    The wording of the bill's text has not been updated officially yet, but here's what it said regarding eligibility:

    So if you filed jointly, you must have been considered a resident alien for tax purposes, and therefore A does not apply. I'm just pointing that out as some people may incorrectly look at that in an immigration context, not tax context.

     

    No public charge issue. These are not tax credits. They are also one-time and not means-tested, so no issue there. Immigration status is not a consideration for eligibility under the current text.

     

    Nothing is final yet, but all signs right now are that this will pass through the chambers and be signed.

     

    I kinda feel bad for all the people who (incorrectly) file as Single because their spouse is abroad, and all the CPAs who advised them to do so may be in for a bunch of upset clients. Or people who filed MFS since they didn't get an ITIN for their foreign spouse.

    hi i have question which im not sure.my wife is a usc and im on green card holder will gonna apply for removal of condition end of this year.im out of work because of market closedown im out from work now. employer suggest me to apply for unemployment benefit.i am not sure if i apply for it.that will gonna count against me or that will be alright to obtain unemployment benefits?

    We called our attorney he suggested we do it again.. But I don't see the point since vaccinations are good for 10 years.

    normally its recommended if your medical is older than one year before your interview do it again for interview otherwise thats gonna be cos of delay on your green card.They will require updated medical.

  4. its not mandatory to you to change your name .your case is depends on your strong tie with your spouse and if you have or planing family.i just attend my aos interview last week.they did't ask any additional document just my updated information.like i have DL and SSN,job letter,and other joint documents like lease and insurances but they did't ask me for this because we blessed with baby in last NOV.They just updated my info in the written form which i submitted before  i - 485. and i got approval within 7 minutes our appointment was on 12.30 we were out by 12.37.

    Good to hear that you got interview. You will receive a letter by mail within one month. To call them is waste of time coz they will not gonna tell anything about your interview according to there guidelines. so wait you will gonna get it by usps soon in your mailbox.

    I have read somewhere that once they approved ur case it only valid for 4 months from that date and  our case was approved on August 2 2018 so as per that date our case will expire on December 2 2018 

    i am so confused now what to do 

    and what are the options we have 

    how can we push the date of expiry of our application and how we can reschedule our interview date too 

    we would be so thankful if someone would help us out of this problem

    Yes it's true k1 visa have validity for 4 months everyone got there pcc done in advance coz it's valid for a year and medical valid for 6 months after issued. Now you should call NVC and check with them and explain your situation. They might can do something otherwise you have to do everything in rush.As per my knowledge once you attend your interview that validity will not gonna effect you but even though I will suggest contact NVC.Best of luck 👍

    when you scroll down and click on case number then you will see what is the updates or you can call nvc directly during working days.

    Actually they don't allow us citizens to talk during interview but it's all depends on consular officer they maybe ask about your petitioner something or not.Interview is all about they have full rights to do anything.

    1. On the interview notice it states on there that we need to submit our I-693 if it was not previously submitted. My wife got her I-693 done in Delhi, India as part of the original K1 visa when she first arrived. Do we need to do another medical certification again?

     

    2. What does it mean by bullet point "All documentation establishing your eligibility for Law Permanent Resident status"?

     

     

     

     

     

    if your wife did her medical one year before then she need to take new medical

    You need his pay stubs, affidavit of support original with signed and his job letter which describes everything like job nature, pay designation, pay etc and bonafide of your relationship like bills, photos, receipt from everywhere you visited etc. gather as much as you can it will helpful.

    I have tried at least ten times. The website shows me all the open dates and times when and select and continue, it gives me an error saying the selected dates and times are not available. I called Mumbai embassy and they see the same error and couldn't give us any appointments at all. 

     

    Does anyone here have had the same issues? Please help me out if anyone knows what to do?

     you should try early morning like 8am to 9 am.slots will open on that time in India.Most of the applicant got there appointment that time.its normal error no need to worry.

    You should take originals as well as copy of each single documents coz if you need to copy any document over there they will charge one dollar for each page and whatever documents they keep they will send you via mail if you approved. Best of luck. Anyways when is your appointment date?

    3) Yeah this could be it, but the thing is, I saw 4-5 couples ahead of me at the USCIS interview waiting room, and they all got separated too. and I doubt all of them used the same lawyer as we did. and so I think separated interview is what they do here regardless. 

    And I still don't understand why she refused to take photos if she needed the proof of bona fide marriage.

    This is the main cause of stressful or stokes interview only your lawyer. This could certainly be it...as far as the IO knew, you had no evidence of a bona fide marriage despite being together for 5 years. No idea why the lawyer advised not to send anything beforehand...maybe that's why he says everybody goes through it.

    No problem. Even some cases they don't allow petitioner to talk during interview if they attend with beneficiary so you are fine attend your interview confidently.just suggestion from me know each and everything about your partner and your meetings with timings like date, day, month, year. it's not predictable what they will gonna ask.
