Me parece que no se requiere apostilla para hacer el AOS en EEUU, pero mejor que responda alguien con experiencia con la visa K-1.

Yo apostillé esos dos certificados digitales por si un día tengo que hacer un trámite en EEUU (no relacionado a inmigración) y me lo piden. Por ahora no pasó. 

Apostillar online documentos no digitales requieren un par de pasos previos extra, así que debe tardar más, pero no tengo experiencia con eso.

El otro día pedí otra apostilla para un documento digital argentino estando en EEUU y no tuve problema, pero sigo teniendo cuenta de banco argentina con la que pude pagar por home banking el VEP que se genera. Sin cuenta no creo que se pueda.

En resumen, no te saqué mucho las dudas jaja mil disculpas!

I think his visa (IR-2) is only given an interview appointment by the NVC, like CR-1/IR-1 visas. One cannot choose.

i think it’s different for K-1 visas.

Once the interview is approved, you have to pay USD 220 either before or after entering the US (I’ve read that before is better), the consul will tell you. They gave me a paper explaining this as well. It’s an immigrant fee, without it the green card will not be created and mailed.

This is the exact same notice they have had on their website for a long time. Given that child and spousal visas are an exception to to the proclamation, I hope that it means they are planning to schedule more interviews soon.😣

That's the exact same thing they replied to me 48hs before my interview, haha. They emailed me first, even! I just replied.

So I wouldn't worry too too much about them having stopped suddenly, since now they also began processing some student visas, and lottery visas (I think?), unlike before that they were only processing CR/IR ones. Also, they cannot schedule too many people on the same day because of the pandemic. So all of this must have made them take a little longer to assign interviews.

I know it sounds like I am obsessing over the small details but this is my only chance at getting this certificate since they are doing a huge exception for my husband to issue the certificate as a Colombian even though he is also Argentinian because his DNI and argentinian passport are both expired and can't renew now due to the pandemic.

 

The instructions make no mention of that so it doesn't matter, and what matters is having the certificate itself, so don't worry!

And I completely understand, it must be so stressful.

In case it helps, this is the (argentinian) phone number of the Registro Nacional de Reincidencia (the issuing authority) -> (+54) 0800-666-0055.

If the .pdf doesn't say anything about the exception to art. 51, and doing a "reclamo" online doesn't work for some reason, as a last resort you can try and call and see if they can help somehow.

I believe an apostille/certificación si not neccessary at the NVC stage, unless it's requested. Searched around the site and it seems to be the case. Maybe at time of interview double check with the US embassy in Colombia just to be sure? (assuming that'd be where the interview will take place).

(If required after all; Colombia, United States and Argentina are all part of the apostille convention, so I would think having an apostille is the way to go, more than a certificación consular. )

In short, even if the procedures vary greatly, they all seem to indicate one should put/write "[Autoridades estadounidenses] con excepción al Art. 51 del código penal" on the "para ser presentado en:/para ser presentado ante:".

"En dicho sitio se indica que deberán solicitar este certificado de antecedentes penales mencionando específicamente "con excepción al artículo 51 del Código Penal". Aquellos que incluyan esta mención podrán hacerlo en el formulario de solicitud de antecedentes en el campo "PARA SER PRESENTADO ANTE.......".

If that works, then it might not even be needed to do the "correction" after getting it in .pdf form since it'll say the phrase already? 🤔

Hi! While we wait from someone from Córdoba to answer:

Did you get an email from the Cordoba ciudadano digital portal telling you your .pdf is ready to download at the portal? 

If they did, you could forward that, and attach the original .pdfs you downloaded from the portal.

If not, take a screenshot, attach the .pdfs, and explain the situation, and maybe give them a link where they can check the validity of the files (in my case, the .pdf itself has a link where they can check, maybe yours too?).

For Buenos Aires, we get an email saying "download the .pdf from here:" and a link. They don't send us the .pdf by mail. And that link is already expired in my case, so I forwarded the email and attached the .pdfs that I downloaded from that link last year.

Also, I'm sure they'll reply to those emails if they need anything extra/more than a screenshot. Remember to put your case number in the subject so they can see easily that is higher priority time-wise (I assume)

According to the instructions posted above, the Argentinian embassy in Colombia should help, but this might be another option:

Does your husband have an Argentinian DNI?

If he does, he can get the police certificate online here: https://www.argentina.gob.ar/justicia/reincidencia/antecedentespenales

Your husband needs a DNI and a "clave fiscal nivel 2". In that link are the instructions for getting that "clave fiscal" online, as well. 

I got that clave fiscal in person years ago so I don't know much about the online procedure, but I hope this helps.

Edit: Also, if he's successful in getting the police certificate online, there's another extra step he must do to get the art. 51 exception written in the .pdf. I explained it here:

Jaja me pasó algo parecido. Puse mi CUIT en donde pide "CUIT del Generador del VEP a pagar" y ahí pude! O sea, puse mi CUIT dos veces.

Tal vez se agreguen algunos pasos dependiendo de la provincia donde fue emitido, pero es una buena opción ya que no están dando turnos presenciales ahora. Lo inicié a mediados de agosto, y a los 15 días ya tengo apostillada la partida de nacimiento y matrimonio. Sale ARS 300 cada apostilla/documento.

Sí, fueron tres pinchazos distintos. Dos en un brazo, y uno en el otro. Fue muy dulce la señora que me las puso, fue rápido así que no tuve tiempo de sentir mucho, jaja.

Así que seguro en tu caso son las mismas que las mías (yo tengo 35), ya que parece que de 18 a 64 son las mismas para todos.

Ayer tuve el examen médico, les dejo mi experiencia 2020 (?), por si a alguien le sirve ahora/en un futuro.

(Aclaro que no se si alguna parte del examen será diferente dependiendo del sexo o edad)

Tenía turno 9:30, y a las 11:20 ya estaba en un taxi volviendo a casa, así que muy rápido todo.

• Elegí a la Dra. Grillo para mi examen.
• Llegué a Sinclair 2924 (“edificio 1”), me tomaron la temperatura en una muñeca, me hicieron pisar una alfombrita para desinfectar mis zapatos y alcohol en gel en las manos.
• En el primer piso, me ingresaron al sistema pidiendo mi DNI y allí me cobraron el análisis de sangre y los rayos x. Pagué $1610 (pesos). Me dieron la opción de pagar en efectivo o tarjeta.
• Luego me vio la doctora. Me pidió los papeles con los datos de mi caso/entrevista/formulario y mi pasaporte, verificó los datos en el sistema y me devolvió todo. Le pagué $3500 (pesos). Efectivo únicamente.
• No me pidió las fotos 5x5cm, ella saca una foto en el momento. Pero por las dudas yo las llevé. Llevé todo lo que figura en las instrucciones de la embajada.
• Me hizo preguntas de mi historia clínica: si tomaba alguna medicación, si tenía alguna enfermedad, si alguna vez fui internada/hospitalizada, si fumaba/tomaba alcohol. 
• Me tuve que sacar la ropa y quedarme en ropa interior (medias también! hacía frío, jaja) y barbijo/tapabocas. Me pesó, me midió, y me hizo una revisión general. Me pidió que le muestre la cicatriz de una cirugía que tuve en el tobillo. También, tuve que sacarme el tapabocas unos segundos y mostrarle mi boca y dientes.
• Me preguntó sobre mis vacunas. Yo perdí/no encontré la libreta de vacunación, así que me escribió una orden para vacunarme allí mismo con las necesarias según mi edad.
• También me dio las órdenes para rayos x, análisis de sangre y el de orina.
• Con todo eso, salí del edificio 1 y fui al edificio 2, a la vuelta (Cerviño 4720).
• Al entrar, lo mismo: tomaron mi temperatura y me higienicé manos.
• Luego de entregar la orden para el examen de orina, lo fui a abonar. Pagué un poco menos de $13.000 (pesos). Me dieron la opción de pagar en efectivo, débito o crédito.
• Luego de la recolección, me sacaron sangre. Después, los rayos X. Hubo un malentendido con la chica que me sacó los rayos X, porque yo le escuché/entendí que me dijo “listo, esperame afuera”. La esperé pero… no, no tenía que esperar en mi caso, jaja. Tal vez le escuché mal porque me lo dijo usando barbijo, detrás de una puerta, sumado a los ruidos de la clínica. Así que por las dudas confirmen si pueden volver con la doctora o tienen que esperar!
• De vuelta en el edificio 1, me desinfecté manos de nuevo, subí al primer piso y entregué la orden para las vacunas. Me dieron la doble adulto (creo que es la doble bacteriana), triple viral y vacuna contra la varicela (ya que nunca tuve varicela).
• Me dieron la opción de pagar en efectivo o tarjeta. Aboné un poco menos de $10.000 (pesos) por las tres vacunas. Luego de vacunarme me entregaron una nueva libretita con mis nuevas vacunas.
• Volví a ver a la doctora, chequeó las vacunas, y listo!

A las 19/20hs le escribí para confirmar que los exámenes estaban bien, y así fue. Ella se encarga de enviar todo a la embajada, ya no te entregan ningún sobre ni hay que retirar nada.

Leí que muchos le escriben previamente a alguno de los dos doctores para ver que vacunas hacen falta, así uno se puede vacunar previamente de ser necesario por su cuenta, que será muchísimo más barato seguro.

Y eso es todo! Ahora a esperar la entrevista…

The procedure to get the art. 51 exception online, is: after you get the .pdf normally, without the exception, you go to Reclamos -> Ingreso de nueva gestión -> "Reclamo - Tramitación" en el tipo de gestión, y luego seleccionás "El trámite no fue entregado con excepción al art. 51 del Código Penal."

Luego de unos días, te llega por email un nuevo .pdf corregido!

Edit: HAHA I just realized I code switched to Spanish after writing the options in Spanish.

Edit 2: If you can't find the Reclamos option, is on the https://www.argentina.gob.ar/justicia/reincidencia homepage, go to "Sacá el certificado de antecedentes penales" ->  and then below where it asks if you have a DNI, you click on "Reclamos" in the "Sistema de Gestión e Información al Usuario" section.

Unfortunately, as of right now it seems they're only processing a few type of visas, spouse visas being one since they've been declared "mission critical" in this proclamation: https://travel.state.gov/content/travel/en/News/visas-news/Proclamation-Suspending-Entry-of-Immigrants-Who-Present-Risk-to-the-US-labor-market.html (where it says "Routine visas services have been suspended...", is the list of visas that are allowed to still be processed).

This is awful for those in the K-1 process 😔

Just make sure to legalize and apostille it before you leave the country so it’s valid in the US.
