligations to file taxes do not end once she has done this once. She needs to file taxes every single year going forward. If this is overwhelming, mom can hire a US tax accountant familiar with expat taxes. H&R Block or TurboTax consultants might not be helpful as sometimes they don't always know all the nuances of expat tax.

No… you have to either contact the UK consulate directly or email NVC to have the embassy change locations. Just indicating your partner’s present address is in the UK won’t change the location of the interview. when does your partner want to move to the US/ how long is his course? Jim sometimes has bad days where he doesn’t have time for nonsense If Hacking continues to pay attention to his marketing team the show will probably have more structure and he will be better at screening calls and passing off people to the leads team/intake. But first they need the audience to grow and make sure people realize Immigrant Home on Facebook is actually the FB group of a law firm (the amount of referrals I see to other immi firms is embarrassing) and the YouTube channel is also looking for clients- the amount of people who have lawyers calling in to the show is also pitiful. hacking doesn’t ever convince them to use his firm unless it’s for a mandamus. And they’re told they can keep their lawyers for everything else… He also needs to be better at answering questions when he doesn’t know the answer “I don’t have to do this task anymore because I hire people” doesn’t really inspire confidence. He needs to get more of his knowledgeable staff on board with the show so people can get answers on the immigration answers show but I have a feeling his staff are more concerned with working on cases as opposed to helping Sven and Mary figure out how to complete the I129F and if it really is a red flag that he is 22 and she is 63… Some days when I’m feeling less generous I think this YouTube channel was the invention of someone in the office to keep Jim happy, busy, and out of trouble… but I know he really does care about immigrants and most of his clientele appear to be happy with the work the firm does for them.

This doesn’t work with iPads.I just tried it on my tablet. it states you need to use Adobe Acrobat for Mac or Windows. You need to use a computer OR if you can only use your iPad use Adobe Fill &Sign. It is also an adobe product. -
Let me see if I understand the situation. 1. Woman in Madagascar met a woman from the US on a Facebook group about tourism. 2. They become very good friends but have not yet met in real life. 3. They decide they will meet in real life. 4. American friend offers to pay for friend in Madagascar to come to the US so she can visit and take a placement test at a local school that teaches English but she will not study in the US during that trip. Instead she will return to Madagascar complete her studies and then return to the US on a student visa at a later date. 5. American friend sends proof of financial support via pay stubs and bank statements. 6. Friend from Madagascar goes to interview. 7. Friend from Madagascar is denied the tourist visa because the interview suspects she is trying to MOVE to the US not just visit. The part in bold is why your friend was likely denied. The interview suspects the friend will remain in the US because she expressed the desire to visit the US not only as a tourist but later as a student. If your friend had kept it simple and explained she is going to the US to visit friends and study a short English course she might have been okay. But, because she also has "a friend" (who might be a romantic partner) willing to pay for her entire trip (and maybe school?) the interviewer suspects once she arrives in the US she won't leave. In addition, you can see I was confused by what was happening - was your friend planning to studying during the first visit? Is it a university? Is it a language school? The interviewer was likely also confused and thought maybe your friend chose the wrong visa. Believe it or not. Many people apply to ESL schools in the US without visiting all of them first. You stated your friend wanted to take the placement test because she didn't know what courses she will take but usually language schools are very simple- you apply to go to the school and you choose the days/hours you want to study. Then when you arrive- you take a placement test and you are assigned a level. You do not take a placement test and then return a few months later - because your language level might have improved during that time. Even if your English level has not improved they would probably make you take the placement test again because if the school is like any of the language schools I've been to... placement tests are taken at the start of the course and at the end of the course.

If you are the friend in the US -I suggest you go to Madagascar to visit your friend. Once you have met in person she can try again. Alternatively, I suggest you tell your friend in Madagascar to encourage their US friend to come visit as this might be the only way they can meet. Once they have met in person, she might be able to study in the US. But, I encourage her to pay for her own trip, too.

The school she wanted to go to- how many hours a week was she going to study? Going to the U.S. to study even for a short term program is very different to going to the US to visit friends. For example, my friend went to the US for a yoga teacher training course AND stay with some friends. She wrote both reasons on her DS160. She was also funding her own trip. Even if you think she didn’t lie the officer feels like she misrepresented her reason for going to the US. Next time she applies she should state all the reasons she wants to visit the US. She should also have a clearer idea of where she wants to study and how long the program is. Because the officer probably thought she was coming to stay and apply to study in an English school that requires a student visa.

N-400 Interview cancelled

You shouldn’t go because you withdrew the N400. So, they correctly canceled the interview. -
You should talk to people who have interviewed in Mumbai and undergone AP to understand how long most people wait. Usually after 3 months or so some people will write to the embassy, contact their congressman or senator for assistance. Then after maybe 6 months they might decide to hire a lawyer and sue for a decision. Be aware- suing doesn’t always mean the visa will be issued. Rather the consulate will have to make a decision about the visa with the information they currently have.

Do not convert these to DOC files. If you look at the PDF you will see there is a barcode at the bottom. The barcode changes as you input data. Try again with Adobe Acrobat Reader. I have been able to complete the forms with no issue. If you are having issues on your tablet use a computer. Many libraries allow you to borrow laptops and computers. -
As you are going through the DCF option, what proof did you show for exceptional circumstances? Is your job offer not sufficient? It might be a little difficult to use your husband's income because he is self-employed and usually proof of income is indicated with tax returns not monthly income. In addition, he is the beneficiary so he probably has not filed US taxes before so they do not have a way to validate his current income. The company he has a contract with- is it a UK based company or a US based company? If US based would there be a possibility of him receiving a job offer from the?

Transferring case to a different country

Will your mother be a resident there or just a tourist? You can write to the consulate to ask them to transfer the case but usually they request you send evidence the person is a resident in the country. https://travel.state.gov/content/travel/en/us-visas/immigrate/national-visa-center/immigrant-visas-processing-general-faqs.html#ivp13 If your case is at a U.S. embassy or consulate, contact the potential gaining U.S. embassy or consulate in writing to request a transfer of your case. Please include a justification for the request. If you are not a resident of that country, specify that in your request. If your petition is being processed at the National Visa Center (NVC), contact the NVC to request the transfer. NVC will transfer cases to another IV processing post if parties provide a written request along with the address in the requested country and the proof of eligibility (citizenship/legal residency in the requested country or other documentation). This can be provided at https://nvc.state.gov/inquiry. In limited circumstances, NVC may need to contact you for additional eligibility requirements. Note that transferring your case might not result in immediate processing as cases are processed in order based on the date the case became documentarily qualified. -
Both K1 and CR1 have their upsides and their downsides. Traditionally, K1 was faster but currently Last 10 K1 cases out of Brazil took between 494-620 days. Last 10 CR1/IR1 cases out of Brazil took between 481- 762 days, If you filed today for either visa your girlfriend will more than likely give birth in Brazil. Because you have a child on the way and the beneficiary is going to give birth overseas it is probably wiser to get married as that will make filing various other types of paperwork easier.
