  1. Hello!

    So we received our NOA2 recently and I've started filling out the I-134. Based on the poverty guidelines, I am above the 125% this past year (not by much) but the two years before I was not above it. I have been in college and graduate school until May, 2018 so I haven't had sufficient income for a bit.

    My questions are:

    1) I currently work part-time and receive an income of $15 an hour for 30 hours a week. I am above the poverty line, but really not by a lot. I also haven't been above the poverty line with just my income alone for the years before (based on being in school). Does this show that I have stable income enough to be financially responsible for my fiance or should I have my father co-sponsor me? 

    2) I do have other assets (such as savings, etc.) that I am going to put there. I don't know what would be sufficient enough in terms of price to show that I am genuinely fit enough to support him financially.

    3)  Also, can both me and my father fill out the I-134 but only take out my father's if they say I don't have enough? Or will they send us back to come back at a later time if he doesn't hand it in in the first place?

     

    I hope someone can help me, because I'm really going back and forth on how to go about this. I don't want the process to take longer, I just want it done correctly the first time.

    Hello, I don’t know if anyone answered this yet, and I really can’t answer it fully, but my fiance is from Brazil and has two first names and two last names with no middle name. This is common outside of the US but was definitely confusing when filling out the form. I personally put all of the names in the I129f following the format of his passport. I don’t know if it was right but I felt more comfortable putting all the names that are in his birth certificate and passport into the form. I don’t know if not putting all the names will result in an RFE though, I’d just sit tight and hope that it doesn’t.

    I wouldn't make any set plans to pick up your fiance until you have the approval that they have the visa. But hypothetically if the approval was in August, you have up to six months to use the K-1 visa before it's void. So if you wanted to wait to pick her up you can do that! Just don't make set plans because there really is no way to know when your fiance will actually be able to come.

    They actually did the opposite on mine, they deposited the check after I received the notification. Also did you fill out the G-1145? If you didn't that may be another reason you didn't receive the message that they got it.
