  1. Procedures at the NVC have actually changed since July 2007 for certain countries. After the choice of agent pays the immigrant visa bill, they have to submit the immigrant visa petition (DS230) and all its supporting documents to the NVC. The NVC will then review the documents and complete the case. After the case is complete, the NVC schedules the interview for the embassy (which is actually better considering that Cairo can take months to schedule an interview) and then notifies the choice of agent with the interview date. The NVC then sends the case to the embassy and the embassy then sends out packet 4 to the beneficiary to tell them that a medical is needed and that they need to bring the medical report to the interview.

    There is a packet 3 & 4 for a K3 through Cairo, however, there is no packet 3 for a CR1/IR1, only a packet 4.

    I understand that your intentions are just to be with your wife however, wouldn't it be easier on her if you were able to work and contribute to the household right away? Waiting an extra 3 months is worth it believe me. It will put you and your wife more at ease. The point shouldn't be just being together as soon as possible, it should be to build a life together. You being able to work right away will help make this happen easier.

    Once the I-130 goes to the NVC the NVC will generate the choice of agent document and the AOS bill. You will choose your wife as your agent so she can take care of everything on your behalf. After the AOS bill will come the AOS (affidavit of support). She will fill this out and return it to the NVC. Next will come the IV bill. Once all these things are taken care of the case will be forwarded to Cairo. They will send you the packet 3 and you will gather the documents they request along with your medical exam and send them back to Cairo. Cairo will then send you an interview appt. letter. You will attend your interview and after security checks and AP (if any) you will issued your visa (God willing). If I missed a step in there please forgive me. Read the guides and James shortcuts for further information. Perhaps it would be a good idea to refer your wife to this forum. She may better understand the steps involved. At any rate the CR1 usually takes an extra 3 or so months more than the K3.

    my Lady moody all my tention is to be together anywhere but till now i did not meet her family ,about work , we dont mean to remain in usa just we need to switch between both countries whenever we want to, because it really was much for her to come to me three time in 6 months and as we are not that rich i think its really hard.

    soo after this i130 approval it will be sent to NVC so if we decided to stick with this petition so for how long(months) we need to wait farther to get the visa in hand?

    and if my wife came here she willhave to quit her job and her apartment will this affect the process too?

    What day was your I130 approved?

    Allaaaaaaaah all of thiss, thank you bodyy i released from your post that till now we are wasting ourtime thinking the embassy will contact me within the few next days

    and that we should apply these two petitions(I-130-I129) to get us together fast?

    so according to the first I130 it will take us more than 6 months to be together again? :bonk:

  3. If your case has been completed with the NVC, then the NVC will schedule an appointment for you and your wife should be getting a letter in the mail indicating when that interview is. The embassy is also supposed to send you, the beneficiary, an interview letter, however, with Cairo, don't be surprised if you never receive the letter.

    This will not be a packet 3 because you won't have to return any documents to the embassy. You have already submitted the visa application DS230 and its supporting documents to the NVC.

    The letter will indicate that you need to schedule a medical appointment to do a checkup & get immunizations.......you will need to bring that report with you to the interview.

    yes the process has been through all of this, and they sent my wife the approval mail and stated that they will send for me, but till now i did not get any news , phone call or even mail which i think its packet 3

    may you post the us embassy phone number so i can contact them to enquire if they have received anything and they cant reach my address , and thats my worry

  4. When was the I130 approved? Did the file get sent from the USCIS to the National Visa Center (NVC)? Has the case already gone through NVC processing? If so, then once the case is complete, the NVC will schedule an interview for you. If your I130 was just recently approved, then it'll be transferred to the NVC for processing and within the next few weeks you will be assigned a case number.

  5. Yes.....that's true.....and it would make sense if everyone's case was subjected to the bureacratic garbage.......but unfortunately, I don't think that's the case.

    And I too would like to think that the embassy is just "doing their job" but I find that VERY difficult to believe when they........on a continuous basis mind you..........can email people information regarding other people's cases, send passports to wrong addresses, lose original documents and ask for them again, send packet 4 letters to beneficiaries after the interview date if ever at all.

    which brings it back around to just being a bunch of bureacratic clusterfu**s, not racial profiling or singling some couples out or anything else. I dont understand why thats so hard for anyone to believe, it happens at every level of our government everyday. Our case had a HUGE problem at the EAD/AOS phase that was largely due to what I would classify as ineptitude on the part of the USCIS, all my calls were met with contradictory and often nonsensical answers and it was frustrating as hell. My husband couldnt work for almost a year and it was incredibly difficult for us both. So yes, this kind of ####### can happen at any stage of the process..

    and anyway, Havent all of us dealt with the DMV at some point? do you think its different because they are in a building overseas??

  6. I think it's a mix between religious & ethnic profiling......I know that their are many Chrisitan couples who are still in the AP he$$ hole but I definitely think that if you are Christian you'll have an easier AP out of Cairo (if any at all), unless there are other "red flags" present.

    Exactly there are many consulates with high fraud rates that do not operate like this

    Absolutely.

    Ethnic profiling ? There are lots of other consulates around the world that are considered "high fraud" -- including Mexico, the Dominican Republic, Nigeria, the Philippines, Russia and more. So which ethnicity is being profiled ?

Yeah.....and how on earth are you supposed to "prove" your relationship when they don't even give you the chance to show them any proof......in fact.....they put up big posters around the embassy telling people NOT to provide any evidence to the CO unless asked.........and of course....they never ask.

    And honestly.....I don't think it's just the age differences and whether either the beneficiary or petitioner has had previous marriages or children or whether they met online or if they didn't have a formal wedding party or if they feel that cultural differences will make the marriage difficult or or or......

    Our case doesn't have any of these so called red flags and we're still waiting and waiting and waiting.....and it REALLY sucks.

    Well the way that I have been explained as that US based processing is really just a clearing house - processing the applications, if there is a security flag that comes up than Bam your out of the pile. The real weight of the argument is in the CO/consulate's hands to prove the relationship and decide whether or not to issue the visa. How many cases have we had where the cases were denied while in the US - I can't think of one. So really I doubt that anyone even assesses the relationship at the USCIS level, the DOS checks security if that's ok then the consulates are in charge of verifying validity. I can think of cases where people have filed K1's gone back gotten married done k3's and been approved - enough proof. Or done K1 or K3 and then moved to their SO's country thus again proving the relationship.

    But how is it that they decide to prove any relationship? That's the part that makes no sense. I know you're not supposed to compare but I know of two other cases almost exactly the same as mine and one got the visa within two months and the other within five months of the interview. Ok so I'm not exactly out of the second one's timeframe but still those two cases in and of themselves show there is a big gap.

    And not for nothing and I know I'll get slammed for saying this but if the dude/dudette is not a threat to national security and if the couple is happy, how is it the US Government's duty to decide if the guy is using the girl? Dayum I wish they had done that with my US Citizen ex 'cause then he wouldn't have gotten away with what he did!!! I mean seriously, at some point isn't this good ole fashioned meddling into people's affairs?

    If my husband is not a threat to national security, yet he's duping me for all I'm worth, isn't that my problem, since I'm the one signing the form stating that I'm financially responsible for him for the next two years? How is that the US Gov'ts problem?

    And as for checking if he's already married, that is done at the courthouse in Cairo where you get married,...and of course he can have three other wives so it's more like they look to see if he has more than four. (he doesn't ...i'm just sayin' ;) )

    my wife and i are going to the embassy on october 11 for our petition interview, is there anyone going to embassy that day,or there is anyone that can give us information to help us, or is there anyone who knows the question that they will ask us,or any thing can help us.

  9. So basically, I wouldn't worry about what would happen if they turned down the CR1 & if you'd have the K3 to turn back on...........chances are that if you file the 129f, your SO would be interviewing for the K3 as the I130 would most likely be retained.

    If, however, you filed for both the I130 & the I129f and if you do not want the I130 to be retained and you wish for both petitions to be sent to the embassy abroad, then once you receive NOA2 for the I130, you'd have to file an I824 to have the I130 sent to the NVC. That transfer takes a few months by the way.

  10. It seem that I130s take longer to be approved when filed alone as compared to when filed alongside a 129f for a K3.

    However, things are different now and before, when an I130 was approved it was sent to the NVC for processing regardless of whether or not the petitioner had also filed for an 129f. If you send the 129f, and that gets approved first or if they get approved together (which is what usually happens now), the 129f will be sent to the NVC for processing and the I130 will be retained in a storage facility until the beneficiary makes it to the states and files for an adjustment of status. This change in procedures, I guess, is convenient for those who want their spouse here quicker, because the K3 would normally be the quicker route as you would not have to wait about 3 more months for NVC processing.

  11. Why does this have to be so hard? Why does my husband have to be from one of the hardest countries to immigrate from???? Why couldn't he have been from Canada or England or some place that doesn't do AR/AP or at least a consulate that freakin' gives you a straight answer about what the heck is going on???

    I feel like dragging all of us outside the embassy and grabbing big huge signs saying BRING OUR HUSBAND'S HOME!!!!!!! And marching back and forth screaming until they listen to us and see our tears and feel our pain and perhaps gain some compassion.

    Count me in.

    Today sucked big time.

    I called DOS today.....don't know why, but I did.. For 3 and 1/2 months they've been saying that checks are cleared and that there's no reason why Cairo can't issue the visa..........today the "visa specialist" asks me......"did he ever show up to his interview?"
