  1. Ok friends received my NOID today in the mail, I'm very surprised but all what apparently was missing was my divorce decree. So I mailed the original with the seal stamped so they know it's the real deal. Now just have to wait for a response. Hopefully not to long. Something simple I thought would of been a RFE but I guess it's changing. Will keep you all posted on time frame to get a response back from them...

Please let us know how this goes, and I hope all goes well for you in this. I may be in the same situation as you are, in the not so distant future. This is a hard road to travel, but love is worth it, right? Otherwise, we wouldn't do it, but that 4 letter word compels us. It's both husband and wife that have to sacrifice and struggle with the wait. Once it's all done and she's here though, it'll ll be worth the wait. I'm sure you'll agree.

I didn't receive the notice yet but I did call the USCIS and talked to a tier 2 person. He said it's definitely a NOID and 95% of the time it's a request for more proof of my marriage. I ask why not a RFE first. He said it's up to the person reviewing your case. So I'm hoping that's what it's is. I went ahead and gathered up some more documents. And definitely sending in pictures of my wedding. I really don't know what happened. I'm hoping that's all what it is. Good luck to you. It's a rough long ride...

It sounds like you’ve become the “victim” of this new provision within the guidelines that permits USCIS to reject an incomplete petition without an RFE. There was a K-1 petition here recently that went the same way - they had forgotten to include the statement of intent to marry and boom! Denied!

So it could be a missing signature, a missing or incomplete document...

Or they have found something that makes you ineligible to petition your wife. Unlikely to be based on criminal record as such denials take a long time and are usually handled by Vermont before being denied. Also nothing you have mentioned suggests that you are ineligible on that basis.

Are you rekated other other than by marriage? For example, are you cousins living in a state that does not permit marriage between cousins? How old was your wife when you met her? I remember a rejected petition a few years ago where the beneficiary was a minor when they met and the petitioner was considerably older (completely different scenario to meeting as 15-year-old exchange students, for example - the so-called “Romeo and Juliet” rule). If I recall that case correctly the beneficiary was 16 and the petitioner was over 40 when they met.

I'm a United States citizen and I'm 13 years older then my wife. My wife is her home country waiting....

Your first problem is using Rapid Visa. They about screwed up my application and I was left scrambling to collect information for USCIS and finishing it myself.  You should get the letter soon and they will tell you want you need to submit. They are not denying you they are warning you at this point.

I'm hoping for the letter today...

Rapid Visa just puts your papers in a nice order and sends it off while charging you a ridiculous amount. Have you ever been arrested? When was the last time you've seen your wife in person? What kind of "proofs" of marriage did you send in?

I seen my wife 4 times in the past year just got back from a month stay in October. I even have a house where my wife is from where she lives at now.

It definitely should be related to some missing information in forms ,with missing proof of marriage they dont send NOID instead they send RFE to request additional documents. It definitely have to do with some missing information in form and i am totally agree with you ,its better to fill by urself instead using these services such as rapidvisa.

Yes I'm doing this by myself this time.i don't want rapid visa involved. Complete waste....
