For anyone interested wanted to let you know that I did receive a text message at 5:34am CST and an email at 5:35amCST from USCIS for our RFE

The tier 2 officer Garcia told me last night they can not fax my RFE to me because it has already been mailed, he stated to never hesitate to contact them because they have the most up to date information and the website is ran by 3rd party vendor that does not always update as we all know this too well..... he stated general reasons for RFE and then I said; “so what is the documentation missing or needed for our RFE?” and he said I need to supply proof of meeting within last two years, if I had recent trip after filing petition that’s even better, and that I have until 11-5-18 to respond; however; we know I will be on that like white on rice 😜😜😜

the officer also again stressed the importance of calling and following up and not to hesitate to call.... once I get the hard copy of RFE I of course will post for everyone’s knowledge.

The one thing he also told me was that on the uscis website there is a link to upload/download my documents online for the RFE but I do not see that link at all...anyone know of this or heard of this????

Praying for all of us and continuing to send tons of hugs and positive vibes to my “special” friends you all know who you are♥️😘😘♥️

we also found RFE from uscis ...and we are waiting for the hard copy by mail..how long will it take ??

Because I am a multiple filer, I had to submit a letter requesting a waiver to the multiple filer rule and explained the circumstances surrounding the prior k1 petition.  This is not a suggestion, a waiver request is mandatory .  Search the forums you will see.   If I were the petitioner I would prepare the waiver request now and either send it in to marry up with the petition or have it ready for the RFE

can we send it now wzout getting RFE ??

they may request the waiver since it was a petition within a 2 year window - regardless of visa issued or not. I just got an RFE for my previous K1 in 2016. Even though we were originally approved at USCIS in 2016, there was no issue of a visa (was denied). My new petition with my new partner prompted an RFE for a waiver. Be prepared....it's fairly easy to put together. They just need to know dates and details of the last petition/relationship and why it didn't work out and any supporting documents to show.

am just worried about the time of delay since we didnt even got noa2 ...

  5. MY FIANCEE divorced five years ago . he filed a k1petition  in the middle of 2016 and cancelled it before the interview stage ...no visa was issued

In the new petition he informed them that he previously filed one before and mentioned detailes ...is this will affect our petition as we hit 200without replay ?? will they request RFE ??  what about the waiver multiple filer  requests ??

If your fiancé submitted another k1 within the last 2 years he needs to include a multiple filer waiver with his current petition.  If it is not included there will be an RFE

but they didnt request this form in the petition they only asked to mention if he filled this petition before and give details ..It was cancelled by my fiance just before interview and the visa wasnt issued ...

As noted, assuming they won't find out or know is totally wrong way to think about this. Even say they didn't find out for 3-4 years until you applied for ROC or even citizenship, if they find out then they can strip you of everything because of that lie and fraudulent claim. Why risk it? Just get the K-1 visa, come to the US, marry, apply for AOS. Get AP or green card then go back home and do a ceremony there for your family; but don't even risk your journey by doing it before hand.

I will do so .. we will organize religious wedding cermony  aday after the civil wedding in boston

Search "Ceremony Wedding" in the VJ search engine. While most couples get tripped up on this prior to the K1 interview and are denied, if a couple is married religiously, then entering the US on a K1 could be essentially considered fraud.  This may not be determined at the border, but could come up at the AOS interview stage.

what is the AOS INTERVIEW STAGE
