  1. Hello,

I really am not sure on what Direction to go. My wifes mom passed away and her 18 yr old sister is over there. I was curious about requirements for me to get her here either by tourist visa so they can reunite for a time (and to experience the USA). Or how to petition her for perhaps, permanent residentry.

please shoot with the best information or ideas you have.

    thanks!

  2. Hello,

So what about your Wife and child who are in the middle of AOS and awaiting biometrics on said child. They both don't have SSN's, when filing it states I cannot claim my wife and child as dependents? Im mostly asking a question for someone who has experienced what I am experiencing now. How and why would my child, at the least, not be able to be claimed as a dependent? (they both got here in March 2019).

Failure to apply for the SSN is the underlying issue and as many have said you don't need a SSN to get insurance. You might have to do it by phone (that's what I had to do) then update once the SSN is here.

Im contacting my HR at my new workplace. I did not realize that I had ‘70-90’ days to apply for an ssn. So much to do and remember with this process. Are you saying contact your organization or contact the organizations insurance provider?

What you need to do is understand that she doesn't need a SSN to get insurance.

Contact he insurance company and/or employer and press the issue. Escalate. Insist.  Ask to talk to someone else until you talk to someone who knows what they are doing.

Alright I will give it a shot, I will escalate it.

SSN is not a requirement in either obtaining or maintaining health insurance by law.

What about Dental? Im going to check the marketplace for health. Cause from what ive gathered from my 26yrs in this nation and anywhere really, as a civilization we don’t recognize dental as healthcare so to speak.

Good that she filed the I-765, should have that long before the green card .. and that allows you to get the SSN.

You only have 76 days from POE to apply for the SSN (up until two weeks before the I-94 expires), for now you will have to wait on the EAD card.

That’s literally retarded (excuse my language). I appreciate your response and responses for answering my questions so quick. So when it comes to root canals, I just have to eat the cost so to speak. That’s great, our government is the best for a reason. Truly remarkable.

You do not need a SSN to obtain health insurance, I’m sorry you haven’t sought advice on this sooner. If it is open enrollment for your employer get her covered now! Otherwise you’d have to buy through the exchange.

Yeah I know, I kind of did through FAQ’s and stuff to no avail. Me being fed up with it got me to post today. Im a new hire at a new job so its a qualifying event, im going to call them.

You have not filed for AOS (I-485) yet?  When you file the I-485 also file the I-765 (Employment Authorization) this is free to file when included with the I-485, you should get the EAD card in 4-6 months (with a little luck) with that card you can then get the SS card.

As for unique numbers, you wife has one .. it is her Alien Number  ;)

As many already noted, you don't need an SSN for the health insurance.

We have filed for AOS, ill have to ask if she did that or not. As for Obamacare, I can file for that now but have specified on my new employment forms already that we aren’t on government healthcare(im starting my new job on December 2nd). Im going to call my employer and talk about it today. As for healthcare, it’s not a debilitating illness she has now or anything (though I want to get her in for checkups etc). Right now she is dealing with needing a Root Canal with a crown $$$. They have Dental at my new job, but once again; no SSN no Insurance.

Do you guys see my problem or is it still clear cut on what I need to do? Should I call the SSN office or? Idk this just sucks.

edit: just asked her, and she filed it with her AOS. I believe we sent it in around september, our daughters packet had an RFE which has since been sent back and the process continues. This really sucks.

  8. Wife entered the US in March. We got married in May, didn’t apply for SSN two weeks after arrival. Now we are entering December without her having an SSN which means no insurance going on 9 months. While she needs to see some doctors, to me it seems asinine that immigrants who are married to a citizen are unable to have an SSN until the reception of their green card.

Unless there is another way to get it, which is my question for this topic. I would love to put her on my insurance at work which isn’t possible without an SSN. If there is no other way, then why not? Shouldn’t the government want to know who is here by assigning them a unique identification number? Especially when all signals point to that person becoming a US citizen.

    Thank you.

  9. Thank you everyone. We reviewed the packet and there was a lot of typo. We just got a NOA1 for her in the mail for the packet that we resubmitted for her.

  10. Hello,

After many months of enjoying my Wife finally being here, I am yet returning to Visa Journey to ask a question or seek reference lol (she's been on my account as of recent). Anyways, our Daughters packet we sent in came back along with the check because I suppose something was wrong with it. So my question is, last time I enjoyed the guide that both Hank and Greenbaum put together to get us through the K1 visa process. So I am wondering if there is an as detailed checklist such as those, that outlines this step in the process with such detail.

    Thanks!

You need to follow the three AOS Guides for K1/K3 Visa holders, the K1 Tip Guide, and the K2 Tip Guide:

    https://www.visajourney.com/content/k1k3aos/

    https://www.visajourney.com/content/k1aos/

    https://www.visajourney.com/content/k2-visa-adjustment-of-status-tips/

Did you follow the K2 Tip Guide? That one throws off a lot of folks. As you found out the hard way, there are some specific differences with between the K1 and K2 AOS packets. I hope that you followed the general forum advice and concurrently filed for AOS/EAD/AP for the K1 and K2 applicants. Check the Special Instructions tab on this USCIS Form I-485 link for more information on that topic: https://www.uscis.gov/i-485

You don't have a lot of time, you will need to have the revised K2 packet submitted using the old forms with a postmark on, or before Oct. 14, 2019. The new AOS forms become required for any AOS applications after Oct. 15, 2019,

I made a separate check for her. Does that mean when I resubmit the documents we have to pay the full price for her now?

The notice stated that we have to resubmit her papers because it was improperly filed.

  12. Hi Guys!

This is Eli's wife. I just sent our packets for aos and got back my daughters documents and they are requesting for her to resubmit her paper. I am wondering if since my papers got accepted and hers needs to resubmit. Would my case be pending until I resubmit my K2's document?

I don't know what went wrong. I just made the same documents with mine for my daughters.

Can anyone please walk us through on how to do the K2 packet.

It's always recommended to file for both EAD and AP. But the choice is yours. Both the EAD and AP are free to file with your AOS. I am not 100 percent on if you need AOS for the K2, but I believe you do. I'm sure someone will answer the K2 question, but trust me, apply for both. Or just search the forums here for people who didn't apply for both, some bad stories that could have been easily avoided.

Okay. Yeah its better to have it ready just in case. Thanks a lot.

You can't really predict what might happen between now and when you get your GC; it's quite possible something will come up that you'd like to leave the country for but USCIS does not consider sufficient grounds for emergency AP. So it's strongly recommended that you apply for it.

You don't have to, though, and EAD is still free if you apply for EAD but not AP with AOS.

A K2 does need her (or his) own AOS (and if you want to get an SSN for your stepdaughter before her GC -- which you  probably do -- then you should apply for an EAD for her even if she's too young to get a work permit in your state; her EAD and/or AP is also free).

    Thanks a lot.

You can, AOS is separate from EAD and AP. If you only apply for EAD, you only get an EAD card, not a combo card. Best thing is to apply for both EAD and AP. They are both free with AOS, and doesn't change the processing time because EAD and AP are processed at the same time. Definitely get both, or I almost always guarantee it will come back to do you dirty if you need to travel.

I only needed EAD tho. Would it still be free if I only apply for EAD with my AOS? and I have a K2 does she also need her own AOS?

  15. We just got married here in our house with my uncle who's an officiant and we didn't had that much picture and we don't have the ring too because it came in late. My question is would it be required to have many photos of our wedding? We are planning to have our wedding in December with my family who's not in here where I am. Would it be a red flag if we just send 3 pictures of us together holding the certificate? or should we redo the ceremony? We are about to send our documents for her AOS. Thanks a lot.

    Great news!!

Answered your CC question in your other posting

I think someone deleted my post in Visa journey, so I wasn't able to respond to you. But none of my information (nor the visa) states anything about my new address. So should I proceed as if I still live at that address?

Its only an hour away from me.

  17. Hello,

Everything is finished, she is getting her sticker from Davao on Monday morning! We are looking at flights and I currently have a window open for purchasing tickets. I am worried about this though....

    • You must pay with your own credit card, and cannot use a third party or corporate credit card.
    • However, Asiana Club members who use the following credit card secured verification (optional) may use a third party credit card. (Verified by VISA, Mastercard Secure Code, JCB J-Secure)
    • Without the physical card, your boarding may be denied

according to the credit terms and International Transportation Article 3.
    • If the card cannot be verified, you may be denied boarding pursuant to our Credit Transaction Terms and Article 3 of International Shipping Terms.
    • Online payment will be processed in personal security environment, using the card issuer's verification system.

So if I book her and her daughter a flight and pay with my credit card, they may be denied boarding??? That is insane. I can't recall if you had to present your card at the counter when checking in luggage or not, but I know they don't ask at the gates.

Does anyone else have any experience with this? She has a scanned copy of my passport bio page, but she does not have the credit card info (i could scan it to her too). Would that be enough to verify? How did any of you others do it?

Follow the link Ate gave you.

she didnt need the birth certificate thank god. She passed the CFO! so thats awesome!

Right now Im looking at flights on Asiana Airlines, it says in the payment method part that if you dont have the card that payed, or you cannot present the card used you could be denied boarding..... I dont have any options, I myself have never got asked to present my card at the gate or wherever. Maybe at the first checkin counter? kinda worrisome
