The problem is people choose the K1 visa without realizing that they will be out of employment for weeks to possible months. And sometimes it affects them. My wife, as having worked all of her adult life, went through  the same emotions as you.

This is why I always suggest to people who ask to go for the CR1 instead of the K1 even though my wife and I did the K1. The Cr1 is a superior visa as it gives work and travel privileges immediately upon entry to the US.

I always get confused what is K1? Is that the fiance visa

I actually am adjusting status through student. I was here on a student visa for the past 9 years. Recently got married and now adjusting status.

I have had previous EAD before through my student status.

    Thanks a lot for replying

I went to interview but I had already told them that I don't have ead, but i am close to have it if there is no problem. They accepted to wait for a while. But, the problem is uscis doesn't expedite even cases with job offer that often. I tried but they still didn't ask me to fax them my job offer, it has been a week, and I am still waiting...

That sucks :( You already got the job?

I hope u get it resolved soon. it kinda sucks to turn down a very good job offer cuz of EAD, when you know you will have it in hand soon its just a matter of time.

Have long has your EAD been pending? Mine is 45 days now

Myself always wonder why people go throuhg interviews without the EAD but anyways...

As far as I understand, you need to supply an actual job offer from the company to even attempt an expedite. I mean I guess you can try; but USCIS probably won't accept "I'm pretty sure I'll get this job" type of thing.

Thank you for your reply! Well idk about other people but i applied to jobs so we could both work and afford the living, which is not that easy in one income. Being a bit impatient also lol.

Thanks tho maybe ill just try it.  nothing to loose. my ead application been pending for 45 days now.

  4. Hi guys,

So long story short i am a january AOS filer. My PD date is 1/2/18 and biometrics were done on 2/2/18. Since then i havent heard back from uscis at all. Statuses online were not updated either.

I had a couple of job interviews and in one them i was successful to go to the final stage of the interview. I got an email from the HR which says congrats you are picked as one of the 2 final candidates for the job. I feel like 90% i am going to get this job and i want to lower the chances of them not accepting me if i tell them im waiting for EAD in case if they offer me the job offer. I know the EAD expedite in itself takes 2 weeks so if i tell them to wait they might move on to the next candidate. But i really like this job!!! What do you guys think? Anybody been successful like this?

Would this be a good enough reason to do an EAD expedite? Please help share your opinion!

I am adjusting from OPT to AOS. My current EAD expires in a week. I hope to get a decision soon!

you can still continue to work on ur expired EAD if your work is ok with it. I know it wont cause any problems with the immigration. The unauthorized emplyment doesnt count if you are adjusting from marriage

But yea better to have the new EAD. I am on CPT but got a new job and cant switch it. Really need the EAD

No sure what exactly you want explained. Did you claim to be a US citizen? Then you’ll never get your GC if uscis finds out. If you didn’t you’ll be fine. I informed usics of all places where I worked, it was on one of the forms and I had to. I got my GC :)

awesome thanks good for you! i did not claim that i was a US citizen. I was on legal OPT when i was working however when my card expired i worked for 3 more months thats the only thing.

I find comfort knowing that it worked for you thats what i wanted to hear!

    Thanks again :)

I got my GC :)  I paid taxes every year and did everything i would as if i had work authorization, they knew it all.

As long as she didnt claim to be a us citizen on i9 she is fine. I know a lot of people who worked without authorization (including myself, also got ssn through J1), it's not a reason to deny.

    Hi,

I know this is old but i was wondering if you could explain a little bit more about your case.

I am in the same shoe and i am a little worried (i only 3-4 months) unauthorized employment would this affect me?

Did they ask proof for your work or asked any questions during AOS or during interview?

Any feedback would be helpful since you went through the same thing.

    thanks a lot

The case status for our I-485 just changed to 'interview ready to be scheduled' on January 26, 2018. I need to include that we did receive a request for initial evidence back in October 2017 (they received the requested documents on October 18), so that likely slowed things down a bit. I honestly don't expect to hear any updates on this case until sometime this summer.

Our I-765 was approved in 131 days, after making several service request via phone. The status is now 'card was mailed to me', and we did receive the card in the mail on January 24.

Our I-131 was never updated and still says 'case received' , however we did receive the EAD/AP combo card that serves both purposes, so that status is irrelevant now.

Oh congrats that is nice at least your case is ready for interview and you got your EAD

I believe they never update those online statuses. They havent sent me an RFE or anything so far after biometrics its been almost 2 weeks.

I am just hoping to put  SR via phone for my EAD and hopefully get it soon even though its only been 42 days.

Thanks a lot for your feedback good luck :)

    So is mine. :)

You are in for a bit of wait in that case, Chicago is currently taking 9+ months to process I-485 petitions.

As mentioned before, you can try expediting the I-765 by calling USCIS and faxing them proof of your job offer.

Oh no thats quite a long time :(

As long as i receive EAD i should be fine then just waiting for I-485.

I saw your timeline, has your status changed online for any of the cases? like for me i485 it still says fingerprint received.

when is that suppose to change and what will it say next?

It's currently taking around 4-5 months for EAD/AP approval. You can try to expedite this with proof of a job offer, and while those expedites are often successful, they also take a few weeks of time.

The processing time of the I-485 depends on your local field office. Some offices are processing cases in 3 months, others are taking over a year.

Thanks a lot for your reply.

It says my office is NBC in Missouri

  11. Hi all,

Found this forum to be helpful hence i am posting here a question i have regarding my AOS

    12/29/17- Filed AOS ( I485,I131, I765)

    1/2/18-  case was received

1/12/18- received all NOA in mail

    1/19/18 received biometric appointment notice

    2/2/18- did biometric

Up to today 2/12 there is no change in my status online. both i765 and i131 say case received still, while i485 says fingerprint fee received.

Does anybody has previous experience like this? When should i expect those to change .

My i765 is pending for 42 days. I have a job offer that i need to sign by the end of the week hence it is urgent. What can i do how can i expedite? Is there any solution or hope that EAD can be approved in 42 days??

Please help and share your thoughts any feedback is very much appreciated.

    Thank you!!!
