Hello I am preparing I-864 for both of my parents. They will be coming to US together and I am the only one sponser. do I need two seprete I-864 or only one.
I think many of you have already filled out I-864 so some body please guide me to fill this out.
I am stuck on Part 3 question 8 , 9 & 10.

Each petition requires a separate I-864.
You don't put the other parent on each petition in question 8 (answer "yes") because they have their own petition, so you leave line 9 blank (unless you are sponsoring people other than your parents) and the total for line 10 is 1.

Thank you for this info. I appreciate it as I couldn't find anything quite as concise anywhere. He mailed off the I-130 this morning but he didn't realize a copy of -her- birth certificate was necessary. He included -his-. So, I guess they will be sending him a request for more info. Too bad. I didn't double check him because I want him to do some of his own work on this.
So, the PO box address in Phoenix he sent the package to will forward his petition to the TSC? And then they send it to the NVC? Where do you find processing times for the NVC? It will be interesting to see how long this process takes.
No, he had it right. Her birth certificate is not necessary at this time. As long as her name is on HIS birth certificate, that's what they want at this time. They won't likely ask for her birth certificate until the interview.

The above post is incorrect.
IR-5 petitions are usually processed by the service centers in about 5 months, transferred to the NVC, then to the consulate of the country where his mother resides. The entire process usually takes 10-11 months from the time the I-130 is submitted.
The initial petition requires the I-130, the USC's birth certificate showing his mother's name (with translation if necessary), the USC's naturalization certificate, and if he changed his name, the documentation for that.

Once you file, figure 9-11 Months for the entire process for your parents.
Depending on what country you are from, 10-15 years would likely be the time it would take for a sibling.
Assuming your sibling(s) are unmarried, once your parents get their green card, it may only take 8 years for the process when they file.
Bottom line, waiting for your parents to petition your sigblings is likely to be a little quicker.

Thank you for that. So just to be clear, my first step right now is to fill out the I-130 (one for each parent) and send that in along with whatever documents are needed for that form (Naturailzation copy etc). Once I an approval, I will be asked for my I-864 and further documentation

Yes, that's correct. And the fee for each I-130 of course.

After the application is approved, it goes to the NVC then to the consulate where the interview will take place.
The approval process usually takes around 5 months.

Hi everybody, I have a couple of pressing questions. I am a recently naturalized U.S. citizen who wants to apply I-130 petition for an unmarried brother who is over 21 years of age. My dilemma is listed below and I was really hoping to get some answers to it. Namely, he just graduated with BS degree from the local U.S. college and was thinking of going to grad school (MBA) on the same campus starting this fall. He will have to pass the GRE but otherwise will remain in status. My questions are:
1. Should I wait until he receives a new I-20 and is officially enrolled into graduate program before applying for his I-130 petition?
2. Will having I-130 on file (I know it's a long process of at least 11-12 years at the moment, but thought of it as a "last resort" type) damage his chances of applying for a PhD program in the U.S.?
3. Will I-130 on file damage a chance of obtaining a H1B from prospective employers after he completes his MBA?
4. If he has to leave the country (say, no chances for a job on OPT post-master, no H1B), does it mean he would have to wait outside all those years because I-130 has been filed showing immigration intent, and would he be denied any other non-immigrant visa?
5. Any other thoughts/suggestions?
Clearly, he has no intentions of overstaying and ruining his chances of legal immigration no matter how long it takes so I would really appreciate your answers.

There are often better ways to get a sibling here than submitting an I-130 and waiting 10-12 years. It certainly would hurt his chances of getting a student visa if you petitioned him prior to him getting the student visa. I strongly suggest you wait until he gets the student visa first. He would be much better off coming here as a student and finding an American wife if he is inclined to do so. It would be much quicker.

I petitioned my parents and I just noticed on the form I-130, section C. Information about your alien relative, List husband/wife and all children of your relative I put all the names of my brothers/sisters but I didn't put my name on it. Do you think it will cause problems in the future? Possible rfe? Any inputs will be greatly appreciated. Thank you !
Hopefully, they can figure it out. It's redundant information. Yet, I wouldn't rule out an RFE.

I need help in filling up our AOS, about the household size. my mom filed I-130 to my dad, and to my other 6 siblings. so my mom and i needs to file an AOS (I-864) to all of them.
in my mom AOS, Part 21 is really confusing.
Part 10: am i going to include the principal immigrant? or just the number of my siblings?
Part 21:
a. enter the number you entered on line 10. (7 people = my dad + my 6 siblings)
b. yourself
c. if married, enter "1" for your spouse (but my mom already included my dad on part 10?)
d. if you have dependent children (they are also included on part 10)
h. add together lines and enter the number here. Household size (if i add everything, from lines a-g, our household size doubles)
my mom is the principal sponsor and im her joint sponsor.
this is just confusing me. hope you could help me. i dont want to go to the embassy with our family, with a mess up AOS.

I think you'd be better off filing the I-864a for yourself in addition to your mom's I-864 rather than as joint sponsors. You should be able to use one I-864a all of them. (assuming you live with your mom)

I am a US Citizen living in California. I met a Filipino girl in 2001 while vacationing in the Philippines and have dated since then. In 2004 she got pregnant and had a child who was born on April 2, 2005. I was with her when she gave birth to our "son" and I accepted responsibility for being the father by signing his birth certificate. In 2006, I went to the US Embassy in Manila to register and report his birth as the son of a US Citizen. During the interview, the consul required a DNA test to prove my paternity, but after discussing it with my girlfriend, we both decided not to go through with the DNA. The reason for deciding to fore go and abandon the report of birth is because my girlfriend had a two month affair with a boyfriend, before we really got serious with each other in 2004. I was afraid that the DNA would have unwanted results. Fast forward to the present; we got married on April 19,2012 and now I am petitioning both her and my "son" to come to the US.
My question is; would my previous abandoned claim have any bad bearing on my current petition for them. My son's birth cerificate lists me as the father and I really have no reason to doubt that he's mine, except that I didn't want to go through the DNA testing as I do not know how I would face any unwated results. Can't the USCIS see my son being petitioned as a "stepson" instead?

Who's listed as the father on the birth certificate?
If you are, they still will likely require DNA testing
If the other guy is, his consent will be needed to take the child out of the country.

If you are a permanent resident, you need a separate I-130 for your wife and your daughter. Are you a USC or a permanent resident? Only a USC can file for a parent.

If everything goes smoothly, your parents will likely get their visas 8-9 months after you apply.

Hello everyone! I was reading some posts here and let me tell you, what a great information resource!Very helpful and informative for people who can not afford big $ to hire a lawyer! But unfortunately I could not find anything directly related to my case, so I would really appreciate any advice you can give me. I can petition my parents finally:) they've come here twice already and still have their visa to come visit. I have a sister who is 19 years old who's never been here and I would love her to come visit and hopefully move here permanently someday. So from what I understand, if I petition my parents, my sister can not come here with them under derivative category(correct me if I am wrong please) I know that if my parents gonna have petition pending here there's almost no chance for her(my sister) to get her tourist visa to come, because with all that immigration protection she would probably get denied under the intent to immigrate(which she has no intention on doing though) So the question is, what is the best thing to do right now: petition both parents and then after they get their LPR they can petition her? OR petition just my mom and then after she gets her GC she can petition my dad and my sister(would she qualify as derivative then?)
Also, after I petition my parents can they come visit with their visa that they already have or would my petition somehow result in annulment of their current visa? I know the process is long, and would really want them to come visit in the summer to celebrate their grandson birthday with them.

If your parents already have visitor's visas, they will not be revoked, but if they expire, they will not likely be renewed after you petition them. It's slightly quicker for your sister to wait until your mother gets here and have her petition her after she gets her green card. It may only take 8 years instead of 10+. She has to stay single though or the deal is off.

For the initial I-130 submission, all you need is his naturalization certificate and his birth certificate (with his mom's name on it) with translation if needed. If your husband had any name change, documentation for that will need to be provided as well. All the other documents can wait until after approval which will likely take about 5 months. You can start preparing all the other documents while you are waiting for approval.

well, I am not sure if I chose correctly. Not realizing the guidelines for optin until now. I sent in the DS-3032 via paper mail and received receipt via email with GUZ case number
Since I didnot send in an email with pdf DS-3032 and state optin. Does anyone know if I can still opt in for electronic at this point?
For all the extra trouble to optin. is it worth it? any experiences.
My AOS I-864 is ready to be go now.

I would call the NVC and ask if it's too late. If you choose the paper route, you're in for a 3-4 month delay at Chinese customs.
