    hello everyone,

Is it possible to use 2017 tax returns to file for AOS since the 2018 tax return is not ready yet. Please help

I think it’s fine. I submitted mine with only 2015-2017 tax returns as the 2018 weren’t available yet at the time I submitted my AOS. Many people say it’s fine because USCIS knows the deadline for filing tax returns isn’t until April 15.

    💥AFFIDAVIT OF SUPPORT : NEED SUGGESTIONS 💥

I need suggestions in filing Affidavit of Support for AOS, so my husband recently got hired (September 2018) for his work and passed the Poverty guidelines for household member of 2 (me and him = $20575 year 2020 guide ), please see photo 1. But because he was just recently hired, his 2018 tax income is low ($7767), see photo 2. My questions are:

    1. Do you think we need to file a joint sponsor? (Btw, I have also my Dad-in-law's joint sponsor forms and documents, I was just thinking if I really need to file a joint because my husband's income made it to the poverty line.)

    2. I think I have asked this before but just want to confirm, I will check 23a since he filed 2018, though did not file 2016&2017?

    3. Should I check 23b? I got all his tax transcripts including, 2016&2017 non-filing tax transcript letter.

    4. Should I check 25?
    Thanks y'all.

Since his 2018 tax return documents show that he has made 7,767 for the year 2018, I believe you should file and include your joint sponsor in your AOS packet.

My appointment letter says NBC service center on I797 ASC Appointment Notice.

I got a notice via text and when I checked it did say National Benefits Center. My receipt letters all start with MSC which I was told is for the Missouri Service Center...

anyway, what is the address for yout biometrics appointment and which state do you live in?

Mine also says National Benefits Center. From what I’ve read, all cases are sent to the National Benefits Center (NBC) and then sent to local field offices once checking of the documents (probably looking for missing documents) and background checking are done.

    Hi Everyone,

I filed AOS on Feb 6th and got NOA dated Feb 8th. My local CIS is San Francisco but our I485 case and (other 131 and 756) is processed by NBC. Is any other people here who got NBC as the processing centre? Our biometrics is on 25th Feb.

As far as I know, all cases go to NBC first. Once checking for documents, biometrics and background check are done, they send it to the local field offices.

We sent it on Feb 5 and it was supposed to be delivered in Feb 7 but it didn't get there til Feb 10 which is Sunday. So they received and started the process on following monday on Feb 11 for EAD and AP. My AOS received date is Feb 13. That's when they cashed our money.

Mine was delivered on Monday, February 11 too but I haven’t received any texts yet. I’m hoping I’ll receive their text notifications soon.

Yup! She sent it first week of January and got her RFE before she even gets a biometric schedule. It really is a case to case basis.

That’s right. Well I already submitted mine with no 2018 ITR or any tax documents since they’re not available yet. Nothing we can do as of the moment but wait.

I heard some people saying that USCIS doesn’t issue RFE anymore, but your friend got one so maybe USCIS still does.

I sent W2’s for 2016-2018, 2016-2017 ITR and only 1040 for 2018. It may or may not work for my application but a friend of mine sent her application first week of Jan 2019 and she recently got an RFE asking for recent tax papers. She only sent 2015-2017. But it’s a case to case basis so let’s just all hope for a smooth process.

Wow! She sent her application in January and she already got an RFE? It means they were already working on her case. That was pretty fast!

Thank you! People said that it's okay to file the AOS way pass I-94 expiration. But I am just scared because when I enter in LAX port, the immigration officer told me that I should get married within 90 days and "file". I don't know if that is AOS filing or just report of marriage.

It’s fine. The important thing is you got married within 90 days. I got married on day 87 so it would be impossible to file AOS before my i-94 expired.

Hi.. I have the same situation as you... my middle name is missing in my marriage certificate and I-94 too... but I didn’t have any problems with my AOS application.. I just filled in the “Other names used” and provided a copy of my Passport and K1Visa (which has my Middles Names on it)- proofs that you are the same person. I filed my AOS without a SSN yet.

I already had my interview and they never asked anything about my SSN or my Middle name missing..

Thank God I’m not alone in this. Anyway, is your name on your marriage certificate your single name or your married name?

Did you change your last name on your AOS forms?
