    Términos y definiciones de violencia doméstica
    El Departamento de Justicia de los EE. UU. Define el término general, violencia doméstica como "un patrón de comportamiento abusivo en cualquier relación que utiliza un socio para obtener o mantener el poder y el control sobre otro compañero íntimo". El Departamento de Justicia continúa señalando que la violencia doméstica "incluye cualquier comportamiento que intimide, manipule, humille, aísle, atemorice, aterrorice, coaccione, amenace, culpe, hiera, hiera o hiera a alguien".
    El Departamento de Justicia define los tipos de violencia doméstica como sigue:
    Abuso físico: Golpear, abofetear, empujar, agarrar, pellizcar, morder, tirar del pelo, etc. Abuso sexual: Coaccionar o intentar forzar cualquier contacto sexual de comportamiento sin consentimiento. Esto incluye, pero no se limita a, violación en el matrimonio, forzar el sexo después de que ha ocurrido la violencia, o tratar a uno de una manera sexualmente degradante.     Hello TexasVAWA, it is better that Sandra or some other collaborator with more experience orient you better, that being said, I can give you my opinion about your situation:
    It happened to me similar to you, initially my Vawa was not sent with a psychological evaluation, it was sent with a letter from a therapist that expressed my diagnosis and expressed the reasons why I had reached that psychological state, after this, by recommendation of some collaborators, including Sandra, I decided to send a DETAILED psychological evaluation; this evaluation must explain not only your diagnosis, but also the reasons why the therapist comes to the conclusion of why you enter into the legal classification of a person who has suffered some type of disorder that qualifies him for Vawa, he must present the results of the different psychological tests to which you were subjected that yielded those results.
    It is likely that, if your file was received by USCIS before September 11, approximately one month later you will receive an RFE requesting evidence of abuse and then you may submit such psychological evaluation.
    I understand your concern about the date of receipt of your file by USCIS, I have the same question, I sent the response to my RFE on September 10 and I got an email saying that they received it on September 25, I hope that someone can clarify the reason for this.
    Please consider my opinion taking into account that I am not an expert and that this information must be confirmed by a more experienced collaborator.

    It typically takes 4-6 weeks to receive the receipt notice. You can however follow the post office’s tracking number you received  when you sent the forms to see when they received it. That will be your receipt date.

    This girl who lived with her husband for 24hours she works at a Law office and the attorney told her that USCIS would NOT approve her VAWA petition at all, and the attorney declined to file her VAWA petition. I filed her VAWA petition and she was approved.

    Getting married before your VAWA based I-485  is approved may make things tricky and subject the applicant to scrutiny, but after already becoming a LPR your path to citizenship isn't necessarily affected by whether you remarry or not.

    You can get married whenever you want to after I-360 approval. It will not have any effects on citizenship. You can file for citizenship after 3 years (instead of 5).

    If USCIS receives a response to an RFE within the deadline and the evidence provided is sufficient, the petition will be approved. If the evidence is insufficient (even if it was submitted on time), they will either ask for a 2nd RFE or send a Notice of Intent to Deny (NOID). 
     
    The new rule is ONLY for I-360 receipt dates AFTER the new rule kicks in.

    In case VAWA is not reauthorized the cases pending will be adjudicated, but then they will not receive new petitions.I am sure 100%  they wil reauthorize.

    Low cost health  insurance  does not count as a public benefit.  Vawa applicants are not subject to public charge ok.

    Hello everyone,
    Please help me understand what they say, in case the congress does not sign the Vawa law again:
    I ask:
    1. People who have a Vawa case pending approval, if necessary, will USCIS send you an RFE or will you simply be denied the case because the Vawa law would no longer be active in the congress at that time?
     
    My question is given by the fact that they are suggesting that they send the complete case, implying that if the Congress does not sign the Vawa law again, then USCIS will not send new requests for RFE.
     
    Please clarify!

    I’m getting ready to file N-400 based on VAWA and I certainly will be applying for a fee waiver.
     
     I can apply 3 months to my 3 years of residency. October is the best month to file  so I’ll be filing next month.
     
    i need to make sure my taxes owed are resolved to avoid any issues.
     
    It is already approved in the name of Jesus Christ.

    Good morning everyone! I had my I-485 interview this morning and I just wanted to share my experience.
     
    My appointment was at 9:45am. I was seated in the lobby by 9:40 and had to wait a bit. I was called in at 10:30am.The interview had me swear to tell the truth then he took my picture and finger prints.
    After that he asked me my name, address, and date of birth. He went down a few questions asking if I had any criminal history. He asked me if I have ever worked illegally and where(yes). He asked if I have claimed to be a US citizen or voted in a federal election(no). He asked me where I went to school, and where I work currently. He asked for my updated medical.
    He told me he had 30days to make a decision but that he would probably make it sooner. He said he would review my file, and if they needed anything else he would send a notice otherwise he would send a notice with a decision. He said he could not tell me at this time what that decision would be. Honestly he was very nice, friendly and curteous.
     
    I left the office at 10:45am. I drove home and had something to eat. At 12pm I got notification by email and text that my new card is being produced!!!!! Honestly I could not believe it!!!! After all this long wait and suffering God has done it as He has always done, this never-failing God.
    I am so grateful to God for everyone on this forum, your help, encouragement, insight and friendship. May God bless you all and help you along on your journeys. I pray for better and safe relationships for all of us as we continue along and rebuild our lives.

    Hi Guys, 
    My interview is this coming Tuesday at 8am. In my letter, I was asked to take along two ADIT style photos (only if not previously submitted). I still went and got them taken.
    Did anyone get the same request in their interview letter?
     
    I was also asked to take documentation proving employment, length of tenure and hours worked each week. 
     
    Other documents l requested:
    •I-94
    •Passport (if your passport is in your maiden name, please take your divorce decree and marriage certificate).
    •Medical exam  (if not previously submitted. Still attend interview if you haven’t gotten it done.) 
    I did mine early 2017, so I got another done, just in case they say it has expired. 
     
    Also, is there anyone who just had an interview? How did it go? Did you attend with or without a lawyer? Did they ask about the abuse?
     
    I am doing my best to be positive, but I can’t help feeling a bit nervous. Please keep me in your prayers.

    @Florecita_Bella and @Kleenex12 there is a separate entry for the passport number they are not the same. If you don't have other travel documents  leave it blank. I did not put anything for travel doc when I applied.

    MY CASE WAS APPROVED TODAY!!!!!! I'm so happy!!!
    On august 28th I received an email that my card was on production under my I-360. Because of the other VJ members that received this email before their approval I was in hope that this would be the case for me too. However, I still didn't want to believe it or celebrate it. I wanted to see the word APPROVED. This process was so painful and difficult that I wanted to be sure before putting my hopes up. Receiving this email means the world to me. I cant contain the joy.. I'm at work right now and went to the bathroom so y could jump, scream, cry. 
     
    For all of you still waiting, please be patient. It is hard. I know. But this day will come for all of you. I promise. Have faith!! If there is anything I can help any of you in this process please let me know. 
     
    May god bless you all and guide you throught this journey.
     
    My timeline:
    May 15th 2017: I-360 Receipt Date
    June 9th 2017: 1st Prima Facie
    March 14th 2017: I-485 Interview This was for the case my ex husband had filed for me. I went to the interview by my self as asked the immigration officer to hold this case until VAWA approval.
    December 11th 2017: 2nd Prima Facie
    June 7th 2018: 3rd Prima Facie
    June 1st 2018: EAD (C9) Receipt Date
    I didn't have a bio-metric apportionment for this EAD because they used my old ones. 
    July 19th 2018: EAD (C9) in hand
    August 28th 2018: Card under production for form I-360
    September 5th 2018: Card was mailed to me for form I-360
    September 6th 2018: Your case was approved.
    *No RFE's
     
    What I sent:
    My personal affidavit which was 16 pages long. I explained everything into deep detail from romance to abuse.  
    Police Report stating that I had visible injuries and describing the whole incident
    2 Restringing Orders (1 from family court, 1 from criminal court)
    2 psychological evaluations 
    Letter from the shelter where I stayed
    Copy of our joint credit cards
    Pictures just of our wedding
    I was concerned about proving we lived together because we didn't have any joint bank account just a credit card account, no insurance, no bills, we lived with his parents so we didn't pay rent. In his declaration to the police he stated that he lived with me at his parents so I guess this also helped.

    1.) I sent mine to VSC.
    2.) They usually send RFE to give the chance to correct your errors. But proofread at least 10x times so u can save time.

    You need to submit police clearance from every place you lived at for 6+ months in the 3 years prior to filing I-360. 
    If you filed VAWA in January 2018, you need to submit clearance from every place starting January 2015. 
    Google Live Scan locations + state you live in to see where you can go to get your fingerprints taken electronically. Some police stations do it and then there are many other places that are certified live scan locations. They will then submit your electronic fingerprints to the state department and within a few weeks you will receive a letter that either states that you have not committed any crimes or a list of your crimes. 
     
    Every country calls this police clearance process something else. I just googled it. I had to submit it for the US and 3 other countries. All of the processes were different but there will be a website if you google police clearance + your country that will explain what to do.

    I was just about to write my timeline yesterday about my new combo card on delivery (my 3rd so far since marriage in 2016),  when sms and email alert said my 360 approved! I was shouting with joy and laughter in my room like I was crazy. Crying and laughing and kept looking on my online update if it was real and kept refreshing my browser. Oh God, Praise Be the Lord Almighty! I couldn't contain my happiness. Couldn't sink in into my system.
     
    All the hardwork have paid off. No RFE. 4 prima facie's since March 2017.  I feel vindicated from the false accusations of my ex. I am so much humbled by the graces of God.
     
    This journey transformed my life because so many good hearted people out there, most of them strangers are willing to help. God sent them to me to guide me in the right direction. I am giving my best to do the same.
     
    May this inspire everyone here who are waiting for their approval. As I was also inspired and this forum helped me a lot in gathering materials for my vawa journey. Thank you also to Sandra who keeps helping.

    Sounds good, more hope for some of us still waiting. Please I'd suggest you go in with a new medical if you can. They might ask for new one since the old one from September 2016 will be out of date.
