Canadian Child with father in USA - Child wants to move here
nastra30 replied to Incognito2025's topic in Canada
Either you or your husband can file I-130 now or even both could if you wanted. Really depends how the two of you want to proceed. However you choose to proceed, get the ball rolling right now. Good luck. -
Op, if you asking because you think the new UK ETA rules for US citizens and other visa-exempt countries also brought new rules for US LPR, then I'll say you are in luck. Currently, US LPR airside transiting through UK don't need transit visas; for now that will stay the same so I suspect you won't need a transit visa with your greencard (issued 1998+) if you won't be going through border control. Specifically for transiting through UK, GC holders have a better deal than USC ; US citizens will need ETA but GC holder wouldn't need ETA or transit visa. I guess the UK trusts that the US has throughly vetted GC holders and will share info with them regarding bad apples.

2023 case I-130
nastra30 replied to yangshang0's topic in IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports
Right. How about the question of how you obtained citizenship? Did you choose Parents or Naturalization? The answer to that will inform USCIS when you acquired citizenship. And there could potentially be a conflict between your answer and your naturalization certificate. Either ways, I think you probably have to look into WoM. -
2023 case I-130
nastra30 replied to yangshang0's topic in IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports
Ok. You got US citizenship on your own not through parent. You only got greencard through parent. So you haven't been a US citizen since age 15 but rather since age 25. I hope you didn't put in the application that you've been a US citizen since 15? I also hope you've not been claiming US citizenship since 15 before you actually become a citizen at 25. -

Do you mean certificate of citizenship? Or certificate of naturalization? -
Op, I too just like @appleblossom suspect you haven't paid the USCIS immigrant fee. Once you pay it you'll get the necessary case number to track the GC production. Almost all the time, the instruction to pay to USCIS is given by the consulate when passport is picked up; how this was missed is a little baffling but things happen. At least you now have a clear direction on how to proceed. Good luck.

documentary qualified question

Check this link and 'Current case review time' section. It might give you a rough idea. https://travel.state.gov/content/travel/en/us-visas/immigrate/nvc-timeframes.html -
Clarification
nastra30 replied to gwafuh_rn's topic in Bringing Family Members of US Citizens to America
@gwafuh_rnIf she doesn't marry, she'll have two categories in her favor both F1 and F2B, whichever comes first. Still ways away but something to be aware of. They should decide what works best for them nonetheless. -
Clarification
nastra30 replied to gwafuh_rn's topic in Bringing Family Members of US Citizens to America
Best case- she should marry her partner after coming to the US with her immigrant visa and then petition for him. Is your sister-in-law from Philippines? -
Yes Yes Yes The N400 will never get approved if the I-751 is not approved so go with spouse in case it's a combo interview. Some officers will acknowledge the existence of the I751 and approve it before continuing to the N400 interview. Some will conduct both interviews. Some will conduct just the N400 and send you home and approve the I-751 while you are gone, etc. There are many variations as to how this can go but go in prepared for a combo interview. If combo doesn't happen it's not the end of the world, the I751 will get approved soon afterwards or the interview will happen sooner. Good luck.

Pen ink color for Certificate of Naturalization
nastra30 replied to nobu's topic in US Citizenship General Discussion
There was a time before Covid they actually made you practice signing your signature at the interview on a dummy certificate before they made you sign the real naturalization certificate before you actually took the oath. Now, since covid, it's a take home to sign on your own because they don't enforce the signature signing at the interview. Blue or black, I don't think it matters. I signed my certificate pre-pandemic at the interview with black. My spouse signed at home post pandemic with blue. -
IMO, I think it's important for people to know the difference otherwise someone reading in the future could get confused. Even if same/similar languages are used the benefits being sort are different between VAWA and I-751 with extreme cruelty waiver. The VAWA act is not used to remove conditions, it's used for other benefits primarily LPR status, which you already covered. With I751 one is already a GC holder.

Will I be eligible to apply for naturalization?
nastra30 replied to Nicolaszz's topic in US Citizenship General Discussion
Within the N400 application, you'll be asked to list all trips taken outside the US in the last 5 years. Then USCIS will use that to do their own calculations. Good luck. -
This is my understanding. Since E-2 is a non immigrant visa, the US is not considered your permanent resident for social security benefits. Expectation as part of the issuance of the visa is you'll need to return to your home country since again, it's a non-immigrant visa. You can visit your local social services office to enquire. Also, it's possible there could be some state level funded disability he could qualify for so again best to visit a local social services center. I think he should be preparing to depart the US since he's no longer working E2 employer.

Please help
nastra30 replied to IneedHelp26's topic in Bringing Family Members of Permanent Residents to America
As recommended ask your friend to sign up. Though, I think I understand the situation; correct me if I'm wrong. Your friend was a derivative beneficiary on a petition filed by her grandmom for her mom. She 'presumably' was single and qualified with CSPA and successfully got her visa along with her mom. Your friend couldn't bring her own child because the petition does not allow derivative grandkids of the primary beneficiary. Your friend has to file I-130 petition for her child; a visa number will be available in about 3 years based on current visa bulletin projection. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2025/visa-bulletin-for-december-2024.html Good luck.
