Please talk to an immigration attorney. If you pay for their biometric fee, they will be expected to show up at their biometric appointment, which they won’t. Their non- existent application will get denied, and it can bring future issues if they do decide to apply for adjustment of status later on.
I repeat: these are your husband’s kids. For those two, he’d provide their names on the I-751, but mark “no” for 4 and 5. The baby is a different story, still no bio fee.

Just listened to this on youtube and people have been rejected multiple times because of this:

thank you so much this helps.

Just got off the phone with a representative from USCIS. They cannot give you legal representation but to break it down, we were told that we needed to pay the biometric fees for both children living in the Dominican.  We will never have to pay for the biometric fee to remove conditions on them again but we will have to pay for the application fee for any type of application that we fill out for them to come here to live with us.  Shocking but true.

Right, but your child is an American Citizen by birth, so he’s not applying with you and thus, no fee is needed.
Remember that your husband is the beneficary of this application, so for his previous kids the answer would be no for both 4 and 5. For the baby, it would be “yes” on 4 and “no” on 5, because he’s American by birth. Hope that makes sense.

Who did you make the check out to? Was it made to - U.S Department of Homeland Security Citizenship and Immigration Services? It looks like that is what the original pay to order of, was made out to.
Because it’s just suppose to be - U.S. Department of Homeland Security. I do believe it is the fee like the other posters are stating. I believe they think that the children will be coming here at a later time. therefore a biometric fees is needed.  I plan on talking to rapid visa who we initially did our visa with and in hopes to get a better outcome.

thankyou all for your replies, this has helped significantly.

We made sure to check to make the check out to U.S department of homeland security. We have continued to get stamps like this on all of our rejection notices.

You need to provide the names of all children (including stepchildren not living with you). You would state that they are not applying with you. See the photo I attached:

yes we did this exactly how you stated as we were worried about the fees but every time we got the same response. I thought we were supposed to include them all because that is what we did on the fiance visa early on.  However, now I believe we have to pay the biometrics fee for them. I am reading this online:If you became a Conditional Resident on the same day, or within 90 days of your parent, then your parent can include you on his or her I-751 Petition to Remove Conditions on Residence. That means you will not have to file a separate I-751 Petition. However, you will have to pay the Biometrics Fee, which, as of this writing is $85.00. If you are included in your parent’s I-751 petition then you are considered to be a derivative dependent of your parent and whether the conditions on your residence are removed will depend upon whether your parent’s I-751 petition is approved and his or her conditions are removed.

Did you list your US citizen child on the I-751, Part 5?  This could be the problem.

Each conditional resident dependent, eligible for inclusion on the principal petitioner’s Form I-751 and listed under Part
    5. of Form I-751, is required to submit an additional biometric services fee of $85.

Why should we if they are not coming here to the US, and the other was born here in the United States? So that means it would be 255 in for all three of them? Wow

If you have a kid together the birth certificate is very good evidence to include.

And hopefully it will end with the issues you've been facing regarding the mistaken fee.

thanks we will get this done. Just to clear things up, I got pregnant with our son while he was living in the Dominican in 2017, had our son 2018, bf at the time moved here in 2019 after our son was born. Procrastinated to get the signed birth certificate then covid hit and put things behind. Which is why my husbands name was not on the original bc, because he was not here when I had our son.  He came months later.

I did not think we needed the birth certificate because we had everything else showing proof of relationship and pictures to back it up. That was my fault, hindsight 20/20 wishing I would have done that first.

We will go tomorrow and get it done since they opened back up last week. they say it is a quick process so we will just do that instead so that there is no more confusion.

Even if my husband's name is not on there yet. We had him when we were filing and did not get his name on there because we were trying to get all other stuff dealt with that we forgot. However, i am putting it in there so they know he is an american citizen with a letter to match clarifying this. Do you think the letter will assist?

Did you list your husbands children on the I-751, if I am not mistaken you have to list them on the form and there are boxes to check whether they are living with you and if you a filing for them, but you have to list them on the form!

yep and we said no for both of them but said that our son that we had together is living with us and I am assuming they thought that he was filing with us or from the dominican as well. I did not put the birth certificate in there because we still have yet to put my husband's name on the birth certificate with covid and everything it put so much behind.

Does he have a valid DR passport? If so, he can show that to TSA for domestic travel: https://www.tsa.gov/travel/security-screening/identification

    • Driver's licenses or other state photo identity cards issued by Department of Motor Vehicles (or equivalent)

Thank you and yes he has a license, but we have to renew the date his card expires. Don't they verify that information.

Well, first time you said it was because of the missing signatures, wasn't it?

And you shouldn't worry if filing late. You'd have good reason for doing so.

yes you are right, but they gave us the same letter so now i am assuming the fees are not correct.

this is the second cashiers check we sent and Uscis stamped it a second time with this same stamp.  No it says void if over us $680.  I am wondering if we should just use a credit card this time because we did use a check the first time but same results.  I just wish we can talk to someone there so we can get a definitive answer. However, I will use the suggestions in these posts and post a letter stating please tell us what we are missing and we will provide a credit card document this go round.  This is so stressful seeing that you all are seeing that there is not much wrong either and we are getting so close to the expiration date that I fear that he won't be able to travel with me to my home in California or back to the Dominican for the holidays.  Why do they do this and just give generic answers?

On October 5, 2021, we rejected your Form I-751, Petition to Remove Conditions on Residence, Receipt Number EAC......, because you sent us the incorrect fee. We mailed your case back to you, including any supporting materials and the incorrect payment. Please follow the instructions to resubmit your case. If you have any questions, contact the USCIS Contact Center at www.uscis.gov/contactcenter. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

This is exactly what they stated. We have a son here in North Carolina but he was born here. My husband has two other children but they are in the dominican but not filing with us. What the heck could we be missing in the amount?

Can't open the file but I guess the stamp is actually from USCIS.

And is the legend "void" part of the check?

    @etapia
File again using the same documents and form you already sent but this time with a personal check.

this is the second cashiers check we sent and Uscis stamped it a second time with this same stamp.  No it says void if over us $680.  I am wondering if we should just use a credit card this time because we did use a check the first time but same results.  I just wish we can talk to someone there so we can get a definitive answer. 14. I would have thought that as well since it is the same wording every time. Yet, every time they placed our 1st check stapled on top, 2nd cashiers check stapled on top, and this third time stapled on top. Please see attached. When you see that it is stapled and stamped I believe you will be lost as well.  I even used ten different calculators thinking my calculations were off and I excelled in math. LOL

As @K1visaHopeful advised, post an image of your rejection letter -concealing any personal information-.

Your form can also be rejected if it was sent to the wrong address or there is a missing page.

Thank you for your responses. It has been the same letter every time and nothing different. It states, "the payment amount is incorrect, or has not been provided. Please review the form instruction for fee information. Please resubmit..........to the address below.  All times we sent to the address and that is po box 21200 phoenix, az 85036.  Please be sure to complete the application fully, submit the appropriate fees, and include all required supporting documents. If you have questions please visit the the USCIS Contact Center. I am so nervous and now out of ideas of what to do. Please help and see attached.

  16. I am at a loss for words my husband and I have file our I 751 and received our 3rd rejection notice in the mail.  The second time we received the notice we saw exactly what we did and missed signing our signatures.  However we see stamps on each page with no errors like we did before.  Here is what we included:

    I751 form

    Pictures of our family together

Front Back of his permanent resident card

Copy of our tax returns 2019 and 2020

Copies of my passport and dates outside of the U.S.

    Marriage License

    Deed to our home

    Bank cashiers check of $680

His expires on October 31st; we initially filed in August, September, and the again in September.  We are worried that if it gets rejected again he will not be able to drive because his license expires around the same date. What are we missing and how do we get a hold of someone from USCIS to see what we are doing wrong? The letters they send are exactly the same and brief.
