    You will likely need a FOIA request to see why it was denied, but a returned petition only occurs when they believe it is not valid (usually not a bona fide relationship, or they think you may already be married).

    This case has already expired anyway. it has been more than a year since I filed for my fiance

Pay at the EcoBank and in 2 business days the calendar will open and allow you to schedule you appointment. They have appointments open as early as a week and they do them on Wednesday. So as soon as you have your DS number and case number do you medical and you can be ready for the next week or the following week. Dakar has really streamlined the process for K-1 and it can be done quickly. We went from Approved with the NOA2 from USCIS to NVC to scheduled and Approved at the Embassy in 1 month. 

    He had an interview last month and unfortunately it was denied. so I still don't know what to do next at this moment. Waiting for a notice from USCIS

    Did they hey give him a bit of paper with a series of letters and numbers on it?

    This is the wording that you need to focus on. Why is he NOT ELIGIBLE? If there's something about the K1 visa that makes him not eligible, it's possible that the same reason could make him not eligible for a CR1 visa either. 

    You need to figure out what makes him not eligible - if it was misrepresentation (leaving out the previous visa attempt - you said he indicated you were a "friend" on a previous visa attempt - maybe they think he was lying) or if it is some other reason he is not eligible. 

     

    You have to figure out a way around that before you get married and apply CR1. How do you feel about just moving to Ghana? 

    Exactly my guess is that they thinking it was a lie. I don't mind moving in with him but I need a job. I have loans to pay though. That's a concern to me

    I think there is more to this than you might know.  Did your fiance receive any paperwork after?  Did the officer say anything?  Are there red flags like age difference, culture difference, language barriers, former marriages?

    None of those things mentioned. The paperwork he received says he his not eligible and they will return the petition to USCIS

    I suggest you use the advanced search tool, type it "K1 Visa denied" and read the dozens of posts of others who have been denied.  There is a plethora of information as to why visas could possibly be denied in those prior posts. Pay particular attention to others who have been denied from your same consulate.   Red flags, prior denials, things you didn't know, interview questions answered incorrectly, etc, etc.   

    Take time go over the interview in great detail with your fiance.

    Without knowing this, we can only speculate as to why he may have been denied.

     

    Other option would be for you to marry in his home country, and then apply for the CR-1 spouse visa.

    Just basic questions how we know each other what i do for a living where do i leave. Then few years ago when we had no intent to marry he applied to come to my graduation as a friend and was denied a visa. We completely forgot about that when preparing for this interview. Now I'm lost. What should I do?

    You won't receive any notification from them. It took us 3 months to realize that their website is not updated. I sent multiple email with no answer. When they finally responded to me, they sent me multiple document with what to do. You will have to "schedule your appointment online at www.usvisa-info.com. You will need to pay the US  $265.00 k-1 visa fee and the 200FCFA (timbre fiscal) fee to the SGBS bank in senegal"  This is from one of the form they sent me. It seems like those fees are actually paid at ecobank instead of SGBS. However after you paid those fees, they will show you the available dates for the interview. If you have not done it yet. Email them so they can tell you what you need. Hopefully they respond quicker than they did with me.

I do have a lawyer, the parelegal confirmed that we had to complete the DS160 online but insist on waiting on a notification from the Embassy. Can we schedule the medical exams, obtain his police report prior to having an interview date?

    Anyone who went throught the K1 visa interview in dakar. Definetly would like my fiancee to be fully prepare for the interview. Can you provide/share information or reviews.

    " On January 03 I wrote to Dakar embassy again and I finally received an email back with lots of attachements. In one of them named K Visa Instructions, it is mentioned that "You have registered with a U.S. Embassy abroad to apply for a K-1 visa to immigrate to the U.S.  You must now obtain the documents required for your application for an immigrant visa.  Once you have all of the required documents specified in these instructions, please schedule an appointment online at www.usvisa-info.com. You will need to pay the $US265.00 K-1 visa fee and the 200 FCFA “timbre fiscal” fee to the SGBS bank in Senegal.  Please note it is your responsibility". Futher in the same document, it is stated that "Electronically submitting your DS-160 online application is only the first step in the visa application process. Once you have electronically submitted your DS-160 online application, you must schedule an interview with us." So, I contacted my fiance and he is trying to find some one in Dakar to go pay the required fees at the SGBC bank.

    So he paid the fees which was ecobank instead of SGBC. Then he pick February 21st from the available dates for his interview. AT this point we are gathering all documents necessary and praying that everything works out fine.

I was told by the NVC staff, that the expiration date you see in the approval notice is for them(NVC); they have to send to documents to Dakar before that date expire. Now your case will never expire because the embassy has it. It will take time for them to contact you, Sometime up to 2 months.

    You can email them but make sure in the subject line: you put the case number, type of visa and your fiance name and date of birth. Then wait

    if you don't hear them send again the same email.

    Thank you @Wawaw It's been 3 months that they received the case. I emailed them 4 times already still no answer.
