  1. My spouse has visited the hospital in person, provided the letter and was told that they will contact him for the appointment. He has received 1 appointment as stated. He just went in person last week to Andrews. In my attempts, to call I have yet to speak to someone. Please share which specific contact number and maybe the timeframe (if you can recall) that allowed you to reach someone. Thank you for your sharing your experience.

    Any advice on how to get things moving. We had a 1 year ban due to marijuana (admitting to past use). Visa processing was scheduled to resume June/21. Hospital contacted spouse for 1st drug test in October/21. No communication has been received since then. I have made contact to the Embassy (responses redirect to hospital), contact made to hospital with no responses, spouse has went in person to explain situation and nothing.

    Any advice ?

Under the Immigration Violation section, the question  summarized asked if you ever sought to obtain a visa by fraud or misrepresentation...yes or no with space for explanation.  This is the situation-Beneficiary was removed from USA at entry from airport, during interview it was discussed about his security. Visa application was completed by employer, visa approved at interview and no questions were asked about his background. However, from the airport denial this resulted in a 5 yr ban and visa revoked. Beneficiary was not charged with misrepresentation however it was stated he was inadmissible due to inconsistent statements and not enough funds. 235(b)1.....212a (7)(A)(i)(I)

    Transcript discusses this issue-Employer completed visa. Consular office in JA did not ask about background. Beneficiary incorrectly assumed that background questions were related to Cayman Island (where he lived) and not JA. Final determination did not include being charged with misrep at determination of inadmissibility/removal proceedings at airport.
     

    Should this question be answered with Yes and brief explanation  as provided here or any other thoughts

I think they will also request an interview from me, but I’m okay with that, I have everything including all the paperwork from when they expedited him at the airport.     Yes, I  had  to just wait per my situation. The process was moving along despite our delays and issues. I received notification and the wording of the message suggested exactly what it was-a NOID. I already responded and submitted additional information and was approved today, per text/email notification. I am not sure but in my case a NOID was issued instead of an RFE. I successfully did the rebuttal. If you are contacted for an interview, they can approve it that day (from my understanding).

    Nope, there is no reason for Congress to get involved with my situation.

    I had a work visa, a student visa and plenty of ESTA travel for yours before my husband and I decided to apply for the Immigrant visa.

     

    However, I am from a low-fraud country but not sure if that makes any difference. No matter what, I wish you all the best and good luck for your interview.

    Perhaps there is an assumption he may be "visa shopping", depending on variables (ie. timeline of each visa/details of any issues with the work one), and might explain why they are already questioning the validity of the marriage at this stage?

     

     

    "Visa shopping" I can agree with you on this point about those assumptions. FyI..there was considerable time in between those.

    Definitely will follow up with the intent of the interview. That comment was a thinking aloud moment.  As stated spouse was removed prior, had a tourist vis...also work permit/visa that I knew about but didn't share because to my knowledge no adverse affect occured from it. 

    However, I am in the process of getting all of HIS documents to examine them for discrepancies in my 130 and all his "stuff."  I have to keep remembering that common sense isn't so common and mindsets are not shared....

    If that is correct was he ordered removed?  If so he has a ban for a period of time, at least 5 years. 

    If he HAD a visa and it was revoked or cancelled when he tried to arrive in usa there will me some numbers written in his passport. what are they? for example, 212) (a)(7)…. 

    Hello, it was before the relationship and yes. 212(a) (7) (i) (I) ...you do not have sufficient funds to support yourself while in the United States. Therefore you can not overcome presumption of an intended immigrant.

    Yes the distrust part is for another day and forum, I suppose. I have a distrusting spirit about EVERYTHING AND PEOPLE (lol!) If you can message me your thought, that would be fine. I probably don't need another thought to execute in my min (ha)

    Nothing to worry about he has to get an interview why not you.

    Take your evidence and be ready for anything.

    The tourist visa he applied for I would ask him everything about it.  Who was he to visit? Did he claim he was single, married?  You need to know everything now.

    That is heavy on my heart as well. I figured I asked all the "right" questions during this courtship from day 1. Ignorance shouldn't be an excuse on my part, especially this late in the game. Yes, I definitely will follow up.

  15. Okay so you guys are confirming that the interview clearly speaks to me. Now I'm still concerned about the why behind it and acquiring his original passport and birth certificate for this appointment by the 25th. I have a photocopy of beneficiary birth certificate   that I submitted with the application even though it wasn't required.
