That would not work for immigration purposes
Yes, but if the children are not his and partly belong to the other man, the other man would have a say in whether the kids can even leave to another country, until they come of age? Just curious.
-
the two children were born before we got married. we got married last year. before i came to the U.S. she was my girlfriend and we born the children and when I became U.S. citizens I went back to get married with her. At my surprise, the DNA results came out negative. These children are only children I have considered as my own in this world.
Just as a first step suggestion, you might want to look at adoption but that would probably mean finding out who the father is and getting him to sign some sort of release form. Possibly talk with a lawyer and see what they suggest.
Good luck

I was just looking at the Israel embassy info. I was curious cause if it had Direct Consular Filing, you would have definitely qualified for it and possibly cut the wait time in half. But there wasn't answer to it so I imagine they don't have it.
-
Oh you've been there for 7 years! I can understand that, never been to Israel. But my wife, before she was my wife used to stay in Cyprus. It was way too hot and way to dry and I really didn't like it all that much there aside from the fact that she was there.

Hi Blanche I was just talking about the processing up to the NOA2 at VSC. Yes it will be at least another 5 months to get the interview at London. So at least 10 months. I was just trying to break the process into 2 pieces so it looked like we have something that's easier to wait for.
Cool you can stay there with your husband! Did you still have to file at USCIS in the US? I guess there's no way to do a DCF right from Israel?
-
how long does it the i-130 process take?
It also depends on whether you're a USC or resident, and who you are filing for. The 5 months mentioned is just for the NOA2 but then you have the NVC and the embassy which can vary on the US Embassy of the country you are dealing with.
-
So, USCIS lists the current average time to get an NOA2 from VSC for a USC filing I-130 for spouse at 5 months.
So I guess I can schedule the big celebration party for June 1st and Blanche, you can peg yours for the 15th of May! No problem what could possibly go wrong!
-
She did transfer me to a higher level officer but the automated message came on saying they will call me back. well, you probably can't call me back in Israel. I was calling the 800- number through Skype. I think tomorrow I might get a Skype phone number so it will be valid in the US, that way I can actually speak to someone. And hopefully they can help
Oh I haven't quite figured out this editor. When I try to post a smiley its screwing up my post. But anyway Good luck. Its too early in the game for the frustration though, cause at this rate you'll be a wreck before we get to the finish line
-
OMG they don't make it easy to fix things. Why were they not able to fix it over the phone. I think you can ask for a higher level officer, sometimes the ones ansering the initial call don't know what to do in cases that aren't standard. UGGH!
-
Blanche, this is the form I was talking about but I think its for the USC and asks for old address and new address. I don't know why they couldn't help you on the phone. Uggh is right, and welcome to USCIS

From what I remember there is a address change form that you fill out with USCIS. I don't remember exactly if its am online form or one you have to send them. But I'm a little confused, are you the US citizen and is the address you are getting the document in Israel?
Well it's late over there so I guess you can deal with it tomorrow. I'll see if I can find that change of address form.
-
I'm with you! We got an email on Dec 1st saying our package was received. Then today I went to check and it says a document they sent me has been returned to them! Grrrr..... Hopefully the path will go smoothly for us all!
Hi blanche glad to see I'm not the only one. So this email you got was that from the lockbox or USCIS? So the USCIS sent you a document and it got returned to them? Did they get your address wrong or were you able to get them to correct what they have?
If they already took the fee, hopefully it was the NOA1 they were trying to send you? Fingers crossed.
Yes hopefully it'll go smoothly for all but you have to buckle up cause the frustration with USCIS will certainly have you taking bumps that can fly you out of your seat!
-
Hi all you would be December filers. I won't really feel like my I-130 is started on the path until I have a topic to sit in so here it is so come on in don't be shy and lets get this show on the road!
Well so far all I know is my package just got to the Chicago lockbox and I have miles and miles to go till I sleep!

Andie, OMG, OMG, OMG, Four years in the making!!! You've stuck to your man like glue, well no actually like cement, through such rough times!!! For sure I have that in common with you, where we've known our partners for what seems like an eternity. Actually I believe you've known Kevin since childhood?
I could not be happier for you Andie, the days you have been waiting for, for so long are finally here, WOOHOOOOOOOOO!!!
Oh and I am off to see Loreta, in a week, for a month!!! WOOHOOOOOOOOO!!!
-
Hi Zara! Nice to hear from you, I see you're just around the corner to getting citizenship, sounds like things are going well! Yes everything has gone pretty well for Loreta and I since she's been living in England, and I'm about to buy tickets to fly over there in mid May! We'll get the CR1 done, there's an old dog of an issue (literally) holding us back!
But we'll get there.
Yes I've been rooting for Andie, I know its been quite tough on her. But she's just a couple steps away from that promised land.
Take Care Zara!

Hey everybody, I wanted to congratulate Andie on her NOA2! Since this is the forum she started the K1 process in. Wow 4 years and she finally got through after her fiancé had to refile for her twice and the NOA2 comes after the July 2014 refiling.
So congratulations Andie, you too finally have the chance to be together, after already knowing him for nearly a lifetime. Hopefully the New Zealand embassy process is quick and easy now after al this!!!
-
Hi Andie, nice to hear from you! Yes we are married now, but no, unfortunately Loreta is still in England. The details I was mentioning was about now getting set to prepare for the IR1 / CR1 process to get her a Visa.
We gave up on Cyprus, she still doesn't remember Cyprus. So even doing the K-1 was sketchy cause she lived so long in Cyprus. So I decided that I'm tired of going through a process where I need to prove we have a relationship. So now we only have to prove that we have a real married relationship.
I had tried initially to get the K-1 case transferred to London but then it seemed to have gotten there but then they sent it back to USCIS in the 'Post Decision Activity' state. Now I sent my Local USCIS office a letter telling them, with proof, that we are married now so we need to cancel the K-1 case.
How are you Andie? I hope you are seeing some light in whatever peace you are now searching for. Take Care and best wishes!

RK, how's it going? I purposely didn't post until it happened for real and not just another Boy who cried wolf story! Well we did it, Loreta and I, we are married!!!
July 26th 2014 was the date. Actually I got a scary thought 3 weeks ago after we had scheduled the marriage with the registry and planned out all the dates and everything. I read something on the net about UK requiring you to get a 'Marriage Visitor Visa'. I was like, nooo way this can't be happening!
I called the marriage registry and they said they don't check and don't care how you get in the country. So my hopes were back up again!
But then I looked at the VJ site and none of it cheered me up except for one post that said those rules were changed in 2012 or so. I looked at UKs border guard site and it said the visa was required!
But then the Visa itself said it wasn't for people in transit to another country
But actually maybe that works cause I go to UK stay for 8 days with Loreta to give me the 7 day residence there so we can give the registry the marriage notice. Then there's a 15 day waiting period so we plan 11 days in Latvia. Then we come back to the UK and get married and then I have to go back to US to get to my job. So you know what I would say I am there in transit!
But in any case I decided best to keep it quiet, and say nothing about marriage to the border guards cause it seems they're not quite sure of the rules themselves so who am I to sway their minds. Anyway I told them the truth, was staying in UK for about a week and a half and the going to Latvia with my friend and then returning to go back to the US. Anyway no problem with the guards and the marriage and all the timing of the trip and all went like clock work
So now to enjoy the moment and deal with the other details and more details when I feel like it!
Hope all's well on your end!
-
RK, finally I'm getting back to responding. I got busy with a bunch of things and you know how it goes ... Wow thanks for all the praise and support of Loreta's and my relationship and the ACCT acronym and all! ACCT describes it perfectly!
We're moving ahead with the marriage plans for about 2 months from now.
I think you and Inday must be getting finished with the ROC and hopefully both of you are doing well. But you know in life it never stops, you may be at the end of on stage but there's always another stage waiting. The way to go is to enjoy the journey to the goals, as the goal posts will keep moving and/or the goals will keep changing!
-
RK, nice to hear from you and glad to hear all those issues are over for you and all is ok now
. Glad you two will now have a chance to be together more often and Inday can chauffeur you around for a change!
Well the cruise ship was a thought but I think it won't work out for us. There's only one that takes dogs however it takes 7 days to go from Southern England to New York, and the dog mostly stays in its little kennel, there's some play time and you can go be with the dog but not allowed in your room. If it was allowed in the room Loreta would have been thrilled about the idea. But we're planning on the marriage route now, IR1/CR1 instead of K1. The K1 would have been faster but Loreta seems to have blocked the memory of Cyprus from her mind and that's like 7 years of her life. That fact makes me a little uneasy about the K1 interview. I mean like what if some question comes up in the conversation about Cyprus and she cannot say anything about it? Loreta's never had any success in convincing people that she lost her memory of anything. Once you're married the interview process would no longer be about proving how you met, and that we actually want to get married, It would just be about proving that we have a relationship like a married couple. So that's the plan now, this summer she and I get married in England!
Well there's no choice on the "stick-to-it-ivness" she's the only one. Besides the best things in life, I've found, are those that you've had to work really really hard for. Take care, my friend.
-
I found a cruise ship that will go to New York from England, she said she was open to that idea cause the dog will be taken care of and we have daily access to visit the dog. The cruise takes 7 days.
I don't know if you are the petitioner or beneficiary in your case. But if the petitioner feels the embassies decision on the AP was wrong then they should find out the congressman for the US district they live in, or their senator and ask them to look into it. Believe me they have some authority in DOS / Visa matters. They have their own websites. Good luck!
-
She has a EU passport. There was some policeman that wanted to marry her long time ago, even though he was married. She told me she didn't want to marry him. I believe it was some sort of mess like this. Seems like somebody had it in for her and didn't want her to leave the country.
Right now don't know it could be all for NOT. Her dog is getting old and the vet says that the dog may die on a trip to the U.S. The dog means a lot to her so pursuing the K1 may not happen. So it remains to be seen what we do from here, a thought to abandon the relationship does cross my mind, but I don't like that thought an all.
Denied after 16 months is very rough. I'm sorry to hear that. Cyprus is a rough embassy because of the North Cyprus / South Cyprus conflict. I wish I had some words to say but its beyond my understanding. Good luck to you.

Thanks for the concern Ebunoluwa but don't really want to talk about this stuff anymore. The Visa lady's, and I use the term loosely, communication through emails was more like how dare you accuse us of this we don't do those kind of things. But of course every time I mentioned that the guy knocked on her new door a week after we faxed them my fiancées new address, the emails coming back seemed like she was shouting at me that she doesn't like me accusing them. The guy that knocked on my fiancees door was telling her he was from the embassy and he said he knew who I was and told her my name. He was looking through all her papers. She realized later that he stole her police report from Cyprus and the one from her home country. Whats really whacky is that the police report he stole was dated 5/2011 was the one that the police station gave us just recently when she kept requesting a police report.
So I think it was actually some crooked cop high up in authority. I wouldn't doubt it if this guy has some sort of connection to the embassy. That's the only thing which would explain the leak of the information we faxed to the embassy leaking right to this cop. How the heck did he know my name?
He asked her if he could check her bedroom. She told him to leave. He left but insisting that she would be sorry for this. Her interview was the next week but he and his thugs grabbed her when she went outside and let her go on the Monday after her Friday interview.
By the way this wasn't the first time this guy attempted to knock on her door. The Visa lady admitted that they sent somebody the first time. My fiancée wasn't at home but this guy threatened her neighbors and for sure put some fear into my fiancées friend. I would say this was the same guy.
***********************************************************************************************
But like I said I don't care about this stuff anymore. Also I've known my fiancée for 12 years and personally know quite well about her health issues and memory loss issues and chose to pursue the relationship anyway. She's my best friend and nothings going to separate us even if I have to live in England. These aren't excuses she's just got very stressed in Cyprus and that doesn't help her health wise.
In general the Cyprus embassy responded to all my questions, requests and comments. They also gave me the form for the transfer and did tell me that all my files were transferred. I wonder if they send that giant stack of emails of our conversations, well don't know. At this point don't care, what will be will be and I put up my fight.
Thanks, take care.

I'm sorry about your case. I am the petitioner and my fiancée was living in 'South Cyprus'. I don't really know but for sure they were getting the full brunt force of my emails. My fiancé also was quite sick at times, lost her memory also and that visa chief sending a thug 'investigator' to knock on her door and interrogate her abusively did not help. It was not at all her fault that she couldn't attend the interview, and I for sure let them know it.
Thanks we should do well, the ceac.state.gov site already has our status as 'Ready'.
P.S. Just for the record, It was more like 2 years and 3 months.

Well thats good! Hopefully it all works out for you. It seens to me you just need to send them the new info. Either way its not necessary for them to be your children to get the Visa because you are allowed to bring over your wife and her childen even if they weren't yours. If I'm wrong somebody correct me.
