  1. Our status just changed today on the USCIS website and said that a new card is being produced and will be mailed to the address you provided to us. Does that mean the green card is being produced and will be mailed to us? However we have two case numbers. One for my wife and one for her 14 year old son, but only one of the statuses has changed.

    Because it is a goverment agency. That is their standard timeframe. I don't know their processes but assume there is one or two managers who can approve it, or they need to request more info from storage and such. 

    If they didn't say that anything is missing and you provided bonafide relationship proof you will be fine.

    Thanks. The guy was really nonchalant about things and did not seem to want to get into a lot of information. 

  3. We just had the interview in Detroit. Is it normal to NOT be told if you are approved at the end of the interview? He just said he would have to review the paperwork and had us sign something that said it could be 60-90 days. His questions were not deep and were all quite surface. All questions were answered properly without any issues. I didn’t hold her hand or hug her or kiss her during the interview. Is that a problem? I didn’t want to make it look like I was trying to prove something. I am nervous, to be honest. I figured they would tell us we were approved right there.

    If she does not speak English, I would get a translator for her, and yes, I don’t believe family members are allowed to translate due to the apparent conflict of interest.  The interview in general will be fairly easy unless of course they conduct a Stokes interview, but the IO needs to make sure your wife understands all the questions hence the need for a translator.

    Thank you. I think you are right. Is it true, do you think, that they MUST be a certified translator?? 

  6. We have our green card interview for my wife and son in Detroit on December 2nd. She has already received her EAD card and SS card. However, she does not speak to English (I speak Spanish), and I have heard we should have a certified translator with us. Does anyone else think that is necessary or have any experience to offer? We would think if they already issued the EAD AND SS it would not be a long and complicated interview. I also heard my 14 year old stepson and I can not be her translator. Help?????

    I believe internally they have another period of time to review your response. I don’t know what it is exactly but probably 30-60 days something like that. So for example, each adjudicator has a quota say 400 cases/months. They may have gotten 380 done and it’s the end if the month, so he just issues bunch of RFE for random stuff on the 20 cases he did not get done. Now he just bought himself another month or so to work on those and still meets his quota. Again, just pure speculation man.

    And apparently that is an acceptable practice, if that is indeed what is happening.  I guess I should plan for another 30-60 days after they receive it Monday.

They have quotas that they have to complete with deadlines and when I see RFE like this, it makes me think that they are facing a deadline and the issuance of RFE essentially "freeze" the case until the response is in, and then they have some more time to consider the response. Again, just my theory. Someone else will disagree.

    Well, I received it yesterday, sent the documents in today, and they will have it be Monday at 1030am, so they have not really “bought” much time. Hopefully it won’t be long after they get this documentation. 

  9. We are in the same situation. We sent the AOS packet April 1 and USPS tracking said it was received April 3 and we still have not received any word on it. We are on the 23rd day since it was received. My wife and son's visa expires May 2, 2019 so I am concerned that it could be a factor. Does anyone have any advice for me? Should I be concerned??  Is there any way I can check the status before receiving the NOA??

  10. Good evening all-

     

    Getting ready to file the AOS and want to make sure I am understanding everything correctly. WOW! Lots of paperwork to fill out but just so happy to be doing it as we were married on February 22! The way I am seeing it, I need to file the

    I-485, I-864, I-765, and I-131. Is that everything? My wife has a 13 year old son. Do I need to file separate 485, 864, and 131 for him? Also, as I understand it, I am only paying the filing fee for the 485 ($1225 for her and $750 for him) and the other fees are waived. Is this all correct? Sorry for all of the questions but I figure that is what the forums are for, right. Any other tips or suggestions? Thanks so much! 🙂

    Fees are $1200+ (exact amount can be found on the USCIS website, keep in mind I-765 and I-131 fees are waived if applied together with I-485/I-864)

    She won't be exempt from anything, she will have to pay and go the route all of us have to go.

    I-765 and I-131 take about 4-6 months right now, I-485 is depending on your local office. You can check estimated processing times for your local office via https://egov.uscis.gov/processing-times/

     

    She can get her SSN as long as her I-94 is valid for at least another 3 weeks. She has to apply in her maiden name first and once she has one she can apply for one in her married name.

     

    The USCIS website says the fee for the I-765 is $485.
