    My husband got his greencard in Jan 2018. He is a UK citizen, I am the American. We have been in the UK since OCT 2019, we planned to return in March of 2020 but.... well we were stuck here. I had a baby in Feb 2020. We haven't been able to get her birth certified at the Embassy in London or even apply for a returning visa. The Embassy was shut and now has extremely limited appts. We didn't plan on being here this long. We want to return but aren't sure about being allowed back. Thoughts and experiences are helpful.

    Not sure if I can still report fraud but it was just brought to my attention that my husband actually confirmed how I felt that he was using me for paperwork and that someone had told him that if he had a child he would still be able legally to stay here even if he filed for divorce . I have a child that we went through several fertility treatments to conceived and  he has absolutely nothing to do w his child. Smh 

    Make sure you have proof ready if not you might end up bitting your own tongue, by then you might be held responsible as an accomplice of uscis benefits fraud.

    Thank you. I will get on this. I am not sure how long the divorce process takes, does it matter if I wait a few months before starting the divorce or does this appear fraudulent to uscis? We are the process of working out closing our joint account and changing/ breaking our lease so I’ll be sure to take evidence before that happens but I just didn’t know if waiting to officially divorce will mess anything up 

    also be ready to prove that you both lived under the same address while being married

    You have 14 months before your green card expires so you have time to file for divorce. Waiting a short time to file for divorce will be okay, I don't think USCIS will have any issue with that. But a divorce is important for you to get sooner rather than later to get your ROC approved.

     

    The thing that will make USCIS confident that your i751 waiver is valid is to provide as much evidence as you can that your marriage was in good faith. At this point collecting and saving bona fide marriage evidence between wedding and the separation is the most important thing to do.

     

    An i751 waiver application can be made at any time you don’t have to wait until 90 days before CGC expires so if you file for divorce and get the final decree long before your green card expires you can file the i751 waiver early.

    Get the divorced finalized as soon as possible and be prepared to file your ROC immediately, i was in same shoes as you my attorney advised i file asap that it takes 2yrs to get an interview and she was right i was on an extension letter after 1yrs of my GC expiration that when i got interviewed and my case was approved and i got my 10 yrs GC in the mail yesterday, P.S ; Gather as much bonafide marriage evidence and photos of places you've been and your income taxes you both did together thats the most important document the Interviewing officer would be looking out for and if you got bank accounts,car notes,house leases or mortagages together get all those documentation together and you'll be good fear not for you'll get approved, and also if you have proof of what made the marriage didn't work out you can add that to your case and build a perfect  case file for your ROC. All the best.

    Check your case status online i had my i751 interview and i was told that my case would be reviewed within 120days as soon as i got home i checked my case and it says a new card is being produced thats how i knew it was approved and 48hrs later status changed that case was approved so best bet is to check your case status online.

    Goto any SSA field office close to you and get the social security card done and your stamped visa on your wife passport can be used as an ID for now you can take that to the SOCIAL SECURITY ADMINISTRATION OFFICE don’t wait for USCIS they suck at that speaking from my experience, as for your green card it might take a while to get it mailed and timeline to delivery to you due to backlogs from USPS meanwhile the stamped visa can be use as a verification to work

    we had about a 10 minute before the interview.  Once inside the interviewer’s office he swore us in.
     

    he asked for our ids. Ask both of us our names, birthdays, and address. He then ask is to verify the signatures on the 751 were ours.  
     

    he spent a few minutes going thru out submitted packet and forms. He then ask how and when we met. Asked me, if and when I had traveled to my wife’s country. At what point we decided to marry and where we were married.   
     

    the only documents he asked for was our original marriage certificate.  
     

    he told us “all looks good and favorable”. He said to expect his decision in the mail in the next 2 to 3 weeks.  He said if he needed any further evidence he would be in touch. 
     

    last thing he asked was if we would like to add any other documents to our file. I gave him our last 2 years of tax returns and some papers from my wife’s employer showing me as beneficiary to her 401k and life insurance.  
     

    upon leaving he wished us a Merry Christmas.  
     

    super nice guy. Had a very pleasant experience.  

    Check your case status online a decision might have been made already

    File your i751 as soon as divorce is finalized the process to get Roc can take anywhere from 2-3yrs I was in same boat had my i751 interview today, and I filed early in 2019 and I just got interviewed today my conditional GC got expired Sept 2020 but I got an 18mos extension letter.
