    He can not adjust his status when he's outside US. But if he plans to arrive on some other visa, you guys should file I-485 and I-864. He can also file I-765 and I-131 if he will want to work and travel outside the country.

    Yes, that is why we applied for it ASAP. And what's more - we filled with attorney's help and even he was surprised seeing such a jump in "Dates for filling" and first wanted to make sure it's not some random error.

    So with that being said - even if "Final Action" would become current in July, that doesn't change much for people who already started the process regarding getting a green card earlier if I-130 and I485 are still pending. Especially when processing time of I-130 for F2A sent to California Service Center is approx. 19-25 months...

    In that sense, that would mean that there will be visas  available  for everybody under the F2A category? That is too much good to be true, we will have to wait and see.

     

    Anyways, I just applied under the dates for filling. Since those are the only ones as of today published under June2019 Bulleting.

    Me (LPR) and my husband (H1B) are in the same boat. We've sent his I-485, I-765 and I-131 yesterday. 

    But I just found out Mr. Oppenheim's predictions and actually I am not sure if that changes anything for us? We submitted I-130 in October 2018 so it is still pending. 

    So I think (please correct me if I'm wrong) he'll not get his green card until his I-130 gets accepted, which is still probably a year or more from now.

    - National Benefits Center,

    - Nebraska Service Center,

    - Texas Service Center,

    - Vermont Service Center... 

    ... while (in my understanding) the majority of the users on this forum have their I-765 petitions processed by National Benefits Center. I thought that the address of the petitioner matters, but apparently that's not true. Anyway - we're seeing our attorney in June and I'll ask.

    Yes I know that. But in said California, they also process EAD "Based on a pending I-485 adjustment application [(c)(9)] - exactly the same like in National Benefits Center. That's why I asked.

    I don't know yet, because I'll be able to apply for my husband's AOS starting from June (according to visa bulletin). Our I-130 went for processing to California and we live near Detroit. So I was just hoping that EAD/AP will also be processed in California.

    I was just hoping - since our I-130 went to California for processing, and we live near Detroit - that EAD/AP will also be processed by California's office. They have waiting time of only 3 months.

    This drastic change will probably positively affect my husband's case. He's in US on his H1B and our priority date is in October 2018.

    We're just waiting for information whether USCIS will allow using "Dates for Filling" for Adjustment of Status in June 2019. I pray they will - we would be set!

    I couldn't find that information anywhere, so I have a question regarding the summary (overall) time which will probably pass from filling a I-130 petition for a husband (who lives in USA on non-immigrant visa) while being LPR until him receiving his green card.

    I am aware that there's visa bulletin and for now it's 1 year 11 months of waiting time only to got a free spot.

    But what I am asking is th OVERALL time. So does it mean that after 1 year 11 months he will get his green card in his hands, or does it mean that after that time he could START his journey with USCIC, waiting for interview etc? Or this time can "contain" that other stages (security screening etc) ALREADY in it?

    I'm asking because I was an immediate relative of US Citizen and STILL the whole process for me to get a green card took about the whole year (USCIS stage, then NVC stage, etc).

    Attorneys only gives "official answers", not very helpful. I feel this forum and people like you are more helpful for giving out real-life experience. Only problem with this forum is too much information in there, hard to dig out.

    Yup that’s right.

    But even the information you’ll dig out can be useless in your case, because it’s really hard to tell how long will one certain case take. It can only give you an estimated timeline. Which is VERY frustrating, because there are our lives and our families at stake.

    My understanding is that paper is slower than electronic submission, since the documents need to be shipped to the embassy, maybe in quarantine for a period of time. I heard it is 2 months for paper submission versus 1 month for electronic submission after CC to get back from NVC for IV date which is one month ahead of time. It is hard to dig out information online about the how long it takes, I am not sure about my information. Please shed some light on it, with regard to whether my information is about correct. My embassy is Guangzhou, China.

    I am not an immigration attorney so the information I have may not be 100% legit, but since what I read here, what people were sharing about their cases, I would say that: pivot/non-pivot is faster/slower - it’s not a rule at all.

    It really depends on a certain case and then on a backlog at the embassy.

     

    Logically, I would say just like you, that electronic documents move faster than papers by regular mail, but it’s not really a rule here.

    Yup, even July is still possible!!!! 

    My CC was 06/12/2018, only a day earlier than yours, and yesterday NVC mailed me my interview date: 07/25/2018.

    Sure, I will!

    But I'm just quite different visa category.

    It's still Family-based (I'm IB1, so it's self-petitioning after my mother's WAVA case), but on the NVC stage timeline is the same as for IR1/CR1 (8 weeks for getting a case number, then 6 weeks for review the documents etc.)
