If you were considered married during the tax year, you can't file as Single or as Head of Household as both of those filing statuses are for people who were considered unmarried for the tax year. (Source: https://www.irs.gov/newsroom/determining-your-correct-filing-status)

If your spouse doesn't have a SSN/ITIN, then you would select Married Filing Separately as your filing status and you have to paper file your return. This is because electronic filing platforms won't allow you to leave the spouse SSN/ITIN blank, but a paper form will. I don't know if it's strictly necessary, but I also attached an explanatory statement to my return when I filed noting that my husband is not subject to US taxes and doesn't have a SSN or ITIN and the return was accepted with no issue.

Now I’m confused 😐 bit stressed about it as I would need my tax transcript soon to submit to NVC.  One IRS rep told me in order to choose that and to be accepted, I need to first use W7 form to request for ITIN for my spouse in order for him to receive a number and then be included if I want to choose option married filing separately.  Without a number he can’t be added.  They sent the whole amended back to me😔and the rep said the W7 can take up to 7weeks.

I’m going to try to write my spouse name on their missing info request and for his SSN states “ unavailable “ and see what they will say (cause when I called they give me hard time and won’t accept it).  They keep recommending that I choose head of household

    Hi there and welcome!

I’ve received a case number after 9 weeks.

Some embassies recently changed from mailing processing to electronic processing so best thing to do to be completely sure is to call and ask about your Embassy method on how to submit documents.

I’ve got a Case Completed in 9 business days.

Its been a week i’ve since I received CC and I’m currently waiting for an interview date -i will get one accordingly to available slots from my chosen Embassy. So check with other VJ members how long it’ll take to get one in Haiti

Good luck to you and call to find out :)

    Thanks Valentina

  3. Hello everyone!

Recently started to follow this thread... I apologize ahead if my following questions have already been asked and answered.

So..., NVC received my case on 8/7/18; since called them twice already, one rep said wait up to 8 weeks, the second one said up to 6 weeks.  However, from  a few posts, I noticed cases are being assigned bet 3-6 weeks in reality...and not much one can do aside from keep calling and waiting until it’s received.

Nevertheless, I still have a few questions :

How do you know if you will be electronic processing? Which countries are eligible (how do you find out) ? Once fees are paid and docs submitted, how long for NVC to review and complete case? How much longer ‘til an interview?

  4. God is sooooooo faithful !!! GLORYYY !!!

    we got APPROVED 🙌🏾🙌🏾🙌🏾🤸🏾‍♂️🤸🏾‍♀️🤸🏾‍♂️🙏🏾

anyone still waiting PLEASE PLEASE PLEASE (I know it’s easier said than done) took us exactly 7 months of wait..., but let me tell you when you see those words “we approved you case” the wait, the frustration, the cry, the lonely days/nights suddenly all worthed.  I compare it like when I was in labor the excruciating pain all gone when I saw my baby’s face...

Nevertheless, renew your strength and wait for GOD to do it !!! He will do it !!!

He will not forget nor leave you through this time!

STAND STILL and wait for GOD to do it!!!

    Same here!

Mine says it was last updated in March 2018.

We tried calling USCIS but since my husband is living with me in my homecountry it was very hard to get transferred to a TIER 2 officer and after the 4 time calling and spending almost 75 bucks on it, we gave up calling and are now just waiting and hoping our NOA2 will arrive here soon!

It is a bit frustrating... I called today and all she said she can tell me is that yes they received it and I’m still within processing time 7-9 months so wait...
