  1. Thank you words of confidenice. But, my confidence is whaling.

     

    Currently it says 12.5 months (80%) for N-400. They received my application on 12/10/2021, that is 14 months and my status shows in review. I am wondering if my I-751A for my son is the hold up. He is 21 but can not apply for N-400 until Nov of 2024. He has a pending I-751A tied to my I-751.  I can only assume they want to do the interview for my son and I joined. I have not received an RFE's. 

     

    Do you think talking to a immegration lawyer will any differance?

    At the automated prompt say "info pass" or "change interview date". Customer service is very nice, but remember they are first tier and will only assign you a ticket number. They say someone will reach out to you in 30 days. Unless you are seeking a stamp in your passport they will just give you a canned answer about delay.

  4. Need a little help:

    • Green Card (24 Month) extension expired Nov 17th, 2022. - EXPIRED
    • I-751 filed in Octorber 2020.
    • N-400 Filed December 2021.
    • Finished my biometrics Dec 2021. 

    No updates since for either. I called USCIS and suppositivly they said I canceled my interview for April 2022. But do I see anything on the online status and I did not get an appoinment letter. 

     

    Last week called USCIS to get a Info Pass appoinment to get a stamp (mainly for work purpose). I have an appoinment on Friday. 

     

    My questions: Do I need to filled out a I-90 and pay the fee? I still have my green card. On the appoinment letter it does not mention need for I-90. 

     

  5. Hello my wife came here in 2019. She is on a green card (N-400 in progress). I am a US Citizen and would like to sponsor my Father-In-Law and Mother-In-Law because I have the income to show. I have a few questions. This for a tourist visa and they only plan on staying for one month. 

     

    1) Which form do I use I-134 or I-864.

    2) If it the I-134 do I need to fill out two I-134 or 1. I do not see an option to include another beneficiaries. 

    3) I assume I check this box "Another individual who is the beneficiary."

    4) I plan to fully support their visit and my in-laws are retired. Do I need to put income for my in-laws?

     

    Any other trips, seems like the revamped I-134 is a bit more involved. 

  6. Hello I am a US Citizen. My wife and step-son came to US 11/2018 via a (CR1). At the time my step-son was 16 years old, so I filed the same visa for both. He is now 19 years old. I also filed for I-751 for both of them 12/2020. The I-751 is still pending and they just extended to 24 months.

     

    I filed for my wife's N400 in citizenship on 12/09/2021 and she has her Biometrics Appointment on 01/06/2022. She was able to apply because I am a US Citizen and she has been been living here for 3 years. 

     

    Now I am trying to file for my step-son. I was reading and there was no option to file because he is older than 18 and has to wait 5 years before I can file for him. Are there any other options I have or does he have to wait 5 years from 11/2018?

  7. Thank you for the words of encouragement. A bit more information; I called the neighbor and he is currently applying for  B1 and B2. I think that is how they got his number. He said the conversation with the consulate was normal and in English. They asked how long my spouse lived in the same society. What are the name of her parents. They asked about my spouses late husband and why he passed away. They asked about my spouses sons name. They asked about my name. They asked how long we were married. Basic questions. The neighbor did mess up on how long we were married, but he was not invited to the wedding. He said 5-6 months, where it has been almost 12 months. It was only blood relatives and few members from my family. 

     

    As some suggested on the fourm, I font loaded @ the NVC stage. Pictures about 150 pics, showed them 4 trips to India, affidavit's from both our uncles, joint bank and joint 2017 tax returns, phone logs, chat history and WA call history. 

     

    I think the only red flag is that we did not change my step son's last name to my name. My wife changed her last name to mine, fairly quickly after the wedding. 

     

    Thanks to this fourm, I feel a bit less worried. And in some aspect I look at this as a positive, where they feel more confident on a bonofide marriage after talking with our neighbor. May make the interview go smoothly. I hoping to share our joy on Nov 6th.

  8. Thanks for all the quick replies. Our initial thought that it was a scammer, however the caller ID was that from the embassy. It was the main number from the embassy. It is India and all most neighbors know about each other especially life events. The questions were more verification questions from the DS260. Nothing major. 

     

    I told my spouse just to be honest and forward during the interview. She is shaken by the event, and this just added to already nervous spouse.😊

     

    It does appear that the phone call was out of the norm, which has me a bit worried, but our file is pretty stright forward. 

  9. Our interview is set for November 6th, 2018 in Mumbai consulate. On Nov 1st, 2018, my spouses neighbor, across the street, got a call asking about my spouses and step sons information. The caller ID was from the consulate number and the person asking the questions had a lot of information (DS260) verification related question. The consulate asked about my spouses parents name, how she became a widow and about my step son. The call lasted about 2min. We have no idea how they got the neighbors number. It is not listed in any of our paperwork. 

     

    Is this normal process? Nobody on this forum has mentioned getting a verification calls. Should we be worried? Is this a bad/good sign? I front loaded the NVC package for Bonofide marriage. My income is over 5x the poverty line.

     

    This has gotton us a little rattled and looking for similar experiences.

    ok thanks for the information. I am from Gujarat, however, I am a bit concerned about delaying the delivery or worst case misplacement of the passport. Having it delivered to Gujarat would be much more convenient.   In addition, there are several holidays Diwali & Veterans day after my interview day. If someone here got there passport in Mumbai, is it faster?

    Hey for biometrics you will find an option saying schedule VAC appointment that is basically your biometrics appointment..you have to schedule the date and time according to your choice .The main interview date you don't need to do anything with that as it is already scheduled by NVC.Go to Ustraveldocs.com then create account (register) then put your personal data then schedule appointment for biometrics and you are all set.Just take the printout of that appointment.

    Also make sure you pick the place you want your passport "picked up" or delivered. As for the profile information assure it matches your passport. 

  12. Indian Consulate:

     

    So my case competed on September 11 @ the NVC

     

    Little History:

    I mailed my AOS and IV on 08/28/2018 which was received by NVC on 08/31/2018. I completed and submitted my DS 260 on 09/01/18. On 09/07/2018, I was reviewing my I-864 and discovered that the address on the in Part 2 "Mail to Address" (a thru i) were incorrect. I put my US address instead of my wife's India address. In section "Other Information" section (3 thru 7). I had put in my information. So, in short, the I-864 is incorrect. All the other data was correct, especially the financial's. I called NVC on the  09/10/2017 and talked to a nice gentleman, who said to send in the correct I-864 and attached a letter explaining the situation. I sent the update I-864 package on the 09/10/2018. It arrived at NVC at 09/12/2018. So I assume they have not even opened the new I-864 package. Today I called (09/12/2018) and was told my case has been completed and they are trying to schedule an interview date. My DS260 (triple checked) and all the address are correct. The correct addresses on the DS-260 and incorrect on the completed I-864, which one matters more?

     

    So here are my questions:

    1) Where will they send the interview letter, to me in the US or to my wife in India?

    2) Do they require the original interview letter for the medical?

    3) I will be going to India for the interview, I assume I should keep both copies and have them note the error?

    4) Anything else I need to do from my side?

  13. Had the same issue. Need to keep on trying seems like I have better luck in the morning and late evening. I had already mailed my IV and AOS packages, prior to my IV payment being open. Just stick the AOS cover letter in the front for the IV and AOS package. Unfortunately it is a holiday on Monday so NVC will not get to it take a look at my timeline.

     

    I think their server may be overloaded. I know not much else, but if it makes you feel better this is a known issue. 

     

    BTW definitely use a PC, doing this on a mobile device is not ideal. 

  14. I think this is a simple question. I am doing the DS260 form online. I already sent the AOS and IV package. BMB Mumbai consulate. 

     

    I am filling out the form for my wife and step son (17). In any event should I put my information as a preparer? Or should I just tell my wife to login and approve the form? I am the the petitioner (agent) for the ds261. 

     

    I did search around, but this specific question was not answered. 

     

    Also wife was a widow, do I need to bring her previous husband's birth certificate. We have his death certificate. Also do I need copies of my wife's parents passport profile pages? 

     

    Just crossing my t's and dotting my I's.

  15. I have been reading carefully and trying to understand. However, this items confuses me because @Ryan H the petitioner (me) did not need "The NVC will not need the petitioner's passport bio page, the petitioner's birth certificate, or those other items you mentioned."

     

    If you are applying for an IR5 visa as the parent of a U.S. citizen or for an F4 visa as the brother or sister of a U.S. citizen:  You must obtain an original birth certificate for your petitioner, or a certified copy.

    Send a photocopy of your petitioner's birth certificate to NVC.
    Bring the original petitioner’s birth certificate plus a photocopy to your visa interview at the U.S. Embassy or Consulate.


    If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

    Send a photocopy of the petitioner’s marriage termination document(s) to NVC.
    Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.
    For country-specific guidelines on how to obtain acceptable birth certificates and marriage termination documents, use the Document Finder above.

     

    Does this mean I need to include my divorce decree from the previous marriage? Do I need to put the same divorce decree in my stepson CR2 package?

    @Abies ok I will not include the Passport Pictures. I am bit confused on your comments for a "bonafide marriage". Do I need to include them in my NVC package? We will be taking chats, photos, phone call logs etc to the interview, do I need to put them into the NVC package? I have put in my latest PG&E bill and Home Mortgage statement for Domicile. Thank You!!!

     

    @Ryan H Thank you for the reply. I will remove the petitioner documents. I am the sole sponsor. I will also remove the W-2, the only reason I included them was the transcripts I downloaded from the IRS website. I did place an order to get the "official transcripts", but the wait is 5-10 days. I don't want to lose any more time.  I also have electronic copies of my full tax returns filed, for all three years. I am just afraid that the downloaded version will not be sufficient. Has anyone had issues with the downloaded IRS Transcripts? I assume all the data is the same, maybe the letterhead may be different.
